RELEASE AND WAIVER OF LIABILITY

This Release and Waiver of Liability (“Release”) is made and entered into on the date set forth below by and between Fresh Truck, a Massachusetts not for profit corporation (“Fresh Truck”), and the executory named below, an individual (“Volunteer”).  

 

 

Volunteer desires to work as a volunteer for Fresh Truck and to engage in certain volunteering activities, work and services in furtherance of the mission of Fresh Truck (the “Services”).  

 

Volunteer hereby freely and voluntarily executes this Release under the following terms:

 

Volunteer agrees to assume all responsibilities for any and all risk of damage or injury that may occur to him/her as a result of his/her participation in the Services. In consideration of the grant of permission to participate in the Services, Volunteer, for himself/herself, his/her agents, heirs, beneficiaries, estate, executors, administrator, and assigns, does hereby and with full knowledge of the consequences of this act, release, forever discharge and covenant to hold harmless Fresh Truck, together with its officers, directors, employees, successors, affiliates, sponsors, backers, supporters, contributors, attorneys, agents, and all other persons or entities involved in the Services (collectively, the “Releasees”), from any and all claims, actions, suits, demands, causes of action of whatever kind or nature, either in law or in equity, which may arise from, or in any way grow out of, directly or indirectly, Volunteer’s participation in the Services and the use of the Images (as defined below), including, without limitation, claims for personal injury or other loss or damage.  

 

Volunteer understands this Release discharges the Releasees from any liability or claim Volunteer may have against Releasees with respect to any bodily injury, personal injury, economic injury, illness, death, or property damage that may result from Volunteer’s Services with Fresh Truck, whether caused by the negligence of the Releasees or otherwise. Volunteer also understands the Releasees do not assume any responsibility for or obligation to provide financial assistance or other assistance to Volunteer, including but not limited to medical, health, or disability insurance, services or payments in the event of injury or illness. Volunteer expressly and specifically assumes the risk of injury or harm in the Services and understands that, except as otherwise agreed to by Fresh Truck, Fresh Truck does not carry or maintain liability, health, medical, or disability insurance coverage for Volunteer.  

 

Volunteer grants the Releasees permission to use Volunteer’s name and/or picture, portrait, likeness or photograph (the “Images”) in any broadcast, advertisement, promotion, or otherwise in connection with the Services and the activities of Fresh Truck, and Volunteer acknowledges and agrees that Volunteer has no right, title, or interest in the Images.

 

Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts, and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Massachusetts. Volunteer agrees that in the event any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. Volunteer agrees the courts of the Commonwealth of Massachusetts located in Boston, Massachusetts shall have exclusive jurisdiction concerning any claims Volunteer may attempt to assert against Releasees, and Volunteer waives any right Volunteer may have to a jury trial of any such claims.
