Liability Release for Rent Adventure.

This agreement releases Active Energy LLC, DBA Rent Adventure as the rental agency its employees and Hot Springs Hideout LLC as the property owner from all liability relating to injuries that may occur during the use of any equipment rented, tours trips or guiding services; including inner tubes, kayaks, rafts, drift boats and paddleboards etc.

Assumption of Risk

I also acknowledge the risks involved in any water activity. These include but are not limited to injury, including the possibility of death due to river conditions and use of equipment and decisions made navigating the water. I swear that I am participating voluntarily, and am aware of possible risks. Additionally, I do certify I do not have any health conditions that will increase my likelihood of experiencing injuries while engaging in this activity.

By signing below I forfeit all right to bring a suit against Active Energy LLC and Hot Springs Hideout LLC for any reason. In return, I will receive rentals for water activities and/or guided trips. I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed. If any part of this agreement is found to be void it will have no effect on other sections of the agreement. In the event rescue or help is needed local emergency personnel will contacted and/or available Rent Adventure resources may be used at our discretion. Signers grant permission for first aid, CPR and AEDs; authorizes emergency transport; authorizes sharing medical information with medical personnel; assumes all costs involved

Waiver of Negligence

In consideration of ordinary negligence by the provider I hereby release Rent Adventure, employees, affiliates and volunteers from any and all claims and release is on behalf of the signer, spouse and heirs. By signing this agreement, I agree to hold Rent Adventure and Hot Springs Hideout LLC entirely free from any liability, including financial responsibility for injuries/death incurred or hardship, regardless of whether injuries are caused by my own or Rent Adventure’s negligence.

I agree to pay for any damaged or lost equipment I have checked out.

It is highly recommended all ages wear lifejackets and is required for any minors under the age of 18 during any and all water activities. By signing below you are responsible for any minors in your group.

 

All customers signed below fully understand and agree to the above terms and are responsible for any minor(s) listed below and certify they are the responsible party. I affirmation that the signer(s) are voluntarily participating in the activity, and is voluntarily signing the agreement with the full intent of releasing the provider of liability for injury or loss due to the inherent risks of the activity or due to the ordinary negligence of the provider.
