Ninja Mountain Bike Performance / Waiver

I agree to and understand the following. I release and hold harmless Ninja Mountain Bike Performance, LLC, the City of Santa Cruz (California), the City of Grapevine (Texas), Cannonsburg LLC, any of thier respective employees, partners, associates and agents from any an all claims, causes of action, or demands of any kind which I may have in the future, or that any person claiming through me in the future against the above named entities and parties for any reason of injury to person or property, or death in connection with any and all agreements with and actions of above entities and parties.

I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the above named entities and parties immediately; and, I attest that there is no reason I should not participate in a vigorous exercise program; and I assume the risk of riding a bicycle and training for and participating in bicycle races and events. I fully understand and acknowledge that riding a bicycle or participating in athletic training may involve strenuous physical activity and sometimes-bodily contact. Riding on public roads may result in contact with motorized vehicles and other natural and man-made obstacles through no fault of the bicycle rider. Riding on roads and trails may include natural and man-made obstacles, and vehicles, as well as wildlife that may potentially cause injury to the cyclist (myself). I fully realize that such risks are inherent with riding a bicycle, and I fully and freely assume such risks. I also affirm that, to the best of my knowledge, I am in good physical condition so that I can participate in bicycle riding, training, and racing.

I hereby grant Ninja Mountain Bike Performance permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.  I understand and agree that all photos will become the property of the Ninja Mountain Bike Performance and will not be returned.  I hereby irrevocably authorize the Ninja Mountain Bike Performance to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I have read, understand, and freely consent to this release. I have read this release, and understand the terms and legal significance of my signing this release. I knowingly and voluntarily release any and all rights to claim or legal recourse against Ninja Mountain Bike Performance, the City of Santa Cruz (California), the City of Grapevine (Texas), any of thier respective employees, partners, associates and agents.
