Open Swim Waiver

During an open swim, if a participant cannot swim, you must notify one of our aquatic staff so that we can arrange for them to have an appropriate personal flotation device.  Our aquatic staff reserve the right to deny a participant access to the pool if they are worried that the participant may be in danger by swimming without an appropriate personal floatation device.  Participants must follow all rules set out by our aquatic staff.

By participating in the open swim, you will be expressly assuming the risk and legal liability and waiving and releasing all claims for injuries, damages or loss which you or your minor child/ward might sustain as a result of participating in the open swim provided by Hippo in the Bathtub Inc.

I recognize and acknowledge that there are certain risks of physical injury to participants in this program/activity and I am not aware of any medical conditions which could put myself or my child at an increased risk of injury during this activity. In consideration of Hippo in the Bathtub Inc., I, release Hippo in the Bathtub Inc. its respective, principals, servants, agents or employees from any claims, demands, damages, actions or causes of actions arising out of or in consequence of any loss, injury or damage to myself, my child or property incurred while attending at or participating in the open swim provided by Hippo in the Bathtub Inc., notwithstanding any such loss, injury, including death, or damage may have arisen by reason of the negligence of Hippo in the Bathtub Inc., its principals, servants, agents or employees. Without limiting the generality of the foregoing, I further release any recourses which I or my child may now or hereafter have resulting from any decision of Hippo in the Bathtub Inc.. Further, I agree to indemnify Hippo in the Bathtub Inc., its principals, it servants, agents or employees from any claims or demands which might be made against Hippo in the Bathtub Inc. arising out of or in consequence of the attendance or participation by in an open swim.

I HAVE READ AND FULLY UNDERSTAND THE ABOVE IMPORTANT INFORMATION, WARNING OF RISK, ASSUMPTION OF RISK, INDEMNIFICATION AND WAIVER AND RELEASE OF ALL CLAIMS.
