Brown Girls Climb, LLC EVENT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

The individual named below (referred to as “I” or “me”) desires to participate in certain hiking, camping, rock climbing, rappelling and other outdoor activities (hereinafter collectively referred to as“Activity”)sponsored by Brown Girls Climb, LLC, a Colorado limited liability company (the“Company”). In consideration of being permitted by the Company to participate in the Activity and in recognition of the company's reliance hereon, I agree to all the terms and conditions set forth in this instrument (this“Release”). 

The individual named below (referred to as “I” or “me”) desires to participate in certain hiking, camping, rock climbing, rappelling and other outdoor activities (hereinafter collectively referred to as“Activity”)sponsored by Brown Girls Climb, LLC, a Colorado limited liability company (the“Company”). In consideration of being permitted by the Company to participate in the Activity and in recognition of the company's reliance hereon, I agree to all the terms and conditions set forth in this instrument (this“Release”).

The risks include, among other things:

 I acknowledge that the Activity entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. The risks include, among other things: the hazards of walking on uneven terrain; slipping and falling; falling objects; exposure to temperature and weather extremes which could cause cold shock, hypothermia, hyperthermia (heat-related illnesses), heat exhaustion, sunburn, dehydration; exhaustion; exposure to potentially dangerous wild animals, insect bites, and hazardous plant life; equipment failure; the use of climbing ropes and equipment; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life-threatening hazards; being struck by rockfall or other objects dislodged or thrown from above; water hazards; accidental drowning; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; vehicle accidents; hazardous road conditions; my own physical condition, and the physical exertion associated with this activity. 


I AM AWARE AND UNDERSTAND THAT THE ACTIVITY IS A POTENTIALLY DANGEROUS ACTIVITY AND INVOLVES THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY, INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE.

PARENT’S OR GUARDIAN’S ADDITIONAL INDEMNIFICATION

I, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative, and estate, hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, manager(s), employees, agents, affiliates, members, successors, and assigns (collectively, “Releasees”), on account of injury, disability, death, or property damage arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Release and forever release and discharge the Company and all other Releasees from liability under such claims.

I expressly assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

Photos: Brown Girls Climb, LLC would like to capture participation in meets ups and trips through photography.

These pictures are primarily for the purposes of recording Brown Girls Climbing, LLC history. However, occasionally these photographs are published in brochures and other contexts and shared with the public. These images become the exclusive rights of Brown Girls Climbing, LLC and may be used for any Event (Event is described as any recreational activity promoted or organized with Brown Girls Climb), pain promotion, or general social media use to promote Brown Girls Climb, LLC and any other partner organizations or businesses. The images from this Event By signing this agreement, you release the rights of any images captured during the Event to Brown Girls Climb, LLC and associated partners or sponsors to use the images to advertise, market and promote Brown Girls Climb, LLC and any sponsors or partners in any and all media without paying any additional compensation, costs or expenses and the right to use, reproduce, format, copy, transmit, store, and configure social media posts (Facebook, Instagram, Browngirlsclimb.com or partner or sponsor websites) or take (or authorize third party vendors to take) whatever other action is required as reasonably necessary to perform all of the foregoing activities.

I give my full permission to Brown Girls Climb, LLC and any other media sources to use my or my child's name (if applicable) and any photographs, videographs, website, motion pictures or recordings for any publicity and promotional purposes without obligation or liability to me.

I hereby irrevocably grants Brown Girls Climb, LLC the right, but not the obligation, to exhibit, distribute, market, display, project, transmit, broadcast, publicly display, publicly perform, share, link to and otherwise use the Social Media Posts.
