Sluggers Waiver

Sluggers Academy, LLC Participant Release

Sluggers’ Academy, LLC, the player, and the player’s Parent/Guardian have entered into the following agreement.

Assumption of Risk, Waiver and Indemnification:

(a) The Player and his Parents/Guardian are familiar with the hazardous risks involved in training for and playing various sports on turf field and all such risks are assumed by the Player and his Parents/Guardian.
(b) In order to be allowed to participate in activities at Sluggers’ Academy, LLC, the Player and his Parents/Guardian agree with the Club as follows:

Modification:

i. The Player agrees (and his Parents/Guardian agree in the name of and on behalf of the Player) that Sluggers’ Academy, LLC and its managers, members, employees, agents and representatives shall not have liability or obligation under any circumstances to the Player or his heirs or representatives on account of any injuries or wrongful death incurred by the Player in connection with any of the activities participated in at Sluggers’ Academy, LLC, including participation in games, practices, training sessions or any event whatsoever.
ii. The Player’s Parents/guardian agree that Sluggers’ Academy, LLC and its managers, members, employees, agents and representatives shall not have liability or obligation under any circumstances to the Player or his heirs or representatives on account of any injuries or wrongful death incurred by the Player in connection with any of the activities participated in at Sluggers’ Academy, LLC, including participation in games, practices, training sessions or any event whatsoever. The Parents/Guardian shall jointly and severally indemnify Sluggers’ Academy, LLC and its managers, members, employees, agents and representatives from and against all loss, costs, expenses (including attorney’s fees) and any damages arising from any claim asserted by the Player or his Heirs or representatives on account of any such injuries or wrongful death incurred by the Player.
Any and all modifications to this Agreement must be in writing and signed by ALL parties.

Applicable Law

The parties agree that this Agreement shall be governed by the laws of Massachusetts and consent to jurisdiction in the courts of Massachusetts. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions will continue in full force without being impaired or invalidated in any way. No party shall be entitled to any incidental or consequential damages as a result of any breach of this agreement. This agreement has been entered into as an instrument under seal.
