In consideration of being allowed to enter into the play center and/or participate in any parties or programs at Wallabies, the undersigned, on his or her own behalf and on behalf of the minor identified below, acknowledges, appreciates and agrees to the following conditions. 1. Inflatables can be hazardous and dangerous. The activities at Wallabies require certain degrees of skill, ability and physical condition. I understand that these activities can result in serious injury to the participant(s) and/or me. I assume any and all risk, damage or injury while on the Wallabies premises. 2. I am aware that participation in parties, programs or any other event at Wallabies creates risk, hazards and danger of personal injury, disability and/or death, including those that may arise out of the negligence of other participants. If I discover any hazards/danger during our participation, I will bring it to the attention of the nearest Wallabies employee immediately. 3. I understand that it is my responsibility to ensure that I/my children understand the rules. I have read and received a copy of the operational rules and understand that it is my responsibility to ask questions about the operational rules and regulations if necessary. Although there are referees to monitor children/adults playing, it is my responsibility to monitor my children and my own activities. 4. I, for myself and participants named below, and our respective heirs, assigns, administrators, personal representatives, and next of kin, hereby release and forever discharge WallabiesUSA, LLC and their officers, members, agents, employees, directors, trustees, affiliates, other participants and all other persons and entities acting on their behalf, from any and all claims, actions, damages, injuries, liabilities, cost or expenses, including attorneys fees, which are related to or arise out of myself or the participant(s) named below participation or use of the facility; and that I forever waive the right to sue or exercise any legal actions against WallabiesUSA, LLC. 5. By execution of this agreement, it is my intention to assume all risk of injury and do hereby surrender and waive any right to sue or exercise any legal rights to seek damages against Wallabies, LLC and its owners, officers, members, agents, employees, directors, trustees, affiliates, other persons or entities acting on their behalf. 6. I acknowledge that my or my child’s participation in activities at Wallabies is strictly voluntary. I hereby certify that I am over 18 years of age; I have carefully the foregoing covenant not to sue and acknowledge that I understand and agree to all of the above terms and conditions. Prior to signing this agreement, I have had ample opportunity to ask any and all questions. I am aware that by signing this agreement, I assume all risks and waive and release all substantial rights that I may have and possess. SAFETY RULES (PLEASE REVIEW WITH YOUR CHILDREN) All guests under 18 must be accompanied by a parent or guardian at least 18 years of age *Each participant must remove shoes and wear socks *On slides, kids must slide feet first on their bottoms *NO shoes allowed in the Toddler play area *No flips or rolling down slides *Participants must remove all objects from their pockets * No running up slides or climbing over walls *No running, pushing, or rough play *Obey referees at all times *No jumping down the slides *No outside food, drinks or coolers Wallabies reserves the right to ask any guest that does not follow the rules to leave While the staff will work hard to ensure everyone has a great time, if a child is unable to follow the above rules, the following steps will be taken to ensure other guests are able to enjoy their play time. 1 st Offense: The rules will be reviewed with the child and their wristband will be marked with a safety mark (notating that they know the rules) 2 nd Offense: The child’s wristband will be marked with a second mark. The parent(s) will be acknowledged by floor staff. 3 rd Offense: The child will be asked to discontinue play (including the possibility of leaving Wallabies.)
