Please read, sign, and fill out this questionnaire (10 minutes max.), for our records and in an attempt to provide the best travel experience for you.

Please note: this is a very standard adventure travel company liability waiver.

PARTICIPANT RESPONSIBILITY:


Trip participants are responsible for their own well being. This includes being in good health and strong physical condition. Participants joining an adventure travel and/or walking tour should consult with a physician, and even obtain a physician’s release prior to departure. Participants are responsible for: knowing all pre-departure information, preparing and bringing proper equipment and clothing, conforming to basic standards of personal hygiene (to minimize the risk of travelers diseases), and acting in a considerate and polite manner toward all group members, to the guide/s, and to local restaurant and hotel staff, and with respect for each country’s customs. No refunds will be given if the trip participant chooses to leave the trip for any reason, or if the trip participant leaves the trip due to medical or physical reasons, or if the guide deems the person not healthy or strong enough physically to continue on the trip or on a walk/hike, or if they have an injury that the guide deems unsafe for the trail or the trip as a whole. All trip participants are responsible for any and all expenses incurred if they leave the tour or if they get sick or injured or need an evacuation.


CONDITIONS OF ADVENTURE TRAVEL TOURS:

Right Path Adventures (hereby known as RPA) is committed to helping all travelers achieve their personal goals safely and enjoyably. RPA, its owners, agents, employees, officers, guides, directors, associates, affiliated companies and subcontractors, hereby give notice that they act only as agents for hotels, transportation companies, land operators and suppliers of travel services. RPA assumes no responsibility or liability in connection with the operation or service of any guide or travel agency, aircraft, motor vehicle, other conveyance, inn, lodge or hotel, cable car or chair lift which may be used wholly, or in part, for services to RPA and its clients. RPA, its operators, airlines and agents will not be responsible for any act, error, omission, nor for any injury, loss, accident, delay, inconvenience, irregularity or damage which may be occasioned by any cause whatsoever. This includes acts of nature, civil disturbance, government restrictions, acts of God, or failure of any means of conveyance to adhere to the published schedule.

RPA reserves the right to change the price or cancel or withdraw any tour, or any guide for any reason whatsoever prior to departure. After departure, RPA reserves the right to alter or omit any part of the itinerary, to substitute hotels, guides or trip leaders, to change any means of conveyance without notice with liability for increased costs (if any) borne by the trip, course or expedition members. RPA reserves the right to accept or reject any person as a tour member at any time and will refund a prorated amount and reimburse that person within 120 days of the end of the trip.

You should be aware, that during the adventure travel and/or active and/or walking tour, in which you are currently participating, or will participate in, under the arrangements of RPA, certain risks and dangers may arise including, but not limited to: steep or treacherous terrain; inclement weather; avalanches, rock fall and other natural occurrences; slips and falls; misuse, failure or loss of equipment; shortage of food or water supply; use of ropes and equipment; the hazards of traveling in politically unstable areas; the dangers of civil disturbances and war; COVID conditions; the forces of nature; the risks of exposure to insect bites; the hazards of ocean and river water; acts or omissions of RPA; travel by boat, automobile, train, ship, helicopter, aircraft or other means of conveyance; the risk of altitude and cold including hypothermia; my own physical condition, illness, and the physical exertion associated with this activity and accident or illness in remote places without access to medical facilities, transportation, or means of rapid evacuation and assistance.

Any legal action must be made and/or filed within ten days after the last day of your tour and any court cases will take place in Las Vegas, Nevada.  Please note Gary Scott & RPA have never been sued or involved in any lawsuits or legal action against them.

Please note you will be required to fill out and sign a standard online Liability Waiver at least 30 days before your trip departure date. Travel insurance is HIGHLY RECOMMENDED.

Terms & Conditions & Booking Policy changes:

Due to the fluid situation with Covid-19, world weather, wars, and situations unknown to us going on around the world, we reserve the right to update these policies at any time and without prior notice.

BOOKING A NEW TRIP

Prices are per person based on double occupancy, quoted in US dollars, and are set well in advance of the trip departure date. Our prices vary depending on a variety of cost factors, with peak travel dates being the most expensive. Prices may change during the course of the year. You can always find the most current prices on our website, or by calling us. Prices cover land costs only; they do not include airfare to and from the trip or delays getting to the trip. Trip prices include baggage transfers, porterage and all ground transportation during your trip. Please see the web page for each trip for the specific details for all items included and not included in the trip price for each specific trip as they do vary depending on the trip.

Trip Deposits: 

Deposits may be made on our website via credit card on PayPal and/or by check, money order, wire transfer in US or AUS dollars or a major credit card.

The deposit is $500 per person for Scheduled Departures.

For Private & Custom Departures a $2,000 group deposit is required to initiate your request and secure your itinerary for your group. The Private Trip deposit is refundable (minus a $250 administrative/booking fee) for two weeks while you gather your group. Once confirmed, the initial $2,000 deposit may be applied toward the first two individuals to sign up and a $1,000 per person deposit is required for subsequent guests. If we are creating custom dates for your group or a private trip for you, the $2,000 deposit is non-refundable once the date is confirmed by us.

Paying Your Balance: The balance of your trip cost is due 120 days before the start date of your trip. We will send you an invoice for the balance due. Balances may be paid by PayPal, check, money order, wire transfer in US dollars or by major credit card. If final payment is not received when due, Right Path Adventures reserves the right to cancel your reservation.

Travel Insurance Policy: We strongly suggest taking out Travel Insurance for all Right Path Adventure tours. Given the active nature of our vacations—and your lifestyle—we know unexpected things that could impact your trip!

No one likes to think about what could go wrong on vacation, travel insurance may help protect your investment from unforeseen circumstances before and during your trip such as: Sickness or injury; Job loss or relocation; Travel delays or trip interruption; Lost or delayed luggage; Death or illness in the family; Hurricane, fire and other natural disasters; Medical evacuation; COVID-19 positive test result; Civil disturbances such as war; And other covered reasons.

Please note if you leave a trip early for any reason you will not receive a refund and any and all costs of leaving early will be your responsibility.

In the unfortunate event you must cancel your trip, you will be responsible for any cancellation fees incurred, up to 100% of your trip price. A travel protection plan can help to protect your vacation investment up to 100% of your trip cost for cancellation due to unforeseen covered reasons and is a small price to pay for some peace of mind.

Guest Transfer & Cancellation Policy: If you must cancel your reservation, your cancellation fee will be determined according to the terms outlined below.

Scheduled Trips: Transfers to another trip or credit on account for a future trip are only allowed before the final payment due date, after which time cancellation fees apply. If the new trip costs more than your original trip, you must pay the difference. Reductions in the group size may result in an increased trip price due at final payment.

Private & Custom Trips: Transfers to another trip or credit on account for a future trip are only allowed 120 days prior to the trip, after which time cancellation fees apply. If the new trip costs more than your original trip, you must pay the difference. Reductions in the group size may result in an increased trip price due at final payment.

Exceptions to our cancellation policy cannot be made for any reason, including but not limited to weather, terrorism, civil unrest, epidemics or the threat thereof, personal, family or medical emergencies or force of nature. There is no refund for arriving late or leaving a trip early. Private and upgraded rooms are considered part of the total trip cost and are subject to cancellation fees. We encourage guests to consider comprehensive Travel Protection plans for cancellation reasons that fall outside of our policy.

Right Path Adventures reserves the right to suspend departures in cases of force of nature or the failure of third parties—such as hotels — and to honor their reservations, in which case, all payments received to date will be transferred on account for use on a future trip (must be used within 24 months). Right Path Adventures is not responsible for expenses that are incurred in preparation for any suspended trips, such as airline tickets, or for costs that are incurred due to travel delays, flight cancellations or illness. All policies are subject to change.

Deposits:

Deposits for a Scheduled Trips is $500 per person and final payment is due 120 days from the start of the trip.

Deposits for Private/Custom Trips is $2,000 and final payment is due 120 days from the start of the trip.

Cancellation Fees (per person):

For Scheduled Trips:

156 + days from the start of the trip = $200 cancellation fee (*)

96 - 155 days from the start of the trip = $300 cancellation fee (*)

61 - 95 days from the start of the trip = 75% of fees paid.

0 - 60 days from the start of the trip = 100% of fees paid.

For Private/Custom Trips:

156 + days from the start of the trip = $600 cancellation fee (*)

96 - 155 days from the start of the trip = $1,000 cancellation fee (*)

61 - 95 days from the start of the trip = 75% of fees paid.

0 - 60 days from the start of the trip = 100% of fees paid.

Please note: Due to our very busy guiding season any refunds will not be paid until 120 days after the trip booked is over.

(*) – Rather than paying the cancellation fee, you may choose to keep your trip deposit on account to use on a future Right Path Adventures trip for use within 24 months (less a $250 administrative/cancellation fee). You will be responsible for paying the difference if a trip fee increases.

Trip Forms & Release of Liability: Guests are required to complete and sign our Release, Assumption of All Risks, and Binding Arbitration Agreement and the Personal Information Form. These forms will be emailed to you after you leave a deposit and your trip is confirmed. We require all forms to be completed prior to final payment. We are unable to allow guests to participate in any aspect of a Right Path Adventures trip without a signed release form.

As we’ve learned during these past few years, what makes sense today may not make sense tomorrow. Please understand that we reserve the right to change these policies without prior notice due to the numerous very fluid and unpredictable situations occurring in the world.

I certify that I have adequate medical, travel and accident insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself.  (Please note that if you become sick or injured your guide will call for emergency services including a rescue team and or a helicopter and/or ambulance which will be your responsibility to pay for).  I further certify that I am willing to assume the risk of any medical or physical condition I may have.  I also agree that I am responsible for any costs associated with leaving the trip early for any reason, including my inability to complete a normal walk, or if I am injured and need to be evacuated and understand I will not be due a refund and must pay all expenses myself.  I agree that RPA has strongly recommended that I take out travel insurance as soon as possible after joining this trip.

"Nothing in this waiver supersedes the rights and protections to which I am entitled under Directive (EU) 2015/2302 of the European Parliament and of the Council.  In the event that any portion of this waiver shall be deemed to conflict with Directive (EU) 2015/2302, then Directive (EU) 2015/2302 shall prevail."
