DIPNET CHARTER WAIVER AND RELEASE OF LIABILITY

The undersigned, for good and valuable consideration, including services provided by AK Expeditions LLC, hereby executes this Waiver and Release of Liability in favor of AK eXpeditions, LLC. and its directors, officers, employees, affiliates, agents, insurers, re-insurers, successors and assigns (hereinafter collectively referred to as “AK eXpeditions”). I make the following representations and agree to the following waiver and release of liability and acknowledgement of risk:

I have chosen to participate in dipnet fishing activities in the remote backcountry on the Copper River including hiking to and from unimproved launch, getting on and off boats from beach, paddling boats, lifting heavy nets, coolers and gear and/or other related or resultant activities (the “Activities”) arranged for a fee on my behalf by AK eXpeditions. I am in good health and have no physical conditions that affect my ability to participate in the Activities.

I understand that the Activities are dangerous activities, which entail risks, including risks that are not reasonably foreseeable or that cannot be controlled or eliminated by AK eXpeditions. These risks include, but are not limited to, the risk of bodily injury or death, short and long-term disabilities, mental anguish, pain and suffering and similar or related conditions, and damage to property.

I assume all of the risks associated with my participation in the Activities, including risks not specifically identified in this document, and the risk of injury, death, or property damage caused by the condition of any property, facilities or equipment used in connection with the Activities.

I hereby irrevocably and unconditionally waive, release, and discharge AK eXpeditions from any and all claims, demands, losses, liabilities, actions, suits or rights of any kind or nature, for any injuries, death, or property damage, arising out of, caused by, or resulting in any way from any accident, incident, or occurrence, the use or condition of any property, facilities or equipment, and/or on account of first aid or medical treatment provided or the failure to provide first aid or medical treatment, related to my participation in the Activities, even if caused in whole or in part by the negligence of AK eXpeditions or any independent contractor.

I agree to defend, hold harmless and indemnify AK eXpeditions from any claim, liability, loss, damages, expenses, or attorney fees resulting from a claim brought by a fellow participant, spectator, rescuer, or any other person for injury, death, or property damage caused by my conduct in connection with the Activities and/or that of any members of my family, and all minors on whose behalf this release is signed.

I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

This Waiver and Release of Liability contains the entire agreement between myself and AK eXpeditions, is a legally binding agreement that will be construed broadly to provide a release and waiver to the maximum extent permitted by law, and is binding on my family members, heirs, successors, assigns, and legal representatives. Any provision of this Waiver and Release of Liability found to be void or unenforceable shall be severed from this agreement and shall not affect the validity or enforceability of other provisions. Any dispute relating to this agreement shall be subject to the exclusive jurisdiction and venue of the State and Federal courts located in Anchorage, Alaska.

I have read and voluntarily signed this document and I understand that by signing below, I have given up substantial rights. I acknowledge that, but for the execution of this Waiver and Release of Liability, AK eXpeditions would not arrange for my participation in the Activities.

 FISH ARE NOT GUARANTEED

Although it is not common to leave a trip empty handed, it can happen. AK eXpeditions can not guarantee that you will catch fish or reach your permit limit but promise to put you in the best position possible to maximize your opportunity to dipnet salmon. Factors outside our control include run timing, river conditions or an individual's strength and skill level are key factors that can impact fishing success. Please understand, you are booking a charter to safely navigate the Copper River to dipping locations along the river and use our crew, boats and dipnets to ATTEMPT to catch fish. You are NOT booking a charter to be supplied with fish. As such it should be clear NO REFUNDS of any kind will be offered should you not be successful in catching salmon on your charter with us.

It is our job to safely transport our clients along the Copper River and put them "over the fish." We do so in comfort, safety and in most fun-filled enjoyable atmosphere possible. Assuming the salmon cooperate, the remainder is up to the dipnetter to net the fish and ensure it is landed. It is unlawful for our crew to pull up the net or fish on the dipnetter's behalf. If the net is not pulled up fast enough, it is common for the fish to escape before being hauled aboard. Dipnetting is a physical endeavor, and the level of skill and experience in dipnetting is directly related to its success. We are fishing in some of the most stunning backdrops on earth, don't forget to look around and have some fun!

 COVID-19 CLIENT PROTECTIVE PLAN

The goal of this plan is to keep clients, employees, contractors, and the communities that support AK eXpeditions safe and healthy, and to minimize the risk of exposure to COVID-19 during the course of normal business operations. AK eXpeditions relies on the Alaska Health Mandates and Health Alerts, as well as guidance by the State of Alaska, U.S. Center for Disease Control and the U.S. Coast Guard in establishing procedures intended to keep you safe while dipnetting.

Dipnet Charter Preparation:

Please plan ahead for your trip. Shopping for food, beverages, gear, or other items should be done in your home community as much as possible, to limit the opportunity to spread COVID-19 between communities. We will still offer ice for sale at camp.
Bring your own PPE; hand sanitizer, wipes, gloves and mask, etc. These are not available in Chitina.
Bring your own coolers for the boat and to transport your catch home.
If you do need to stop for supplies on your way, please adhere to Alaska Health Alert 10 and use a face covering. We also recommend sanitizing your hands prior to entering and after leaving a business.
Cash transactions for all services and tips are still accepted – However we prefer payment via the “TAP” feature found on many mobile phones (ApplePay, GooglePay, SamsungPay) and credit cards. We also accept credit or debit cards and can charge the card on file for your booking to pay for additional services.
We will follow CDC & Life Jacket Association guidelines for sanitizing our life vests however, please feel free to bring your own US Coast Guard Approved personal flotation device in good repair.
Whenever possible, limit your trip to only include members of your household or those you’ve been sheltering in place with.

During Dipnet Charter:

We can’t always maintain social distance while dipping, but we can take other steps while on board:

Always wear your facemask and gloves while on board.
Don’t share your net, food, beverages, or clothes with people outside of your household.
Pack single-serving foods and beverages. We discourage sharing foods or beverages from a container (e.g., bag of chips, jerky, shared water bottle, etc.).
Stay in assigned locations on the deck and limit moving around unnecessarily.

After your Dipnet Charter:

We sanitize the boat and our dipnet gear after each charter.
If you pack it in, pack it out! Please help keep our crew safe by putting your trash in your carry-on after your trip.
If you will be processing your catch at the beach, please be prepared with tables, knives, etc.
Let us know if you or anyone in your party becomes ill within 48 hours of your trip with us. 907-903-2329
