SIGNATURE OF PARTICIPANT

 

Vancouver Running Company Inc.  (to be referred to as “Vancouver Running Co.”) and its (their) directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors and assigns (all of whom are hereinafter referred as “the Releasees”)

“SPORT ACTIVITIES”: (to be referred to as “RUNNING” in this documents)

DEFINITION

In this Release Agreement, the term “RUNNING” shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by the Releasees and shall include, but is not limited to: “RUNNING”; “RUNNING” events; orientational and instructional courses, seminars and sessions; travel, transport and accommodation; and other such activities, events and services in any way connected with or related to “RUNNING”.

 

PROTECTIVE EQUIPMENT

I have been advised to wear all protective equipment that is required by the rules and regulations of the governing body for my sport.

 

ASSUMPTION OF RISKS

I am aware that “RUNNING” involves many risks, dangers and hazards. The risks, dangers and hazards, including but not limited to: loss of balance; difficulty or inability to control one’s speed and direction; variation or steepness in terrain; rapid or uncontrolled acceleration on hills and inclines; mechanical failure of equipment; variation or changes in the running surface including rocks, gravel; changing weather conditions; exposure to temperature extremes or inclement weather; travel or transport to and from the sites used for “RUNNING”; travel on highways and backcountry roads; encounters with domestic and wild animals including dogs, bears and cougars; collision with pedestrians, motor vehicles, cyclists and other players; failing to play safely or within the limitations of one’s own abilities, negligence of other participants; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RISKS RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF “RUNNING”.

 

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH “RUNNING” AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.

 

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT

In consideration of the RELEASEES agreeing to my participation in “RUNNING” and permitting my use of their services, equipment and other facilities, and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, I hereby agree as follows:

1. TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the RELEASEES AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in “RUNNING” DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN “RUNNING” REFERRED TO ABOVE;

2. TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES for any and all liability for any property damage, loss or personal injury to any third party resulting from my participation in “RUNNING”;

3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the province where the “RUNNING” takes place and no other jurisdiction; and

5. Any litigation involving the parties to this Release Agreement shall be brought solely within the province where the “RUNNING” takes place and shall be within the exclusive jurisdiction of the Courts of that province. In entering into this Release Agreement I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of participating in “RUNNING”, other than what is set forth in this Release Agreement. I CONFIRM THAT I HAVE READ AND UNDERSTOOD THIS RELEASE AGREEMENT PRIOR TO SIGNING IT, AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

The novel coronavirus, COVID-19 has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is known to spread mainly by contact from person to person. Consequently, local, provincial and federal governmental authorities recommend various measures and prohibit a variety of behaviours, in order to reduce the spread of the virus.

Vancouver Running Company Inc. and its members commit themselves to comply with the requirements and recommendations of Provincial and local Public health and other governmental authorities, and to put in place and adopt all necessary measures to that effect. However, Vancouver Running Company Inc. cannot guarantee that you will not become infected with COVID-19. Further, attending community runs and events could increase your risk of contracting COVID-19, despite all preventative measures put in place.

I acknowledge the highly contagious nature of COVID-19 and I voluntarily assume the risk that I could be exposed or infected by COVID-19 by participating in community runs and events. Being exposed or infected by COVID-19 may particularly lead to injuries, diseases or other illnesses. *

FLIGHT CREW RUN CLUB (Vancouver Running Company INC.) CODE OF CONDUCT

All members of Flight Crew Run Club are expected to abide by our Code of Conduct, during all runs and events that are hosted by and/or associated with Vancouver Running Company and/or Flight Crew Run Club.

We are brought together by our love of running. In the interest of fostering an open, welcoming, and inclusive environment, we believe in respect, compassion, understanding, and expect all Run Leaders and Ambassadors to act on these values.

We have no tolerance for any form of harassment; we expect everyone to act with compassion and to follow the social norms of the community.

THE PLEDGE

In the interest of fostering an open and welcoming environment, we pledge to make participation in our project and our community a harassment-free experience for everyone, regardless of age, body size, disability, ethnicity, gender identity and expression, level of running experience, nationality, personal appearance, race, religion, or sexual identity and orientation.

THE STANDARDS

Examples of behaviour that contributes to creating a positive environment include:

•Using welcoming and inclusive language

•Creating open and safe opportunities for discussion

•Being respectful and empathetic of differing experiences

•Referring to people by their preferred pronouns and using gender-neutral pronouns when uncertain

•Consider your language and how this may impact or exclude people in marginalized groups

•Help others in trouble - we encourage you to reach out to a community lead member if you see someone being treated disrespectfully

•Seek to support and converse with those who are new to the community

•Committing to ongoing diversity, equity, inclusion and anti-racist learnings

Examples of unacceptable behaviour by participants include:

•Any action that results in complaints from our community

•Assuming or promoting any kind of inequality including but not limited to: age, body size, disability, ethnicity, gender identity and expression, nationality and race, personal appearance, religion, or sexual identity and orientation

•Attacking personal tastes

•Continued one-on-one communication after requests to cease

•Deliberate "outing" of any aspect of a person's identity

•Deliberate intimidation

•Exclusionary jokes or comments

•Finding loopholes in the code of conduct

•Incitement of violence towards any individual, including encouraging a person to commit suicide or to engage in self-harm

•Not being respectful to reasonable communication boundaries, such as 'leave me alone,' 'go away,' or 'I'm not discussing this with you.'

•Offensive comments related to a person's identity

•Other conduct which you know could reasonably be considered inappropriate in a professional setting

•Sustained disruption of event programming

•The usage of sexualized language and unwelcome sexual attention or advances

•Threats of violence

•Trolling, insulting/derogatory comments, public or private harassment

•Unwelcome physical contact

•Unwelcome remarks regarding a person's lifestyle choices and practices

•Unwelcome sexual attention

We pledge to prioritize marginalized people's safety over privileged people's comfort and therefore we will not act on complaints regarding:

'Reverse' -isms, including 'reverse racism,' 'reverse sexism,' and 'cisphobia'.

Reasonable communication of boundaries, such as "leave me alone," "go away," or "I'm not discussing this with you".

Communicating in a 'tone' you don't find congenial.

Criticizing racist, sexist, cissexist, or otherwise oppressive behaviour or assumptions.

REPORTING VIOLATIONS

In the unfortunate case that you see someone violating the code of conduct, please contact Clare Wilkes via email (clare@vanrunco.com).

We will respect confidentiality requests for the purpose of protecting victims of abuse. At our discretion, we may publicly name a person about whom we've received harassment complaints, or privately warn third parties about them, if we believe that doing so will increase the safety of Flight Crew Run Club members, Run Leaders or the general public.

ENFORCEMENT

All reports will be reviewed and investigated and will result in a response that is deemed necessary and appropriate to the circumstances. Someone from the leadership team will approach anyone identified as participating in harassing behaviour and ask to cease any inappropriate activity or to disengage from our community immediately.
