RELEASE OF LIABILITY, ASSUMPTION OF RISK, WAIVER OF CLAIMS AND INDEMNIFICATION AGREEMENT
(ADULT) 

NOTICE: By signing this document, you may be waiving certain legal rights, including the right to sue.

I, the undersigned, in consideration of KAMP-VL, LLC, Kampgrounds Enterprises Inc, and the Rancho California Water District (the “Hosts”) allowing me to enter, use and enjoy the Vail Lake Resort and its facilities (the “Property”), and activities conducted on the premises (the “Activities”), hereby agrees, to the fullest extent permitted by law, as follows:

  1. TO WAIVE ALL CLAIMS that I may have against the Hosts arising out of my use of the Premises and participation in the Activities, including any equipment associated with such Activities, even while receiving instruction and/or training;
     
  2. TO ASSUME ALL RISKS arising out of my use of the Premises and participation in the Activities, including any equipment, even those caused by the negligent acts or conduct of the Hosts, its owners, affiliates, operators, employees, agents and/or officers. I understand that there are inherent risks of participating in the Activities and enjoying the Property, which may be both foreseen and unforeseen and include serious physical injury and death;
     
  3. TO RELEASE the Hosts, their owners, affiliates, operators, employees, agents and officers from all liability for any loss, damage, injury, death or expense that I (or my next of kin) may suffer, arising out of my use of the Premises and/or participation in the Activities, including any equipment, even while receiving instruction or training. I specifically understand that I am releasing any and all claims that arise or may arise from any negligent acts or conduct of the Hosts, their owners, affiliates, operators, employees, agents and/or officers, to the fullest extent permitted by law. However, nothing in this Agreement shall be construed as a release for conduct that is found to constitute gross negligence or intentional conduct; and
     
  4. TO DEFEND AND INDEMNIFY the Hosts, their owners, affiliates, operators, employees, agents and officers from all liability for any loss, damage, injury, death, or expense that I (or my next of kin) may suffer, arising out of my use of the Premises and/or participation in the Activities, including any equipment, even while receiving instruction or training.

PERSONAL RESPONSIBILITY

     I, the undersigned, certify that I have no physical or mental conditions that preclude me from using the Property and/or participating in the Activities or using any associated equipment and that I am not participating against medical advice.

     I understand that my use of the Property and/or participation in the Activities is voluntary and I further understand that I have the opportunity to inspect the Hosts’ Property and equipment before any participation.

     I understand that I am obligated to follow the rules of the Property and Activities and that I can minimize my risk of injury by doing so and through the exercise of common sense and by being aware of my surroundings.

     If, while using the Property and/or participating in any Activities, I observe any unusual hazard or condition that I believe jeopardizes my personal safety or that of others, I will remove myself from use of the Property and/or participation in the Activities and immediately bring the hazard or condition to the attention of the Hosts.

     To the extent any portion of this Agreement is deemed to be invalid under the laws of the State of California, the remaining portions of this Agreement shall remain binding and available for use by the Hosts in any proceeding.

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
