WAIVER AND ASSUMPTION OF RISK RELEASE

In consideration of Ocean Addicts agreeing to provide the equipment and/or services to me, I hereby release Ocean Addicts Pty LTD, its contractors, agents, employees, directors and shareholders (together, Ocean Addicts) from liability on behalf of myself, my children, my parents, m­­­­­y heirs (together, you).  Ocean Addicts expressly waivers all liability to you in tort and contract for any harm you suffer by reason of participating in the activity.  I do hereby waive any and all claims release of negligence, contract or strict liability arising out of my use or misuse from products provided, foil board equipment and foil board tuition offered by Ocean Addicts and I agree not to bring any claim against Ocean Addicts.  I fully understand, recognize, and acknowledge that foil boarding encompasses known and unanticipated risks which could result in physical injury, with inherent risks and dangers, such as the possibility of injury to myself or others, drowning, damages to the foil, board, or boards, boats and watercraft of others and or death, which I nevertheless accept. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in the activity, I may be found in a court of law to have waived my rights to maintain a lawsuit against Ocean Addicts, on the basis of any claim which I have released them wherein.  I understand and acknowledge all participants know how to swim.  I further agree to indemnify and hold harmless Ocean Addicts from claims brought by or on behalf of minors under 18 in which anyway connected with use or participation by any minors.  I agree to pay for any damage done to boats of property incurred as a result of our participation.

 

I must not participate in the activity if I have any injury, disability, medical or health condition that may increase the risk of me becoming injured unless I have told Ocean Addicts about it and they have authorized me to participate. I declare that I am medically and physically fit and able to participate in the activity and I will immediately notify Ocean Addicts of any change to my fitness and ability to participate. I understand and accept that Ocean Addicts will continue to rely on this declaration as evidence of my fitness and ability to participate. I agree that my details may be used for marketing purpose unless declared otherwise.
