Release and Indemnification Agreement

The Denver Police Activities League, Inc. is a non-profit charitable organization established in 1969 to provide community based activities, including athletic, educational and historical activities to the youth of Denver, as well as provide a positive interface between the Denver Police Department and our community and its youth.

One such program is the D-Day Leadership Academy, named after the American/ Allied invasion of the Normandy France beaches on June 6, 1944 during World War II – the D-day invasion.  Here, we enlist local law enforcement personnel to join and mentor children from our area in a joint trip to Normandy, so as to keep alive the incredible effort and sacrifice of truly the Greatest Generation and the history surrounding those Veterans and their accomplishments.

As part of that trip to France, we ask all parties to acknowledge that there are certain risks that PAL cannot assume.

Accordingly, this Release, Waiver of Liability and Indemnity (“Release”) is executed on this June 16, 2025, for the reliance and benefit of the Denver Police Activities League, along with its officers, directors, employees, volunteers, members, representatives and any and all other related personnel (the “Denver PAL”), and its program known as the D-Day Leadership Academy (the “DLA”).

I desire to participate and engage in the Denver PAL’s DLA Program, and thus freely and voluntarily, with full understanding of the meaning of this Release, and without any duress, execute this Release for the reliance and benefit of the Denver PAL.

1.       Waiver and Release:  In return for PAL allowing me to voluntarily participate in the Denver PAL  Program. I release, waive and forever discharge and hold harmless the Denver PAL from any and all liability, claims, demands, and/ or causes of action, of whatever kind or nature, either in law or in equity, known or unknown, for death, injury, property damage and/ or loss (“Claims”), which may arise from or which may relate to my participation in or in connection with the DLA Program, including even if such risks may have been caused by the negligence of the Denver PAL.

I understand and acknowledge that this Release irrevocably and forever and fully discharges the Denver PAL from any and all claims that I may have or hold against it.

I understand that the Denver PAL does not assume any responsibility for, or obligation to provide, financial or other assistance, including, but not limited to medical, health, or disability assistance or insurance, or attention for any of them, in the event of injury, illness, property damage, or death.

2.       Medical Treatment:  I release and forever discharge the Denver PAL from any and all Claims which might arise from, or relate to, any first aid treatment or medical service rendered to, or which might be called for, or for my benefit, in connection with any emergency during my participation in or in connection with the DLA Program.
 

3.       Assumption of Risk:  I understand and acknowledge that participation in or in connection with the DLA Program may include activities that may be hazardous to me, including, but not limited to the following risks:

a) those associated with travel to and from location(s) to be visited during the DLA Program, including transportation provided by commercial, public or private motor vehicles;

b) bodily injury including broken bones, soft tissue damage, emotional distress, severe or fatal injury, to myself or others, incurred while transporting to, or participating in, the DLA Program; and

c) those associated with departing that location and returning to my U.S. based residence, after the DLA Program.

I thus understand and acknowledge that participation in or connection with the DLA Program may expose me to inherently dangerous activities, and expressly assume all risks, dangers, and hazards, known and unknown, relating to or in connection with those activities, as well as any and all other activities and parts of the DLA Program, and thus, as stated elsewhere herein, release the Denver PAL from any all Claims arising from or related to my participation in or connection with the DLA Program.

I therefore acknowledge that the Denver PAL is not responsible for any injury, loss, or damage sustained, by any person, while participating in any PAL sponsored activity, event or trip including the DLA Program, and that I am SOLELY RESPONSIBLE for any injury, loss, or damage which I may sustain while participating in the DLA Program, even though such injury, loss, or damage may have been caused by the negligence of the Denver PAL.

4.       Photographic Release and Intellectual Property Rights:  I grant and convey unto the Denver PAL all right, title, and interest, including any intellectual property such as copyrights, in any and all photographic images and all writings or video or audio records made or created, in whole or in part, by me or contain same of me, as part of my participation in or in connection with the Denver PAL DLA Program.

5.       Indemnity:  I agree to indemnify and hold harmless the Denver PAL from and against any claims and legal issues, including fees related thereto, which are caused by, may arise from or relate to my actions, or omissions, including, but not limited to, negligence, misdeeds or violation of law.

6.       Other Provisions:  I understand and acknowledge that it is my intent that this Release shall be interpreted as broadly for the protection of the Denver PAL, as permitted by the law of the State of Colorado, which is the exclusive law governing this Release.  I agree that in the event that any clause of provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be valid and enforceable.   I agree that the sole and exclusive venue for the litigation of any matter concerning this Release or its interpretation, or any liability for Claims, however so presented, pled or formulated, shall be a court with jurisdiction for and within Denver, Colorado.  I irrevocably waive my right to trial by jury, and consent to a trial by judge.  Without limiting my intent that this Release fully discharge the Denver PAL, in the event that any judge determines that any part of this Release is not effective to accomplish that purpose, I limit my right of recovery to ACTUAL DAMAGES ONLY, waiving any right to indirect or consequential damages, including the right to recover loss of income, punitive, exemplary damages, or attorney fees or costs.   

7.      Review by Attorney:  I understand and acknowledge that I have been informed, and I understand, that this Release is a legally binding instrument, which I am providing for the reliance of the Denver PAL, which has a right to rely on my statements in this Release.  I acknowledge that I have been advised that I have the right to have this release reviewed by an attorney of my choice before I sign it.  I acknowledge that by signing this Release that I fully understand the terms, meanings, and implications of and contained in this Release.
