EQUINE RELEASE AND WAIVER OF ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

Fun-E Farm T.O.O., LLC does not guarantee your safety from your participation in horseback riding, maintenance and care activities. AGREEMENT made on October 16, 2026 between Fun-E Farm T.O.O., LLC located at 3488 Church Road Gilbertsville, PA 19525 , ALL neighboring properties and participant(s) listed below:

I hereby enter into this agreement in consideration of my/my ward's ability and permission to ride OR use any horses and/or animals and/or equipment owned by Fun-E Farm T.O.O., LLC ("OWNER") whose address is 3488 Church Road Gilbertsville PA 19525 and ALL neighboring properties and property owners.

IMPORTANT NOTICE: BY SIGNING THIS AGREEMENT YOU ARE GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO RECOVER DAMAGES IN CASE OF INJURY, DEATH, OR PROPERTY DAMAGE, ARISING OUT OF YOUR RIDING OR USE OF THE OWNER'S HORSES AND/OR ANIMALS AND/OR EQUIPMENT AND/OR PARTICIPATION IN EQUINE ACTIVITIES AT FUN-E FARM T.O.O., LLC, AND NEIGHBORING PROPERTIES AND OWNERS, INCLUDING INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF THE NEGLIGENCE OF YOU OR FUN-E FARM T.O.O., LLC. AND OR NEIGHBORING PROPERTIES AND OWNERS.

READ THIS AGREEMENT CAREFULLY BEFORE SIGNING IT. YOUR SIGNATURE INDICATES YOUR UNDERSTANING OF AND AGREEMENT TO ITS TERMS.

By signing this form, I hereby acknowledge on behalf of myself/ my ward that I have familiarized myself with the activities that I will be allowed to participate in, and that I hereby acknowledge and agree that I/ my ward will participate in these activities without restriction or limitation. I recognize the inherent risks involved in horseback riding and working with horses and animals, including but not limited to:

  • Bites, kicks, abrasions or contusions from horses and animals
  • Being throw or bucked off by horses and animals -Scratches or other injury from grooming tools and other equine equipment and tack
  • Allergic/bacterial reactions to animals, hay, or other allergens
  • Tripping in holes or on materials or farm equipment; getting harmed in any way by use of farm equipment
  • Slipping, falling, or otherwise being injured in the barn, in stalls, or on the grounds which can be slippery, muddy, wet or c contain or present other hazards
  • Being injured as a result of the unpredictability of horses and animals

I hereby specifically forever waive and release Fun-E Farm T.O.O., LLC and its principals and agents AND ALL neighboring properties and owners, from any liability for injury arising out of the inherent risks from riding, working or participating in a stable environment and/or with horses and/or animals and/or equipment, as well as from the active negligence of Fun-E Farm T.O.O., LLC, its principals and agents.

By signing this agreement I hereby acknowledge that although there may be supervision during my time spent at Fun-E Farm T.O.O., LLC, or on neighboring properties and owners, there will not be a nurse on the premises and Fun-E Farm T.O.O., LLC and its principals and agents bear no responsibility for my health or medical care.

I agree to indemnify, save and hold harmless Fun-E Farm T.O.O., LLC and its principals and agents and neighboring properties and property owners, from and against any loss, liability, damage, attorneys’ fees, or costs that they may incur arising out of or in any way connected with either my presence or participation at Fun-E Farm T.O.O., LLC or any acts or omissions of Fun-E Farm T.O.O., LLC principals or agents.

By signing this Agreement, I hereby acknowledge my complete understanding, agreement and consent to my presence and/or participation in the activities at Fun-E Farm T.O.O., LLC, and neighboring properties and owners, without restriction, without liability to Fun-E Farm T.O.O., LLC, its principals or agents, and neighboring properties and owners, and with full knowledge and understanding of the disclosures, waivers, and releases herein.

If I am present at and participate in the activities of Fun-E Farm T.O.O., LLC and or on neighboring properties and owners, I do so at my own risk, and I hereby acknowledge and agree that Fun-E Farm T.O.O., LLC and neighboring properties and  owners, and/or any of its principals and agents shall bear no responsibility or risk associated with injuries that could arise from my presence or participation at Fun-E Farm T.O.O., LLC.

AGREEMENT AND WARNING: I understand and acknowledge that, except for limited circumstances listed below, an agritourism activity provider is not liable for any injury to or death of a participant resulting from an agritourism activity. I understand that I have accepted all risk of injury, death, property damage and other loss that may result from an agritourism activity. I understand that an agritourism activity provider is not protected from liability if the provider: (1) Performs an act in a grossly negligent manner and causes injury or damages to a participant. (2) Purposefully causes a participant’s injury. (3) Acts or fails to act in a way that constitutes criminal conduct. (4) Recklessly fails to warn or guard against a dangerous condition that causes injury or damages to a participant. A dangerous condition is a condition that creates an imminent and substantial risk of injury or damages to a participant.
