Waiver, Release, Hold Harmless, and Indemnification Agreement

PLEASE NOTE OUR POP-UP PLAY AREA TOYS ARE MEANT FOR CHILDREN AGED 6 AND UNDER.  IN ADDITION, OUR FACILITY IS AN ALL AGES FACILITY AND THEREFORE CHILDREN MUST BE SUPERVISED ACCORDINGLY AND AT ALL TIMES.

As Consideration for being allowed to enter the play area and/or Participate in any party and/or program at Sugar Space Play Café and Sugar Space LLC, the undersigned, on his or her behalf, and on the behalf of the Participant(s) identified below, acknowledges, appreciates, understands, and agrees to the following:

I represent that I am the parent or legal guardian of the Participant(s) named or I have obtained permission from the parent/legal guardian of the Participant(s) named to execute this agreement on their behalf.

I acknowledge that my participation and my child’s participation in or use of Sugar Space Play Café and Sugar Space LLC’s games or activities contains known and unanticipated risks that include, but are not limited to, bodily injury. I understand these injuries may be caused or contributed by the negligence or carelessness of others. Some risks include but are not limited to: cuts and bruises, muscle and joint sprains and strains, broken bones, collisions with other participants, paralysis, illnesses, viruses, Covid-19, and/or other serious injuries, and in extreme cases, even death. I understand there are some risks associated with indoor playground equipment, retail items, hot beverages, food and toys, steps, rugs/mats and/or uneven surfaces, climbing toys, mirrors, furniture, stairs and concrete floor, parking lots, vehicles, electrical outlets, lighting, fireplace, and outdoor areas at Sugar Space Play Café and Sugar Space LLC.

I agree that Participant(s) named, and I shall comply with all, posted safety signs, rules, and verbal instructions as conditions for participation in activities at Sugar Space Play Café and Sugar Space LLC. If I observe any hazard during our participation, I will bring it to the attention of the nearest Sugar Space Play Café and Sugar Space LLC employee.

I acknowledge that Sugar Space Play Café and Sugar Space LLC does not require me to participate in these activities. I recognize the existence of inherent risks in participation in Sugar Space Play Café and Sugar Space LLC activities and I agree that I freely accept and assume all inherent risks and dangers associated with my participation and my child’s presence and/or participation in or at the said activity.

I assume full responsibility for understanding and following the rules and safe practices associated with Sugar Space Play Café and Sugar Space LLC activities and for the personal safety of my child and me.

I waive any and all claims against Sugar Space Play Café and Sugar Space LLC arising from or connected, directly or indirectly, with my presence and/or participation, or my child’s presence and/or participation at these activities.

I release Sugar Space Play Café and Sugar Space LLC from any and all liability for any loss, damage, injury, illness or expense that I, or my child, may suffer or incur by reason of my presence or my child’s presence at, or participation in, this activity, due to any cause whatsoever, including negligence on the part of other participants, or anyone else.

I further agree to hold harmless and indemnify Sugar Space Play Café and Sugar Space LLC from any and all liability for any and all liability for loss, damage, personal injury, illness or death to myself or my child or by anyone else in connection with my presence or my child’s presence at, or participation in, this activity. Should Sugar Space Play Café and Sugar Space LLC or anyone acting on its behalf be required to incur legal fees and costs to enforce this agreement, I agree to indemnify and hold Sugar Space Play Café and Sugar Space LLC harmless from all such fees and costs.

I acknowledge and understand that Sugar Space Play Café and Sugar Space LLC is not responsible for any lost or stolen items of personal property belonging to myself or my children under my care while said property is at Sugar Space Play Café and Sugar Space LLC facilities, including but not limited to lockers, parking lots and vehicles in parking lots.

I understand that photographs may be taken of myself & my children and used on Sugar Space Play Café and Sugar Space LLC's social media accounts.

I understand I may periodically receive promotional e-mails from Sugar Space Play Café and Sugar Space LLC (we do not sell our subscriber list). I further understand I am able to unsubscribe from any email subscriptions at any time and it will not effect me negatively. Benefits of staying on the mailing list includes early notification of events, discounts and specials.

Any litigation involving the parties to this agreement shall be brought in the exclusive jurisdiction of the State of Utah and shall be governed by the exclusive laws of the State of Utah.

All of the provisions of this Agreement shall be treated as separate and distinct and if any provision is declared invalid, the other provisions shall nevertheless remain in full force and effect.

The Rules of Sugar Space Play Café and Sugar Space LLC:

To keep everyone safe, we have a few rules:

Parents must supervise their children at all times.  Sugar Space is not responsible for supervising children at any time.

PLEASE KEEP BABY GATES LOCKED AND CLOSED ON AT ALL TIMES. If you are unclear how to open or lock a gate please call out and a staff member can assist you. If a stairwell is present, even if your child can go up and down the stairs unassisted and/or go in and out doors, some children are unable to and therefore when you come in or go out you must lock and secure the baby gates and doors for the safety of all guests.

Kids and adults take off your shoes before entering the play area. Everyone must wear grip socks in the Play Area or adults can wear shoe covers. Barefeet are allowed on the Pikler Triangle only (it gets slippery with regular socks). Grip socks or bare feet are required when using this toy.)We have grip socks you can buy if you forget yours. Please note that the floors outside of the play area could be slippery when wearing socks. Use caution when walking in other areas of the building outside of the Play Area. Please put your shoes back on when not utilizing the indoor Play Area.

Parents must sign a waiver prior to children playing (please read above).

No climbing or hanging on the walls, baby gates, curtains or furniture.

No food, gum, or candy allowed in the Play Area. Outside toys are discouraged and especially toys or objects that are not infant and toddler friendly. 

Children who have been recently sick (not Covid-19), are requested not to enter the facility (until 48 hours AFTER the last sign of symptoms). See extra Covid-19 illness precautions below.

Sugar Space Play Café and Sugar Space LLC is a non-smoking, non-vaping facility.

If you are eating in the designated Food and/or Café area, please keep it clean – if there are any spills, let us know – we’ll be happy to clean them up so no one slips.

Sugar Space Play Café and Sugar Space LLC is not responsible for lost, stolen, or damage to personal property brought into or stored on the premises.

Persons not following the safety rules will be asked to leave.

All Children must be accompanied by parent/guardian and parents/guardian are responsible for children at all times and may not leave them unattended in any areas of the facility for any length of time.We are unable to provide "babysitting" services at this time. It is the parents/guardians responsibility to ensure their children are following the rules for everyone's enjoyment and safety.

Adults WITHOUT accompanying children under their supervision are not allowed in the indoor pop-up play area(s) but can utilize the public Café area

No outside food or beverages allowed.

Beverages and/or food purchased at the Café may be hot. Please use caution!

The play area is meant for kids ages 6 and under and therefore rough play is not allowed. Older kids and siblings are welcome as long as they are playing appropriately.

If you want to reserve the play space privately for a meet up or group please let us know in advance! We apologize but we cannot accommodate groups or parties without a reservation.

We do not allow outside food or drinks aside from baby food, breastmilk and formula.

If you or your child have a cough, green runny nose, fever or “sick” symptoms, we please ask that you stay home to avoid infecting any of our other guests. If we notice you or your child experiencing any of these symptom, we will ask you to reschedule your visit for another time when these symptoms are no longer present. We do our best to provide a fun, clean and a “germ free” environment for our children and yours.

We may make changes to our hours and open dates and they will be posted and announced via social media, website and/or email.  Reasons for closing may include, private event bookings at Sugar Space, weather, staffing, maintenance etc. If you are unsure about our hours at any time, please call us at 385-202-5504!

Our Play Café is available for rental for parties and events! Please contact us to discuss the many available options.

Art, Dance, Yoga, Music, Juried Short Films and Bounce and Play are just some of the add-on classes and events available in the theater room at the Sugar Space Play Café. Some classes and activities are led by Sugar Space Play Café and Sugar Space LLC and some activities may be hosted by a third party. Some classes require an additional fee and some classes are FREE.

Bathrooms will be located across the driveway in our “Warehouse” building and children must be accompanied by parents at all times as the bathrooms are located in a higher traffic building and you must cross a driveway and parking lot.

Parents are strongly encouraged to monitor and deter their children from engaging in play activities that increase the spread of germs (such as putting toys in their mouths). To make it easier, we removed any toys that are difficult to disinfect and sanitize and introduced new ones that are better suited for safety. 

All toys will go through a deep cleaning process at the end of every session.

If you have any of the following symptoms, you agree to not visit out business. These are including but not liimited to a fever of 100.4 or higher, cough, shortness of breath, decrease in sense of smell or taste, sore throat, muscle aches and pains, known exposure to Covid, awaiting Covid test results, etc. You agree to not visiit if the CDC recommends you should be quarantined for exposure or possible exposure to Covid-19. You agree to physically distance from groups outside your immediate household, by 6 feet. to the best of your ability.

Food and beverages will be available from the cafe located in our larger building (warehouse). The cafe is currently managed by a third party although Sugar Space does provide some food options in conjunction with the third party provider. I HAVE READ THIS DOCUMENT THOROUGHLY AND I ACKNOWLEDGE AND REPRESENT THAT I understand it and sign it on behalf of myself and my minor child voluntarily of my own free will. No oral representations, statements or inducements apart from the foregoing agreement have been made. I am at least eighteen (18) years of age and fully competent. I execute this Agreement for full, adequate and complete consideration fully intending to be bound by the same.
