All visitors and members must read and sign this Waiver, Release of Liability and Assumption of Risks. Please read carefully before signing—this is a legally binding Agreement. This Agreement applies to Climb Tulsa’s new location at 4923 E. 32nd Street, Tulsa OK and to its existing location for as long as it remains open at 1140 S. 107th E. Ave, Tulsa, OK. In consideration of Climb Tulsa allowing me to use its facilities and to participate in or observe any of the activities now available or to become available at Climb Tulsa, including without limitation: facility and bouldering orientations; climbing, bouldering, spotting, belaying, classes, private coaching, clubs and any other activity associated with climbing; fitness training and workouts with weights, weight machines and other fitness equipment; yoga and other fitness classes; special events, including birthday parties or other social events; renting equipment; and otherwise using its facilities, including outdoor areas (all of which is referred to throughout as the “Activities”); and in consideration of any other services provided by Climb Tulsa in connection with the Activities, I hereby agree and acknowledge, as follows: 1. Risks of Activities. I acknowledge that climbing on an artificial climbing wall is inherently HAZARDOUS and entails many known and unanticipated dangers and risks which could result in harm or loss to myself, to property, or to others. Such dangers and risks include, but are not limited to: falling off the wall; collisions with climbing walls, holds or other objects; entanglement with ropes; loose and/or damaged holds; failure of ropes, climbing hardware, mechanical or personal belay and/or belayer, or any part of the climbing wall structure or other equipment; misuse of equipment or techniques; being struck by objects or people; climbing out of control or beyond one’s personal limits; inadequate directions or instructions; the actions, including the negligence, of other climbers, visitors, participants, or other persons who may be present, including Climb Tulsa employees, volunteers, staff or other agents; my own actions and negligence. I also acknowledge that there are risks and dangers associated with using exercise equipment and fitness machines and in participating in yoga classes or other group exercise classes. Such risks and dangers include, but are not limited to: misuse of the equipment; mechanical or other malfunctions of the equipment; overexertion and fatigue; using improper form; germs and bacteria. I understand that the known and unknown dangers and risks of the Activities can result in physical or emotional harm of all types, including SERIOUS INJURY AND DISABILITY (such as strains, sprains, torn muscles/ligaments, dislocated or broken bones, abrasions, infections, concussions, head, neck or spinal injuries), as well as PERMANENT DISABILITY, PARALYSIS AND DEATH. 2. Assumption of Risks. My participation in the Activities is purely voluntary, and I elect to participate in spite of the risks. I expressly accept and assume all risks and dangers of my participation in the Activities, inherent or otherwise, known or unknown and whether or not described above, EVEN IF ARISING FROM THE NEGLIGENCE of Climb Tulsa, its employees, staff, volunteers or others. 3. Release and Indemnity. I hereby release, waive, forever discharge and hold harmless Climb Tulsa and its owners, directors, officers, employees, managers, volunteers, contractors, staff and agents (the “Released Parties”) from and against any and all claims, demands, causes of action, damages, expenses, losses and liabilities (including attorneys’ fees and costs), on account of any injury, illness, death, property damage, or other loss arising out of or in any way related to my participation in or observation of the Activities (which includes my use of Climb Tulsa’s facilities and equipment), INCLUDING to the fullest extent allowed by law any such injury, illness, death, property damage or other loss CAUSED BY THE NEGLIGENCE OF ONE OR MORE OF THE RELEASED PARTIES. Should Climb Tulsa or any of the other Released Parties be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless from and against all such fees and costs to the extent that Climb Tulsa or any of the other Released Parties prevail. 4. Certifications. I certify that: - It is my sole responsibility to determine my suitability, medical or otherwise, for the Activities and that any assessment, orientation, instruction, training or certification which Climb Tulsa may require before my participation in the Activities does not relieve me of this responsibility. I acknowledge that I will not engage in any activities that are beyond my physical capabilities.
- I have no medical or physical conditions which could interfere with my safety in the Activities, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.
5. Use of My Likeness. I understand that during the Activities, there may be photos or video taken which may purposely or inadvertently include me. By participating in any of the Activities, I agree to let Climb Tulsa use my likeness, with or without my name and without compensation to me, in photos/video for marketing or any other promotional purposes, including online media, and I expressly waive any right of privacy, copyright, compensation or other ownership right which may be connected to same. 6. Miscellaneous. This Agreement will be governed by the laws of the State of Oklahoma (except with regard to conflict of laws). Any legal action arising under this Agreement shall be brought exclusively under the jurisdiction and venue of the appropriate state or federal courts within or for the City and County of Tulsa, Oklahoma. If any portion of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remainder of the Agreement shall remain in full force and effect. This Agreement shall be binding on me and my heirs, next of kin, personal representatives, executors and administrators. By signing below, I acknowledge that I have read this Agreement and understand that I am waiving, for myself and my heirs, next of kin, personal representatives, executors and administrators, my right to maintain a lawsuit against Climb Tulsa or any of the other Released Parties on the basis of any claim from which I have released them herein. IF I AM SIGNING THIS AGREEMENT AS A PARENT OR LEGAL GUARDIAN OR LEGAL REPRESENTATIVE OF A MINOR UNDER AGE 18, I confirm that I am granting permission for such minor to engage in the Activities and that I have discussed the Activities and their risks with such minor and he or she willingly and voluntarily desires to participate in the Activities. I further confirm that each of the releases, discharges, indemnifications, certifications, assurances and agreements contained in this Agreement are made on behalf of such minor(s) to the fullest extent allowed by law, and on my own behalf. SCREENING NOTICE: I acknowledge that I am not currently a registered sex offender. In addition, I understand that Climb Tulsa may conduct regular sex offender screenings on all members, participants, and guests. If a sex offender match occurs, Climb Tulsa reserves the right to cancel membership, end program participation, and remove visitation access.
Climb Tulsa - Bouldering and Facility Orientation and Gym Rules All participants and observers must read and initial the following Orientation and Gym Rules before using the facilities. If the participant is a minor, the minor’s parent or legal guardian must read and provide the following information to the minor, and the parent or legal guardian shall indicate his or her acceptance of this responsibility by initialing below. Bouldering Orientation: • Bouldering (un-roped climbing) is permitted at CLIMB TULSA in designated bouldering areas. • Bouldering involves increased risks because YOU WILL FALL, and all falls are ground falls which could result in injury or death. Padded floors and crash pads (where present) mitigate risks, but do not and cannot guarantee prevention of injury or death. Improper pad placement or improper pad use can also cause injury or death. Many injuries occur when you fall near or at the top of the wall and / or when you miss the crash pad or hit an edge of a crash pad. • To reduce your risk of injury: - Down climb when possible instead of jumping off.
- Use proper falling technique.
• Keep Landing Zones Clear: Do not lounge on pads or walk under climbers. Remove all personal items (like water bottles) from landing zones. Be aware at all times because you could land on or be landed on by other participants. • Proper Falling Technique Can Reduce Injuries: - First, upon falling from the wall, spot your landing.
- Second, stay relaxed and bend your knees and elbows.
- Next, pull in your arms. Avoid extending your arms to reach for the floor.
- Lastly, as you land, absorb the impact with your legs bent and roll to the ground.
• Ratings: CLIMB TULSA rates the difficulty of boulder problems with the V-Scale (V0, V1, V2, V3, etc) with V0 being the easiest. • New Climbers: Those who are new to bouldering should start with easier problems (V0 to V1) and avoid climbing the full height of the wall until they are more comfortable with climbing, down climbing, and proper falling technique. • While CLIMB TULSA takes substantial measures to mitigate the risks of Bouldering, it cannot eliminate all risks. Risks of injury and death are present even when you and CLIMB TULSA take all available safety measures. Facility Orientation: • All climbers and observers must check in at the front desk before proceeding into CLIMB TULSA. • Use of fitness equipment is not allowed by anyone under the age of 16 without direct supervision of a staff member. • Climbing is dangerous with inherent risks. Participants must assume the risks of climbing. All climbers, facility participants, individuals operating a safety system at CLIMB TULSA, and anyone walking on a padded surface must sign (or their parent/guardian must sign) CLIMB TULSA’s Waiver and Release of Liability for any Injury or Death and Assumption of Risks form. • All persons in a rope climbing area must receive an Auto Belay orientation from a staff member. • No children under the age of 13 may use an Auto Belay without assistance from a supervising adult. • Double check your partner’s safety system (Knots / Harness / Carabiners / Belay Device) before every climb! • CLIMB TULSA staff reserve the right to check safety systems at any time. • Individuals desiring to top rope belay, lead belay, or lead climb at CLIMB TULSA must be at least 13 years of age and pass the corresponding Belay Safety Check. Those individuals who do not pass or choose to not take the Belay Safety Check may not belay or tie knots, and must wait a minimum of 24hours before taking or re-taking the Belay Safety Check. Individuals who have passed the Lead Climb Check may borrow a lead rope at the front desk. CLIMB TULSA staff reserve the right to revoke belay privileges at any time. • Climbing ropes must be tied directly to the climber’s harness. Clipping the rope to the harness is prohibited. • Weight differences between the climber and the belayer can greatly impact the safety of both individuals and all belayers must take responsibility for anchoring in from their harness to the appropriate floor anchor as needed. • All persons using CLIMB TULSA are expected to respect other individuals at CLIMB TULSA and conduct themselves in good order. Persons deemed by CLIMB TULSA staff to be behaving in an unsafe or disorderly fashion will be asked to leave the facility. • Youth: Youth climbers under the age of 13 must be supervised by an adult (18 years or older) or by a CLIMB TULSA staff member. Parents and caregivers are responsible for the supervision of their children. Gym Rules: • YOU MAY NOT TEACH BELAYING IN OUR FACILITY.
• ALL CHILDREN 13 AND UNDER MUST BE SUPERVISED BY ATTENDING ADULTS AT ALL TIMES.
• There can be no more than 3 children under the age of 13 per supervising adult.
• Only Climb Tulsa staff may teach belaying.
• All climbers, belayers, and observers must be checked in and have an active waiver on file.
• All climbing gear must be removed before entering restrooms.
• Use of fitness equipment is not allowed by anyone under the age of 16 without direct supervision of a staff member.
• All persons in a rope climbing area must receive an Auto Belay orientation from a staff member.
• No children under the age of 13 may use an Auto Belay without assistance from a supervising adult.
• No running or horseplay.
• Climbing barefoot is not permitted.
• Keep your shirt on.
• Watch your language.
• Belayers must stand while belaying.
• Do not climb/boulder beneath another climber.
• Do not climb on or swing from the ropes.
