I (the undersigned) understand that animals can be unpredictable and potentially harbor infectious organisms. I (the undersigned) will take full responsibility and will not hold Jungle Island responsible for damage and/or sickness and injuries that can be incurred by interacting with an animal or entering its enclosure. In consideration of the services at Jungle Island, their agents, owners, officers, volunteers, participants, employees, and all other persons or entities acting in any capacity on their behalf, I hereby agree to release, indemnify, and discharge on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate all liability, holding harmless the companies ESJ JI Operations, LLC, ESJ JI Leasehold, LLC,  Jungle Island, Inc., the companies' staff and/or Directors, and releasing liability regarding any potential injury/clothing damage that may be received while participating in this activity. 

I acknowledge that interaction with animals of any kind can be potentially hazardous, and therefore, I (we) accept full responsibility for my (our) participation in any of the above mentioned animal encounters. Potential injuries include, but are not limited to, being scratched, bitten, punched, pinched, and slapped or any other physically painful or disabling injury. Clothing damage includes, but is not limited to, tears, feces or urine stains and possible stretching. I (the undersigned) accept full responsibility for any medical or emotional distress caused by such an injury.

 I expressly agree to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

 I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Jungle Island from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of equipment or facilities, including any such claims which allege negligent acts or omissions of Jungle Island.

 Should Jungle Island or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

 I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

 In the event that I file a lawsuit against Jungle Island, I agree to do so solely in the state of Florida and I further agree that the substantive law of Florida shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

  In consideration of any minor being permitted by his or her parents or guardian to participate in this activity, I further agree to indemnify and hold harmless Jungle Island from any and all claims which are brought by, or on behalf of Minor, and which are in any way connected with such use or participation by Minor.

 By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Jungle Island on the basis of any claim from which I have released them herein. By signing below I acknowledge that I have read and understand this entire document.

 

All participants must sign this form, and provide proper identification with a valid address to a company representative prior to being permitted to participate in any "Animal Interaction" activity or program.

 

A parent or legal guardian must sign this release if any of the participants are under the age of 18.
