Waiver Form Escape 60

RELEASE OF LIABILITY

In exchange for participation in the Escape Room Event organized by NEXT GEN 6S INC, of 1638 10th Ave SW or 5542 1A ST SW property, facilities and services of Escape 60 Calgary, AB, I agree for myself and (if applicable) for the members of my family, to the following:

I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Escape 60, or the employees, representatives or agents of Escape 60.
I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Escape 60 for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Escape 60 Calgary, whether caused by the fault of myself, my family, Escape 60 or other third parties.
I agree to indemnify and defend Escape 60 against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Escape 60 Rooms.
I agree to pay for all damages to the facilities of Escape 60 caused by my or my family's negligent, reckless, or willful actions.
Any legal claim that may arise from participation in the above shall be resolved under Alberta Law.
I agree that Escape 60, or the employees, representatives or agents of Escape 60 Rooms, has the right to any photos or any video/sound footage of me during the Escape 60 event. These photos, video footage, and sound materials may be used for any marketing purposes.
I agree all game details of Escape 60 are trade secrets that are protected by Intellectual Property Laws, and I shall keep any games details or other information obtained confidential. No use, copy, distribution, public display or creation of any game details or other information or derivative work is permitted without the consent of Escape 60.
I agree all personal belonging such as cell phones, keys, tablets, laptops, bags, lighters, books, pens, recording devices (this list is not exhaustive) will not be brought into the room and will be left with employees of Escape 60 in a locked area.
I understand that Escape 60 reserves the right to terminate the game without refund at anytime if participants are being unsafe, are causing damage to the facility and or are not following the rules and policies of the company.
I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Escape 60 has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement. I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
