ACKNOWLEDGEMENT OF RISKS, ASSUMPTION OF RISK
AND RESPONSIBILITY, RELEASE OF LIABILITY AND INDEMNIFICATION
(For Minors)
To Parents and other Legal Guardians of all Minor Prospective Rodeo Participants: Your child or ward is expressly prohibited from participating in the Bryce Canyon Country Rodeo or otherwise engaging in any rodeo activity on the property of Ruby's Inn, Inc., or in any way associated with Ruby's Inn, Inc., and from entering any area on the rodeo grounds other than the spectator seating area, unless you have read this form in its entirety, understand its contents, agree to the provisions herein, and have personally signed below on behalf of your minor child or ward.
WARNING and ACKNOWLEDGMENT OF RISKS: PARTICIPATING IN A RODEO IS DANGEROUS AND INVOLVES SIGNIFICANT INHERENT RISKS, INCLUDING, BUT NOT LIMITED TO, SERIOUS BODILY INJURY, PERMANENT TRAUMA, SPRAINED OR TORN MUSCLES AND LIGAMENTS, FRACTURED OR BROKEN BONES, EYE DAMAGE, CUTS, SCRAPES, CONTUSIONS, CONCUSSIONS, PARALYSIS, NECK AND/OR SPINAL INJURIES, SHOCK, PARALYSIS, AND EVEN DEATH. THESE RISKS CANNOT BE ELIMINATED. By signing this acknowledgement, I understand that the following describes some, but not all, of the ways in which my minor child or ward may be so injured, paralyzed or killed: (1) being stepped on, trampled, kicked, crushed, gored, bitten or otherwise injured by the rodeo stock they ride, including sheep, bulls and horses, or by other stock, including the pick-up horses, in or around the arena; (2) colliding with the ground, fences, gates, barrels, or other equipment; (3) hanging up or otherwise becoming entangled in stirrups, reins, ropes, bull-ropes or other gear, fences, chutes or gates.
EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY:
(1) I agree to fully assume responsibility for the risks identified herein on behalf of my minor child or ward, as well as those risks not specifically identified and any resulting expenses. My child or ward’s participation in this activity is purely voluntary, and no one is forcing them to participate. My minor child or ward is sufficiently physically and mentally fit to participate in all rodeo events in which they participate.
(2) I am fully responsible for providing my minor child or ward’s own equipment, including, but not limited to, saddles, helmets, protective vests, gloves, ropes, bull-ropes and spurs. I am also fully responsible for inspecting all equipment used by my minor child or ward, whether owned by them or me or borrowed or otherwise obtained from another, including equipment obtained from Ruby's Inn, Inc., or its employees, agents and volunteers, and to assure that such equipment is in good working order and used appropriately, including, but not limited to, in the case of rough-stock riding, safely adjusting the proper tension of the wraps and the ropes in a manner that is not likely to cause my minor child or ward becoming hung up or otherwise entangled. I alone am responsible for the equipment they use.
(3) I am fully responsible for inspecting the rodeo facilities, including, but not limited to, the gates, fences and chutes, to assure that all such facilities are in good working order, and agree not to allow my minor child or ward to participate unless I make such inspection and inform Ruby's Inn, Inc. of any facilities I find not to be in good working order or that otherwise may represent a hazard to my minor child or ward in any way.
(4) I will not allow my minor child or ward to use alcohol or intoxicating drugs on Ruby's Inn, Inc.'s premises, nor will I allow them to participate in the rodeo if they are under the influence of alcohol or any drug, legal or illegal, that impairs my physical or mental abilities.
(6) I am a natural parent or the duly court-appointed legal guardian of the minor for whom I am signing.
(7) As a rodeo contestant I understand and acknowledge that my minor child’s or ward’s relationship with Ruby's Inn, Inc. is solely that of a competitive contestant in a rodeo contest, and that their participation is not to be construed as employment by Ruby's Inn, Inc. or any of its owners, subsidiaries, affiliates, agents or assigns. In the event they receive prize money or a monetary participation award, I acknowledge and agree that such prize or payment does not constitute a wage or compensation as an employee or independent contractor, but is solely a prize for competing in the rodeo. (8) If my minor child or ward is currently employed by Ruby’s Inn, Inc. I understand and acknowledge that their participation in any rodeo event is not in the course and scope of their employment or in any other way a part of or connected with their employment, that their participation is of their and my own free will and choosing, and that their employment status is in no way conditional upon, connected to or affected by their or my decision to participate or not to participate in any rodeo event. While participating in the rodeo, I also agree to not allow my minor child or ward to wear any uniform, hat or other item that would identify them as an employee of Ruby's Inn, Inc. If they are an employee of Ruby’s Inn, Inc. and participate in a rodeo during their shift, I understand and agree that as soon as they leave their employment post and move toward the place of rodeo participation, at that point they are no longer on company time or in the performance of their employment duties, and have “clocked out.” They may resume their employment duties after participating in the rodeo event once they return to their place of assigned duties as an employee.
AUTHORIZATION: I hereby authorize any medical treatment deemed necessary for my minor child or ward in the event of any injury while participating in any rodeo activity. I either have appropriate insurance or, in its absence, agree to pay all costs of medical services as may be incurred on their behalf.
RELEASE AND INDEMNIFICATION: In consideration for being allowed to participate in any rodeo event on Ruby's Inn, Inc.'s property, I, for myself, my minor child or ward, my and their heirs, assigns and personal representatives and their and my estate, do hereby covenant not to sue and release RUBY'S INN, INC. and its principals, shareholders, directors, officers, agents, employees and volunteers (collectively called "Releasees") from all liability and waive any claim for damage arising from any cause whatsoever, including Releasees' own negligence, regardless of whether such negligence is the partial or sole cause of any injury, damage or death, including property damage. I also agree to protect, indemnify and save Releasees harmless from all claims, demands and causes of action of every kind and character arising in favor of me or my minor child or ward and their and my heirs, assigns, personal representatives and their and my estate on account of any injuries or damages I or my minor child or ward may suffer, or their death. On behalf of myself my minor child or ward I have read, understood, and accepted the terms and conditions stated herein and acknowledge that this agreement shall be binding upon myself, my minor child or ward, my and their heirs, assigns, personal representatives and estates.
SUCCESSIVE PARTICIPATION COVERED: The terms and provisions of this agreement shall apply to all rodeo events in which my minor child or ward participates, including, but not limited to, mutton busting, bull riding, saddle bronc and bareback riding, barrel racing, calf roping and team roping, from the date that I sign below, regardless of the number of events, and regardless of the number of days on which such events occur.
SEPARABILITY: If any provision of this agreement is found to be unenforceable by a court of competent jurisdiction or an arbitrator or panel of arbitrators, all other provisions shall remain in full force and effect. witness |
