Waiver and Release of Liability

 

In consideration of Cross Creek Clays furnishing services, equipment, and/or the facilities and in consideration of my participation in clay shooting and other related activities (the “Sport”), I agree as follows:

 

I fully understand and acknowledge that: (a) there are risks and dangers in my use of Sport equipment and my participation in the Sport; (b) my participation in the Sport, use of equipment, and/or presence at Cross Creek Clays facilities may result in damage to or loss of personal property, personal injury, death, or other ailments that could cause serious disability; (c) these risks and dangers may be caused by the negligence of the shareholders, and that risks and dangers may arise from foreseeable or unforeseeable causes, and; (d) I, on behalf of myself, my family, heirs, executors, administrators, representative and assigns, assume all risks and dangers and all responsibility for any losses and/or damages which result from my participation in the Sport or presence in or on Cross Creek Clay facilities. (e) WE RECOMMEND TAKING INSTRUCTION OR GUIDES FOR ALL BEGINNERS. (f) I HAVE READ THE COURSE RULES INCLUDED WITH THIS WAIVER AND RELEASE.

 

I, for myself, my spouse family, heirs, executors, administrators, legal representatives, and assigns, hereby release, waive, discharge Cross Creek Clays and its officers, shareholders, directors, employees, and agents (collectively, “Released) from any and all claims actions or losses for injuries, property damage, death, loss of services or other, arising out of my participation in the Sport or presence in or on Cross Creek Clays facilities, whether due to the fault or negligence of Releasees, circumstances beyond Releasees’ control, or other.

 

That this Release and Waiver contains the entire agreement between myself and Cross Creek Clays. The terms of this Release and Waiver are contractual and not a mere recital.

 

I HAVE READ THIS RELEASE AND WAIVER, AND THE COURSE RULES CAREFULLY AND BY SIGNING IT AGREE IT IS MY INTENTION TO RELIEVE CROSS CREEK CLAYS FROM LIABILITY FOR INJURIES, PROPERTY DAMAGE, OR DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSES. I ALSO UNDERSTAND AND WILL FOLLOW THE SPORT RULES, GUIDELINES AND RULES THAT MAY ALSO BE POSTED AROUND THE COURSE AS IMPOSED BY INTENDING TO BE LEGALLY BOUND:

 

Course and Property Rules

 

Guns must be carried with actions open and empty. Don’t be afraid to ask someone to open their gun; don’t be offended if someone asks you. Practice gun safety and use common sense.

Eye and Ear protection required for shooters and observers at all times.

Hats are strongly recommended.

If you observe an unsafe situation, vacate the area and report it immediately to CCC staff. Failure to observe Range Safety Rules is not tolerated and may result in being disqualified from the range.

Practice swings are not allowed outside shooting station uprights.

Do not shoot at target chips or deflected or errant targets.

Guns must not be loaded until in the station ready to shoot with barrels outside the barrier.

Do not approach trap equipment for any reason. If a trap malfunctions, do not go downrange, please notify our staff.

Maximum of two (2) shells may be loaded at any time. Please help us keep CCC clean by picking up your hulls and using designated trash receptacles.

Back-up shooting is not allowed (only one shooter allowed at a time).

Shot size: 7 ½, 8, 8 ½, 9 only allowed

No magnum loads, no tracers, no 12 GA 3” shells. No black powder.

Only Factory new ammunition may be used in CCC rental guns.

Minors under 18 must be with an experienced adult.

It is strictly forbidden to shoot any live bird or animal on this range.

Participants and observers must sign a liability waiver and agreement.

We are not responsible for any damages to your person or any equipment that falls off a golf cart/ATV for any reason whether it’s yours or Cross Creek Clay’s. Drivers of a golf cart/ATV, whether it’s yours or Cross Creek Clays’ must possess a valid automobile driver’s license.

No golf cart/ATV speeding. Speeding is considered driving faster than a person jogging or a staff's judgement. Speeders will be asked to leave for the day with no refund, NO WARNINGS! Only licensed drivers may drive Cross Creek Clays Carts.

Follow course signage and directions. All golf cart riders must be seated. No hanging or standing on the back of a golf cart or ATV. No more than 4 riders per cart.

Always park off to the side of the road, but remain on the road. Always leave room for others to pass safely.

All guns must be field shotguns i.e.: no pistol grips or collapsible stocks; 26” barrel minimum.

No alcoholic beverages are allowed in the shooting areas.

If you or your party brings alcohol and consume such you assume full responsidbility of your actions and you indemnify Cross Creek Clays, LLC of any of your actions or any damages caused by the consumption of alcohol and you understand Cross Creek Clays, LLC does not serve alcohol on the premises.

Any infraction of these rules will result in loss of privileges and possible expulsion from the property with no refunds.
