Property Rentals: We may share personal information with the owners and operators of the property in order to provide you with services.
 

Business Partners, and Other Third Parties: We may disclose your information to business partners, sponsors or other third parties in connection with administering reservations, commission payments, promotions, sweepstakes or similar activities. You may be offered an opportunity to request additional information, materials or offers from the sponsor or other third party; should you make such a request, we will provide your personal information to the third party so that they can fulfill your request.

You may choose to opt-out from the above types of sharing by contacting us at info@captainjaks.com. Please note that if you choose to opt-out, we may not have the ability to perform the requested Services or you may not be able to participate in one or more of our programs.

Service Providers: We may disclose your information to service providers retained by us in connection with our business such as: travel services companies, financial services companies, property owners’ associations, vacation insurance companies, website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure, customer service, email delivery, credit card processing, tax and financial advisers, legal advisers, accountants or auditing services.
 

Message Boards: We may make message boards, blogs, and other such user-generated content facilities available to users. Any information that is disclosed in these areas becomes public information and you should always be careful when deciding to disclose your personal information. We are not responsible for the privacy practices of other users, including website operators to whom you provide information.

Merger or Acquisition: To a third party who acquires any part of Captain Jak’s itself or any of its Affiliates, whether such acquisition is by way of merger, consolidation or purchase of all, or a substantial portion, of our assets.
Disclosure Permitted by Law: To law enforcement authorities, government or public agencies, regulators, and/or to any other person having appropriate legal authority or justification for receipt of your information, if we believe that we are required or permitted to do so by law or legal process, to respond to claims, or to protect the rights, property or safety of Captain Jak’s or others.

 

Anonymized/Aggregated Information: Because aggregated or anonymized information does not personally identify you, we may use it for any purpose. If we combine anonymized or aggregated data with personal information, we will treat the combined information as personal information according to this Privacy Notice.

How do we safeguard your information? 

Security of Your Information: We will take reasonable steps to protect the information you provide us from loss, misuse and unauthorized access, disclosure, alteration and destruction. We have implemented appropriate physical, electronic and managerial procedures to help safeguard and secure your information from loss, misuse, unauthorized access or disclosure, alteration or destruction. Unfortunately, no security system is 100% secure, thus we cannot ensure the security of information that you provide to us.

Changes to Our Privacy Notice: From time to time we may revise this Notice and/or use personal information for new, unanticipated uses not previously disclosed in this Notice to meet changes in the regulatory or business environment, or to satisfy the needs of our customers and service providers. Golf Cart Rental

Liability Release & Assumption of Risk Agreement

 

A $250 USD fine (unless otherwise noted) is immediately applicable to your credit card/cash deposit for the following violations:

  • Driving the rental on private property 
  • Driving the rental on airport runway 
  • Driving the rental on public beaches and on the sidewalk
  • Allowing the rental to be operated by an unauthorized driver 
  • Overloading the rental 
  • Rental must be returned with the gas guage reading FULL. If the guage is not on FULL, we will fill the rental on your behalf and you will be responsible for the cost of gas plus a service charge of $2.50 USD.
  • Cable lock and key must be returned at end of rental period,  Failure to do so will result in a charge of $20 USD per item (cable lock and key).
  • Renter is liable for the first $500 USD in damages + any additional costs (see #4 below) 

TERMS & CONDITIONS

  1. Rental must be returned to Captain Jak’s in the same condition, with the same equipment and with the same amount of fuel with which it was rented to you. You agree that this rental will not be used in any manner that represents a violation of this agreement or the laws of this country. Violations of the rental agreement include, but are not limited to:
    • Allowing unauthorized drivers to operate the rental.  The only authorized drivers are the renter or additional drivers who are listed above.  All drivers must have and carry with them at all times a valid driver’s license and be at least 21 years of age.
    • Operating the rental under the influence of alcohol or drugs (prescription or otherwise).
    • Operating the rental for any use other than its intended purpose.
    • Operating the rental in violation of the laws of Belize.
    • Driving the rental off the peninsula, this terminates at The Placencia Hotel.
    • Obtaining the rental by providing false information.
    • Using the rental for illegal or improper use.
    • Leaving the rental unattended, unless the key is removed, the rental is parked & locked to the steering wheel, in a safe location.
    • Running the rental dry of essential oils, fluids & water, potentially causing excessive damage.
    • Operating the rental on any surface not intended for vehicular use.
    • Overloading the vehicle. Maximum vehicle loads are as follows: 4-seater golf carts (4 people); 6-seater golf carts (6 people).
  2. The renter agrees that Captain Jak’s is not responsible for loss or damage to personal property of the renter or passengers during or after the use of the rental.
  3. The renter agrees to pay all applicable charges arising from this agreement including, but not limited to:
    • Overdue charges of $15.00 USD per hour for the first 2 hours after which the cost of an additional day applies.
    • A $30.00 USD fee if the rental is returned to another location other than the rental location unless prior arrangements are made. Location will be confirmed with Captain Jak’s on first day of rental.
    • All costs arising from parking & traffic violation while the vehicle is rented to renter.
  4. The renter is liable for the first USD $500.00 in damages to the rental, plus loss of income resulting from such damage & any additional charges & cost arising after a final audit of this agreement up to and including the full replacement of entire vehicle. A valid credit card is required to hold required rental deposit of USD $500.00.
  5. The renter agrees to not make any repairs on the rental without Captain Jak’s expressed authorization.
  6. The renter shall report all accidents to the police and Captain Jak’s immediately.
  7. Captain Jak’s will not be responsible for the loss of life or personal injuries arising from accidents or otherwise.
  8. The renter agrees to these additional provisions:
    • I am the renter of the vehicle only & am not Captain Jak’s agent or representative for any purpose.
    • Captain Jak’s is not responsible for any damages, direct or coincidental, resulting from the performance or non-performance of the vehicle.
  9. This agreement shall be interpreted & enforced in accordance with the laws of Belize. By signing this contract, I hereby authorize Captain Jak’s to charge my credit card (an imprint of which has been signed by me) for any damages incurred, fuel used or additional time if the rental is not returned by the agreed time.  I agree that any of these expenses incurred & charged to my credit card are final & that I shall not employ the service of my credit card company as means of settling any dispute related to this matter.
