Subsequent instructor assisted jumps and freefall training, may be arranged at the manifest desk. Tandem parachute jumps are also available. All fees are payable in advance. There will be no refunds, and participants or their parent or legal guardian will be required to sign a Waiver of Liability prior to training. Those under the age of majority in their province or territory; 19 in British Colombia and the Yukon, and 18 in Alberta, will require written permission from a parent or legal guardian, and those under 16 will require the presence of a parent or legal guardian and must take tandem training. Course availability dates subject to change pending unforeseeable circumstances such as: weather conditions, etc. SkydiveBC North / Skydive Yukon / Skydive Canada is a partnership providing general services to persons, clubs, associations and organizations interested in participating in activities related to sport parachuting. Among other things, SkydiveBC North / Skydive Yukon / Skydive Canada provides and offers for sale, training for first and subsequent solo parachute jumps, tandem parachute jumps, experimental physically disabled adaptive tandem and solo parachute jumps, sales and rental of parachute equipment used for sport parachuting, parachute rigging services including repair, maintenance and periodic repacking of both main and reserve parachutes, arranging for aircraft with pilots for use in sport parachuting, and arranging for municipal, provincial, territorial and privately owned property for sport parachutists to land in. Guardian Aerospace Holdings Inc. and Tundra Helicopters provide aircraft services to SkydiveBC North / Skydive Yukon / Skydive Canada. Consistent with the growth of sport parachuting in the past decades is the emergence of personal injury lawsuits brought against various sport parachuting operations as a result of injuries suffered by a participant, often a student. Courts have a high standard of care for sport parachuting instructors and damage awards can be devastating. SkydiveBC North / Skydive Yukon / Skydive Canada, Guardian Aerospace Holdings Inc. and Tundra Helicopters, their directors, officers, employees, contractors, aircraft owners, pilots, instructors, riggers, ground crew, landowners, occupiers, volunteers, and any other persons working for, or volunteering with, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., do not carry insurance for any such awards. They do not wish to risk everything they have worked for, in exchange for your participation in a sport that is OBVIOUSLY DANGEROUS. For these reasons, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., will agree to provide any of the services they offer including, but not limited to, training for first and any subsequent sport parachute jumps, tandem parachute jumps, and experimental physically disabled adaptive tandem and solo parachute jumps, and aircraft rides, transportation to and from landing and take off areas, ONLY if you agree not to sue us if you get hurt for any reason at all, INCLUDING NEGLIGENCE AND BREACH OF DUTY OF CARE on the part of SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc..
I understand that all photographs and video produced by SkydiveBC North / Skydive Yukon / Skydive Canada remain the property of Skydive BC North/Skydive Yukon. Videos and pictures are available for purchase. Please contact the manifest desk.
For your safety, your instructor requires some information on your physical fitness and/or any limitations you may have (eg. vision, hearing or mobility). It is your responsibility to thoroughly and honestly inform your instructor or manifest, of any physical limitations or health concerns that could affect your jump with SkydiveBC North / Skydive Yukon / Skydive Canada. **Weight Restrictions are as follow: - Solo Jumpers: 230 lbs -Heavy Drops : Any solo jumpers weighing over 230 lbs will be charged $50 extra for the extra altitude, Aircraft Weight and balance, and Special Equipment required for such drops. Jumps will be made only at the discretion of the Instructor) - Tandem Jumps: The maximum weight of Tandem passengers is calculated as a total of Tandem Pilots weight + Passengers weight + 50 lbs of equipment= (Not to exceed 500 lbs.) Tandem Passengers over 200 lbs may participate at the discression of the instructor
These are unavoidable facts of sport parachuting: You, your instructors, pilots, parachute packers and ground crew are all human beings who are capable of making mistakes. Unforeseeable things like the weather conditions can change quickly and may affect the outcome of your jump.
The equipment SkydiveBC North / Skydive Yukon / Skydive Canada provides is made and packed by human beings and therefore may not be perfect and can malfunction. SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters, and Guardian Aerospace Holdings Inc. CAN NOT and DO NOT offer any guarantee that the equipment it supplies to participants for making sport parachute jumps will work properly.
Your training can only be an approximation of the reality of sport parachute jump as there is no totally adequate simulation for doing an actual sport parachute jump.
Sport parachuting is NOT perfectly safe. SkydiveBC North / Skydive Yukon / Skydive Canada CAN NOT and DOES NOT offer any guarantees. SkydiveBC North / Skydive Yukon / Skydive Canada DOES NOT guarantee that either of your parachutes will open properly. SkydiveBC North / Skydive Yukon / Skydive Canada DOES NOT guarantee that individuals at, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters or Guardian Aerospace Holdings Inc., will function without error. SkydiveBC North / Skydive Yukon / Skydive Canada DOES NOT guarantee that any of our back up devices will function properly, and we CERTAINLY DO NOT guarantee that you won't get hurt. You may get hurt or killed, EVEN IF YOU DO EVERYTHING CORRECTLY.
SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., encourages membership in the Canadian Sport Parachuting Association (C.S.P.A) and adheres to its policies and recommendations. The C.S.P.A. is an association of jumpers dedicated to promoting safe sport parachuting in Canada. Membership in the C.S.P.A. is voluntary. The C.S.P.A. has developed a series of equipment and training recommendations, including a system for providing certificates of proficiency and instructor ratings for individual participants. Nevertheless, the C.S.P.A. cannot, and does not regulate sport parachuting. The C.S.P.A. does not accept any responsibility with regard to the activities of SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., or any private individuals participating in sport parachuting.
The training methods, equipment and aircraft used by, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., are consistent with industry standards. Nevertheless, injuries can and do occur. Typical injuries consist of soft tissue injuries, broken bones, legs, ankles, arms, wrists or fingers, back, neck and head injuries, injuries of all sorts (including death) due to hitting obstacles (e.g. powerlines, trees, buildings, roads and water etc.), and death from hitting the ground too hard, including aircraft crashes, or motor vehicle or ATV vehicle crashes. Like skiing, river rafting, mountain climbing and other high-risk sports there is a chance that the participants will get hurt or killed even if they do everything correctly.
The following form is a Waiver of Liability that we ask you read carefully and then sign it. This waiver is a legal contract binding you to give up the right to sue SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., OR ANY OF THEIR AFFILIATED DROP ZONE OPERATIONS, or any person or entity acting on behalf of SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc. for any reason, including NEGLIGENCE OR BREACH OF DUTY OF CARE.. As it pertains to you "any reason" would include poor equipment, bad training, misrepresentations as to safety or errors by, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., or other unforeseeable situations such as weather conditions etc.. READ CAREFULLY and fully understand each paragraph. DO NOT sign or initial the waiver unless you agree to the terms stated in it.
WAIVER OF LIABILITY 1) ASSUMPTION OF RISK I realize and acknowledge that my participation in sport parachuting involves inherent risks and hazards. I understand that these risks and hazards are both foreseeable and unforeseeable, which can and do result in injury to, or death of, participants, including but not limited to exposure of Covid-19, bodily injuries such as soft tissue injuries and/or broken, bones, necks, backs, legs, ankles, arms, wrists, and fingers and head injuries. Also injuries or death resulting from hitting the ground, people, water or obstacles too hard, and aircraft crashes, motor vehicle crashes or ATV vehicle crashes. My participation in sport parachuting conducted by SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., shall be AT MY OWN RISK, AND I VOLUNTARILY ASSUME ALL SUCH INHERENT RISKS AND HAZARDS.
2. PERSONAL EQUIPMENT (For persons bringing their own parachuting equipment and those holding certificates of proficiency) I ACCEPT FULL RESPONSIBILITY for ensuring that any equipment that I bring to the drop zone for use in sport parachuting will be safe and suitable for its intended use. I am not relying in any way on SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., to ensure that my equipment is fit and safe for sport parachuting. I have not misrepresented any information on my level of sport parachuting skill in my log book. My Canadian Sport Parachuting Association, and/or my World Air Sports Federation (FAI) affiliated association, is current. Please provide proof of this affiliation, or your logbook and any certification you hold to SkydiveBC North / Skydive Yukon / Skydive Canada manifest to compete your registration.
3) WAIVER, RELEASE AND DISCHARGE I AGREE NOT TO proceed with litigation against, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., TRANSPORT CANADA, AIRCRAFT OWNERS AND OPERATORS, FEDERAL, TERRITORIAL OR PROVINCIAL GOVERNMENTS or AIRPORT OWNERS or MUNICIPAL AUTHORITIES. I HEREBY WAIVE, RELEASE, AND DISCHARGE, the aforementioned and their owners, directors, officers and employees and anyone acting on their behalf, from any and all claims I may now, and in the future have for exposure or contraction of Covid-19, personal injury, death, damage to property or loss of any kind and nature, and however caused, INCLUDING NEGLIGENCE and BREACH OF DUTY OF CARE on the part of the aforementioned, in connection with my participation in sport parachuting activities at their facilities. I hereby agree and acknowledge that the provisions of this WAIVER OF LIABILITY extends to the following persons or entities, on whose behalf SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., is acting as agent for: Canadian Government, Provincial Governments, Territorial Governments, Airport Authorities, Transport Canada, the Canadian Sport Parachuting Association, sport parachute clubs and associations, aircraft owners, pilots, instructors, coaches, parachute riggers and packers, ground crew, land owners, occupiers, employees, contractors, spectators, volunteers, and any other persons working for, or volunteering with, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc..
4) INDEMNITY I agree to assume the risk of any damages, injuries, exposure to Covid-19 or disability that may develop or occur as a result of my participation in sport parachuting activities conducted by SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc., and I WILL HOLD, SkydiveBC North / Skydive Yukon / Skydive Canada, Tundra Helicopters and Guardian Aerospace Holdings Inc. and ALL AFORMENTIONED PARTIES, HARMLESS FROM ANY AND ALL CLAIMS, therefore. Also, the provision of any local, provincial, federal or foreign statutes or judicial decisions providing in substance that releases is hereby expressly waived.
5) GENERAL This WAIVER OF LIABILITY is binding on my family members, heirs, assigns, executors, administrators, legal representatives and anyone else who may claim on my behalf.
6) MEDICAL STATEMENT FOR UNDERGOING PARACHUTE TRAINING AND JUMPING I hereby certify that I am not aware of and am not under treatment for any physical infirmity or chronic ailment or injury of any nature and that I have normal vision or have corrective lenses, and that I am currently not receiving treatment for any of the following or if I am receiving treatment for any of the following I will notify my instructor or manifest: - any coronavirus (including Covid 19);
- epilepsy (even if well controlled by drugs);
- severe diabetes which is poorly controlled;
- drug addiction or alcoholism;
- total deafness or exceedingly bad hearing;
- marked obesity;
- recurrent dislocation of the shoulder (unless it has been successfully treated surgically);
- large inguinal hernia (unless surgically corrected prior to taking parachute training);
- haemophilia;
- abnormal stress (if individual is over the age of 40, should show a normal stress ecg);
- severe asthma;
- cardiac or pulmonary condition;
- high or low blood pressure;
- fainting spells or convulsions and seizures;
- nervous disorder; or
- kidney or related diseases
I hereby certify and warrant that the statements contained above are true and correct to the best of my knowledge and belief. I further certify and understand that acceptance of this application by SkydiveBC North / Skydive Yukon / Skydive Canada will be made on the basis of the statements contained above, and such accepted application will become part of the agreement between SkydiveBC North / Skydive Yukon / Skydive Canada and myself to provide this service. I understand that having any of these ailments does not necessarily mean that I will not be able to participate, however it may be at the discretion of the instructor, with the exception of Covid-19.
7) DECLARATION I declare that in making and signing this WAIVER OF LIABILITY, I have not been influenced to any extent in making and signing this WAIVER OF LIABILITY by any representations or statements made by any persons hereby released, or any persons representing them. It is also expressly agreed that each person who signs this document agrees not to sue any other person who has signed this waiver of liability.
