BUCK & DOE’S MERCANTILE WAIVER, RELEASE, INDEMNITY, CONSENT AND RANGE RULES AGREEMENT

All those who wish to use this facility in any capacity – whether observing, shooting a personal firearm, shooting a rental firearm or participating in events in the archery range – must fill out this form in its entirety.  All information will be kept confidential and will not be distributed to others for any purpose.  This waiver is strictly for use by Buck & Doe’s Mercantile.

Lawful Possession of Firearm and Ammunition:  I affirm I can lawfully possess firearms and ammunition under State and Federal Laws.

Assumption of Risk:  I hereby release Buck & Doe’s Mercantile, its member entities, owners, employees, officers, directors, club members, volunteers, instructors, guests, agents, and affiliates from all liability for personal injury or property damage through use, in any way, of the facility, its equipment, its bows, its firearms, or my own firearm.  I agree to indemnify Buck & Doe’s Mercantile from responsibility for any claims or demands arising out of such use.  I agree to accept and assume any and all risks existing at Buck & Doe’s Mercantile facility and its operations at 24250 US Highway 281 North, San Antonio, TX 78258.  I acknowledge and understand that shooting activities are hazardous and involve risks both known and unanticipated.  I agree to assume all responsibility of these risks, which could result in damage to property and serious physical or emotional injury, including paralysis or death, to others or myself.  Possible known and unknown injuries may include, but are not limited to:  being shot or injured in any manner by myself or others, shooting others, partial or total loss of eyesight or hearing, burns, amputation, inhalation, exposure or other harmful contact with lead or contaminants, being struck by flying or falling debris or projectiles, disability, and death.  I agree to assume all liability for any act, acts, or omission to act, even any negligent, reckless, or criminal act by any other or myself.

Release and Indemnification:  I agree that myself and my heirs, guardians, representatives, successors, that myself and assigns release and forever discharge and agree not to sue Buck & Doe’s Mercantile officers, managers, directors, attorneys, agents, employees, contractors, volunteers, and guests.  I release and discharge these same parties for any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever that I may have for property damage, personal injury, or death resulting from my entering the premises, using the facilities or equipment, or engaging in or observing shooting and other activities at Buck & Doe’s Mercantile facility and its operations, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result from any acts of Buck & Doe’s Mercantile, even any negligent act or omission to act including negligent or omitted first aid or rescue operations of procedures.

Further, I agree to indemnify, defend, and hold harmless Buck & Doe’s Mercantile for any and all claims, damages, demands, causes of action, expenses, attachments of property, attorneys’ fees, court costs, or liability of any kind that any person or entity may have for property damage, personal injury, or death resulting from my entering the grounds or premises, using any facilities or equipment, or engaging in or observing shooting and other activities at Buck & Doe’s Mercantile facility and its operations to the extent that such claims, damages, demands, causes of action, expenses, attachments of property, attorneys’ fees, court costs, or liability result partially or wholly from any negligent act of participant, or any act that would subject participant to strict liability.

Medical Certification:  I certify that I have no medical or physical conditions that could compromise my safety and the safety of others in any activities at Buck & Doe’s Mercantile facility.  I certify that I have adequate insurance to cover any injury or damage I may cause or suffer, or else I agree to personally bear the costs of such injury or damage.

General Range Rules:  I acknowledge that I have read, understand, and agree with the General Range Rules listed below.

a) Never enter Buck & Doe’s Mercantile with a loaded firearm, other than a conceal carry weapon or “Open Carry” personal defense weapon that must remain holstered.
b) On the firing line, always point the muzzle downrange and treat as if the firearm is loaded at all times.  Downrange is the only safe direction.
c) Always keep your finger straight and off the trigger until your sights are on target and you are ready to fire.
d) The use of drugs or alcohol on Buck & Doe’s Mercantile property is prohibited.  Persons under the influence of drugs or alcohol will be denied the use of Buck & Doe’s Mercantile facilities.
e) Smoking or vaping while in the building, range or restroom is prohibited.
f) Eating or drinking in the range is prohibited.
g) Horseplay is prohibited.  Horseplay or other activities not related to shooting are not allowed on the range.
h) No person is allowed inside the shooting bays unless they have a current signed waiver on file.
i) User ages:  Pistol shooters must be 21 years of age or older, or be supervised by a parent or legal guardian with a current consent signed or on file .  Rifle shooters must be 18 years of age or older, except, children under 18 may shoot when supervised by a parent or legal guardian where a current consent has been signed or is on file.
j) Buck & Doe’s Mercantile does not allow visitors or spectators in the range. Minors cannot be left unattended.
k) Only paper targets are allowed on the range.
l) Commands issued by the Range Safety Officer (“RSO”) or any range staff must be followed immediately.
m) Any violation of the safety rules, operating procedures, or RSO instructions can be cause for removal from the premises.

Firearm and Ammunition Safety Rules:  I acknowledge that I have read, understood, and agree with the Firearm and Ammunition Safety Rules listed below:

a) Know how the firearm operates.
b) Be sure that the firearm and the ammunition are compatible.
c) Keep the action open and the firearm unloaded until ready to use.
d) Keep fingers off the trigger and outside the trigger guard until ready to shoot.
e) Drawing from the holster requires prior approval from the Range Safety Officer.
f) Tracer, steel core, armor piercing, steel sabot slugs, incendiary and black or green tip ammunition are not allowed on the range.  All ammunition is subject to inspection upon entering the range. Only brass or nickel cased ammunition is allowed on the range. No reloaded ammunition is permitted.
g) Use of fully automatic firearms is prohibited without prior approval of the Range Safety Officer.  A Range Safety Officer must be present one-on-one during loading and firing of rental automatic firearms.
h) For shotguns, only slugs or single projectile are permitted.  Shotgun shot and steel sabot slugs are prohibited.

Range Operating Procedures:  I acknowledge that I have read, understand, and agree with the Range Operating Procedures listed below.

a) Hearing and eye protection must be worn on the range.  See the Range Safety Officer if you need to purchase hearing and/or eye protection.
b) Any shooting that causes damage to the range or equipment may result in a repair fine up to $10,000.00 in addition to actual damages up to $15,000 and/or removal from the range.
c) All firearms will be unloaded with the action open and magazines removed before entering or leaving the range.  Unloaded firearms may be transported in gun cases, with the actions closed.
d) All firearms will be placed on shooting benches with the muzzles pointed down range.
e) When sharing a firearm with a person, the firearm must remain in the original lane and the person may exchange positions.  The firearm may not be passed from one lane to another.  A firearm may not be exchanged directly from one person to another.  It must be placed on the bench and it may then be picked up by the second person.
f) No one is permitted forward of the gun firing line, at any time, for any reason.
g) No person is permitted forward of the archery firing line, unless the command is made and acknowledged by the other participates.
h) Please allow adequate time to unload your firearm and clean up your area and targets.  You are permitted to stay in the range for a reasonable amount of time and as long as you are shooting. The RSO has complete authority to determine if a session is over and shall instruct a shooter when their time has expired.
i) When a cease-fire is called, immediately set your firearm on the bench and step back to the rear of the bay.  Remain in the back of the bay until the Range Safety Officer announces the lane is ready to resume firing.
j) Shoot only at the target in your lane.  Please place the target so it is the correct height and you are shooting parallel so that your projectile strikes the center of the trap.
k) It is your responsibility to clean up after yourself.  Brass on the ground – except from your firearm – does not belong to you.  You may NOT take brass for yourself unless approved by the Range Safety Officer.

Other Rules:  I agree to abide by all written, video, and verbal safety rules issued by Buck & Doe’s Mercantile instructors, staff, archery staff or Range Safety Officers, and to supply my own safety equipment.

Definition of Firearm and Archery:  For the purposes of this Agreement, a firearm is defined as any pistol/handgun, rifle, shotgun and/or machine gun or device of any description or design whether single shot, semi automatic, or fully automatic which discharges a projectile by the use of gunpowder.  For the purpose of this Agreement, archery includes bows, compounds, crossbows, catapults and slingshots or any device capable of firing a projectile without the use of gunpowder.

Venue:  This Waiver and Release and Indemnity Agreement is governed by the laws of the State of Texas.  Venue shall be San Antonio, TX. This release is binding on heirs, executors, assigns and administrators.

I have fully and carefully read this (1) Waiver, Release and Indemnity Agreement and (2) Range Rules Agreement and understand its contents.  I am aware that this is a release from liability and indemnification agreement and a contract between Buck & Doe’s Mercantile and myself and that it imposes limitations to my legal rights.  I sign it of my own free will.  I certify that I will not operate any firearms or equipment with which I am not completely familiar.

I also consent to be financially responsible for and reimburse Buck & Doe’s Mercantile for any shooting that causes damage to the range or equipment or store.  I acknowledge that my shooting activities are recorded by a video camera for this purpose.  I consent to any repair or replacement for actual damages of up to $15,000.00 and/or removal from the premises, and/or termination of my membership or disbarment from Buck & Doe’s Mercantile.

Consent for Minor: As parent/legal guardian, I consent to my child/young adult who is under the age of 21 years old, to shooting a personal firearm, rental firearm or the use of a personal or rented archery item (bow, crossbow, etc..) on the date of this Agreement which shall remain in effect for one year. My consent applies as long as I remain on site and maintain a physical presence at Buck & Doe’s during the activity. I understand this consent is given to encourage participation in firearm education, classes, or improvement of shooting skills through supervised or unsupervised activities.
