RELEASE, WAIVER and CONTRACTUAL AGREEMENT


NOTICE: YOUR LEGAL RIGHTS MAY BE AFFECTED BY SIGNING THIS FORM, PLEASE READ IT CAREFULLY.

In consideration of participating in hunting, fishing, or other guided services provided by Aspen Outfitting Company (AOC), a Colorado corporation, the undersigned hereby declares the following: that he/she is duly aware of the terms of this outfitting service as discussed verbally and/or noted by AOC’s booking software as it pertains to the type of service to be provided, dates of service, transportation arrangements, cost, ratio of clients to guide, AOC’s trip cancellation policy (full 48 hour notice required for refund), and any trip cancellations due to weather is the determination of AOC as to the effects it has on the well being of the undersigned; that AOC, pursuant to section 12-55.5-105(1)C and (1 )D, is bonded and possesses the required minimum level of liability insurance and the activities of AOC are regulated by the director of the Division of Registrations in the Department of Regulatory Agencies, State of Colorado, thereby constituting a written contract between AOC and the undersigned, that he/she is duly aware of the risks and hazards inherent in a guided hunting, shooting,  fishing, or any other guided trip provided by AOC, has inspected and is familiar with his/her equipment or the equipment supplied by AOC, and hereby knowingly and intentionally assumes all risks of loss, damage or injury, including death, that may occur while engaging in said activity.


In addition, the undersigned, for himself/herself, his/her heirs, executors and administrators hereby releases and agrees to defend, indemnify and hold harmless AOC, its agents, officers and employees from and against any and all losses, liabilities, damages, injuries, claims, demands, costs and expenses of every kind and nature, including without limitation all foreseen and unforeseen personal injuries and property damages (including loss or damage to any personal property such as guns, fishing equipment, cameras, etc.) illnesses and COVID-19 infections to or incurred by the said undersigned in connection with such hunting, fishing and/or other guide services, and hereby knowingly and intentionally waives all claims or demands which the undersigned, his/her heirs, executors or administrators now has or may hereafter have against AOC, its agents, officers or employees arising out of or in any way connected with such hunting, shooting, fishing and/or other guide services. The undersigned does hereby give Aspen Outfitting Company, and any parties designated by Aspen Outfitting Company, the irrevocable right too use his/her photograph and name (or any fictional name), without compensation, for sale to and reproduction in any medium, including all print, broadcast, and electronic media, for purposes of advertising, trade, display, exhibition, or editorial use.


In addition, the undersigned, for himself/herself having read and understood the current daily bag and possession limits for the species of game being taken and the licensing requirements on his/her specific hunting/fishing outing with AOC agrees to comply with the above mentioned regulations. If any limits are exceeded by the undersigned, that individual is personally liable for any fines or other punitive measures that the appropriate government agencies sees fit to enforce. 


In addition, if required the undersigned, for himself/herself, agrees to wear a vest which has at least 100 square inches of fluorescent orange on it, as well as a hat of the same color while engaged in hunting activities with AOC. Although not required by law, it is required for the added safety benefits by AOC. In addition, the undersigned realizes that as a guest of AOC while shooting, fishing and/or any other guided activity on private lands, and by signing below agrees that he/she will never trespass upon any of the above mentioned land unless accompanied by an agent of AOC.


As a material inducement for AOC to allow me to participate in the hunting, fishing, or other guided services provided by AOC, I hereby represent, with the specific intention and understanding that AOC will rely upon said representation, that I am in all respects physically, mentally, and emotionally capable of safely handling and operating any and all kinds of firearms, sharp edged instruments, fishing tackle, and any other type of equipment that may be required for my involvement in those activities, both with regard to my own safety, as well as the safety of others who may be around me.


I further state that I am of lawful age and legally competent to sign this affirmation and release, or that I have acquired the written consent of my parents or guardians, that I understand the terms herein are contractual and not a mere recital; and that I have signed this document of my own free act. It is the intention of participant by this instrument to exempt and release AOC and its employees, officers and agents from all liability whatsoever for personal injury.


In signing the foregoing Waiver and Release Agreement, the undersigned hereby acknowledges and represents: a.) That he/she has read the foregoing contracted Agreement in its entirety, understands it and signs it voluntarily. IN WITNESS WHEREOF,

the undersigned has hereunto set his hand this day of April 30, 2024.
