Release of Liability

and Assumption of Risk

THIS RELEASE IS A BINDING LEGAL CONTRACT. PLEASE READ IT CAREFULLY BEFORE SIGNING.

In consideration of being allowed to participate in any way as a ‘Participant and/or Competitor’ in collaboration with Roc Ventures, Inc. (RV) and other related events and activities... I, the undersigned, willfully sign this waiver in order to acknowledge, appreciate, and agree that rock climbing, elevated obstacle course activities, portable rock wall, and other related activities propose inherent, extreme risk, including the potential for permanent paralysis and death, also including viral infections, bacterial infections, and other communicable diseases and illnesses, and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist.

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown of my participation at RV , even if arising from the negligence of the releases or others, AND ASSUME FULL RESPONSIBILITY FOR MY PARTICIPATION.

I WILLFULLY AGREE TO COMPLY with the stated and customary terms and conditions for participation in RV programs and willfully agree to acknowledge the inherent, extreme risk included with activities which include but are not limited to:

  • FALLING; FLOOR MATS ARE FOR YOUR PROTECTION BUT DO NOT GUARANTEE YOUR SAFETY, INJURIES COULD BE SEVERE
  • INATTENTIVE CLIMBERS, BELAYERS, OR PARTICIPANTS, INCLUDING MYSELF
  • IMPROPER, INCORRECT, OR UNAUTHORIZED USE OF EQUIPMENT
  • INJURIES RESULTING FROM COLLISIONS, DROPPED ITEMS, OR BROKEN HOLDS
  • CUTS, ABRASIONS, OR OTHER WOUNDS FROM CONTACT WITH WALLS OR ROPES

I agree to be observant to the state of the ropes in RV, and that of the anchors, harnesses, equipment, and any damage that I cause, or any other damage, and I further agree that if any defects or unsafe conditions are found within RV, I will cease participation in any and all events and notify facility staff immediately. I also understand that indoor climbing and indoor ropes course is not the same as outdoor climbing and that additional skills are necessary for outdoor climbing that cannot be acquired at RV.

Medical Insurance: I, the participant, do have current medical insurance to cover all injuries that may occur at RV or with the portable rock wall.

Image Release: I, the participant, give RV permission to use photos or videos of myself, the participant, for promotional purposes, on websites, social media, and other marketing material.

I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS, RV, their officers, officials, agents and/or employees, other participants, sponsors, advertisers, wall builders, wall designers, ropes course builders, rope course designers, hold manufacturers, and, if applicable, owners and lessors of premises used to conduct the event, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, VIRAL INFECTIONS, BACTERIAL INFECTIONS, AND OTHER COMMUNICABLE DISEASES AND ILLNESSES, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by the law.

If any provision of this Agreement or its application to any party or circumstance is restricted, prohibited or unenforceable, such provision shall, as to such jurisdiction, be ineffective only to the extent of such restriction, prohibition or unenforceability without invalidating the remaining provisions hereof. In addition, if any one or more of the provisions contained in this Agreement shall for any reason be held to be excessively broad as to time, duration, geographical scope, activity or subject, it shall be construed by limiting and reducing it, so as to be enforceable to the extent compatible with the applicable law of such jurisdiction as it shall then appear.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT AN INDUCEMENT.
