RELEASE AND INDEMNITY AGREEMENT

COUNTY OF KERR

KNOW ALL PERSONS BY THESE PRESENTS, THAT, I,  IN CONSIDERATION OF BEING ALLOWED TO RECREATE ON THE RED ROSE RANCH, PONDA ROSA RANCH, RED BUD RANCH, OR HILL COUNTRY SHOOTING CENTER OR ATTENDING CLASSES OR INSTRUCTION OF KM FIREARM TRAINING LLC., (KNOWN HEREAFTER AS “THE RANCH”), DO BY THESE PRESENTS FOR MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY RELEASE AND AGREE NOT TO HOLD LIABLE, THE OWNERS OF THE RANCH, AS WELL AS THEIR AGENTS AND EMPLOYEES FROM ANY AND ALL ACTIONS, CAUSES OF ACTION, CLAIMS, DEMANDS, COSTS OF DAMAGES ARISING FROM OR RESULTING FROM PROPERTY DAMAGE, PERSONAL INJURY OR DEATH SUSTAINED BY ME OR MY PROPERTY WHILE RECREATING ON THE RANCH.

    I FURTHER AGREE BY THESE PRESENTS FOR MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, TO INDEMNIFY, HOLD AND SAVE HARMLESS THE OWNERS OF THE RANCH AS WELL AS THEIR AGENTS AND EMPLOYEES, FROM LIABILITY, ACTION, CLAIM, DAMAGES, AWARD OF JUDGEMENT INCURRED OF SUFFERING BY ME OR OTHERS AS THE RESULT OF ANY ACT OR OMISSION BY ME OR CAUSED BY ME WHILE RECREATING AT THE RANCH, OR IF CAUSED, PARTIALLY OR WHOLLY, BY THE NEGLIGENCE OF THE OWNERS OF THE RANCH, AS WELL AS THEIR AGENTS AND/OR EMPLOYEES.

    FURTHER, IT IS THE UNDERSIGNED’S EXPRESS INTENTION THAT THE INDEMNIFICATION PROVIDED IN THIS AGREEMENT SHALL INDEMNIFY AND HOLD HARMLESS THE OWNERS OF THE RANCH, AND OR THEIR AGENTS AND/OR THEIR EMPLOYEES FOR THE CONSEQUENCES OF THEIR OWN NEGLIGENCE, GROSS NEGLIGENCE, INTENTIONAL TORT, BREACH OF WARRANTY, STRICT LIABILITY IN TORT, PRODUCT DEFECT OR OTHER TORT LIABILITY AND FOR VIOLATION OF ANY STATUTE, ORDINANCE, REGULATION, OR RULE, INCLUDING BUT NOT LIMITED TO THE TEXAS DECEPTIVE TRADE PRACTICES ACT-CONSUMER PROTECTION ACT AND REGULATIONS WHETHER SUCH CONDUCT WAS OR IS THE CONCURRENT, OR OTHER CAUSE OF THE ALLEGED OCCURRENCE, EVENT DAMAGE, AND

    IN ADDITION, I MAKE THE FOLLOWING REPRESENTATION AND ACKNOWLEDGEMENTS: (1) I UNDERSTAND THAT WHILE RECREATING ON THE RANCH FIREARMS OR ARCHERY EQUIPMENT MAY BE USED, AND (2) THAT SUCH EQUIPMENT IS INHERENTLY DANGEROUS, AND (3) I VOLUNTARILY ASSUME ALL RISKS OF USING AND EMPLOYING SUCH EQUIPMENT OR SIMILAR EQUIPMENT, THOSE RISKS BEING INHERENT, AND (4) I AGREE THAT I WILL NOT RECREATE ON THE RANCH AT ANYTIME AFTER CONSUMING ANY SUBSTANCE THAT WILL OR MAY IMPAIR MY MENTAL AND/OR PHYSICAL FACULTIES, AND (5) I VOLUNTARILY ASSUME THE RISK OF BEING IN THE PRESENCE OR BEING NEAR OTHERS WHO WILL BE USING SAID EQUIPMENT OR RELATED PRODUCTS.

NON-NEGOTIABLE STATEMENT OF UNDERSTANDING

Thank you for using our facility.  We apologize for the on-going construction which may inconvenience our shooters.  The end result will be a place you can shoot which is a safe and wonderful experience.

SAFETY:

  1. All  GUNS ARE ALWAYS LOADED.  (TREAT THEM AS IF THEY ARE LOADED, ALL THE TIME)
  2. NEVER POINT THE MUZZLE AT ANYTHING YOU ARE NOT WILLING TO DESTROY. (THIS   INCLUDES, YOUR FOOT, HEAD, PARTNER, VEHICLE, T.V., ETC.)
  3. KEEP YOUR FINGER OFF THE TRIGGER, UNTIL YOUR SIGHTS ARE ON TARGET. (MOST IMPORTANT RULE! THINK)
  4. BE SURE OF YOUR TARGET & BACKSTOP.

RANGE RULES:

  1. RAPID FIRE IS NOT ALLOWED ON THIS RANGE!!!!!!!  CONTROLLED PAIRS ARE ALLOWED, HOWEVER, A PERCEPTIBLE PAUSE BETWEEN CONTROLLED PAIRS IS REQUIRED.
  2. WE DO NOT ALLOW RIFLES WITHOUT SIGHTS ON THE 100 YARD RANGE.
  3. NO ALCOHOLIC BEVERAGES WILL BE CONSUMED BEFORE OR DURING RANGE USE.  NO EXCEPTIONS.
  4. SAFE FIREARMS HANDLING WILL BE PRACTICED AT ALL TIMES.  HCSSC RANGE OFFICERS WILL HAVE THE FINAL SAY ON SAFETY.
  5. MINORS, YOUNGER THAN 18, WILL BE SUPERVISED BY AN ADULT AT ALL TIMES.
  6. ALL PERSONS ON THE RANGE MUST CHECK IN WITH THE RANGE OFFICER AND ARE REQUIRED TO SIGN A LIABILITY RELEASE FORM.
  7. EYE AND EAR PROTECTION ARE REQUIRED AT ALL TIMES BY ALL PERSONS ON ANY RANGE.
  8. NO SHOT LARGER THAN 7.5 WILL BE ALLOWED ON ANY SHOTGUN RANGE. NO .50 Cal BMG GUNS ALLOWED FOR DOWN RANGE SAFETY REASONS.
  9. PLEASE UNDERSTAND THAT YOUR SAFETY AND THE SAFETY OF ALL SHOOTERS IS OUR BUSINESS.

RIFLE/PISTOL PROCEDURES:

  1. REGISTER AND PICKUP TARGET BACKER FROM OFFICE/PRO-SHOP.
  2. DRIVE THROUGH THE GREEN GATE AND YOU MAY PARK TO THE LEFT OF THE RANGE.
  3. PLACE 1X2 STICKS IN TARGET STANDS PROVIDED ONLY AT THE 25/100 YD BERMS.
  4. YOU MAY TAPE ANY PAPER TARGET YOU WISH TO THE TARGET BACKER.
  5. YOU MAY NOT SHOOT CANS-BOTTLES-ROCKS. JUST THE TARGET ON THE CARDBOARD BACKER.
  6. RIFLE BENCH REST SHOOTING ONLY AT 100 YARDS.  DO NOT MOVE THE STANDS OR SHOOT ANYWHERE OR ANYTHING ELSE.  PISTOL SHOOTERS MAY SHOOT FROM 3’ TO 25 YARDS IN COOPERATION WITH OTHER PISTOL SHOOTERS ON THE RANGE.
  7. BE SURE THE RANGE IS CLEAR AND ENJOY GOOD SHOOTING.
  8. WHEN SHOOTING SESSION IS COMPLETE, UNLOAD AND STORE YOUR FIREARM.
  9. ALL TRASH-EMPTY AMMO BOXES, ETC., PLACE IN TRASH RECEPTACLE.
  10. PLEASE RETURN TARGET BACKER AND CHECK OUT AT OFFICE WHEN FINISHED.
