PARTICIPANT ASSUMPTION OF RISK, RELEASE, AND AGREEMENT Golf Cart Rental

In consideration of the services of Greenbrier Outfitters, Inc. d.b.a. Gasparilla Adventures, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as GA), I hereby agree to release, indemnify, and discharge GA, on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate. I agree to the following:

1.  Operator must be at least 18 years of age.

2.  Operator must have a valid driver’s license.

3.  No more than 4 people in a four passenger cart and no more than 6 people in a six passenger cart.

4.  Guest is fully responsible and liable for the cart and the actions of its driver and occupants.

5.  Guest is fully responsible for any and all property damage caused by the golf cart in his/her name.

6.  Guest is fully responsible for and will reimburse GA for all loss or damage to cart tires, accessories and/or equipment.

7.  GA shall not be liable for loss or damage to cart or any property left, stored, or transported by guest or any  other person in or upon vehicle either before or after the return thereof to GA whether or not said loss or damage was caused to/or related to the negligence of guest. Guest hereby assumes all risk of such loss or damage and waives all claims against GA and will indemnify GA for claims based upon or arising out of such losses.

8.  Guest agrees to hold GA harmless and to indemnify GA against any loss arising out of the golf cart or anyone who operates said vehicle with guest’s permission. Guest agrees to reimburse GA for any loss sustained as a result of any claim made against them, including reasonable attorney’s fees.

10. There is a $50 charge for lost or not returned keys or charging cords

11. A $50.00 fee will be assessed for any cart, not on our delivery and pick-up program and not returned to our shop.

12. IF I, OR ANY MEMBEROF MY PARTY ROLL OR FLIP A CART, I UNDERSTAND THAT A MINIMUM CHARGE OF $3,000 WILL BE APPLIED TO COVER REPAIRS AND LOST REVENUE.

By visiting Gasparilla Adventures, you voluntarily assume all risks related to exposure to COVID-19.

I grant to Resort Outfitters, its associated companies, its representatives, and employees the right to take photographs of me and publish them in print or electronically. I consent that Resort Outfitters and its associated companies may use my photograph for, but not limited to, publicity, advertising, and Web content.
