2024 REQUEST AND RELEASE

 

 

I have requested permission to enter and participate in an on- or around-field promotional event to be conducted in conjunction with (i.e., prior to, during, or following) a St. Paul Saints baseball game or event at CHS Field, located in Saint Paul, Minnesota.

I acknowledge that I know the risks and dangers involved in the activities associated with this promotion and that unanticipated and unexpected dangers may arise during such activities. I freely assume all such risk of injury to my person and property, both known and unknown, that may be sustained in connection with the promotion or activities, in and about the premises.

In consideration of the permission granted to me to participate in the promotion or stated activities, I agree to exercise care in participating so as to limit the risk of injury to others and myself. In addition, I hereby for myself, my heirs, administrators and assigns, release, waive, and discharge DBH St. Paul, LLC, the City of St. Paul, together with their respective agents, officers, employees and owners and all other participants in the promotion or stated activities (collectively “releasees”), from of and from any and all claims, demands, actions, and causes of actions of any nature, for injuries sustained to my person and/or property during my presence at CHS Field and my participation in the promotion or stated activities due to their negligence or any other fault. I also hereby agree to indemnify, save, and hold harmless the releasees from any loss, liability, damage or cost they may incur due to my presence or in any way my competing, officiating, observing, working or, for any purpose, participating in the event, whether caused by the negligence of releasees or otherwise. I hereby assume full responsibility for any risk of bodily injury, death or property damage due to the negligence of releasees or otherwise while in or upon any restricted area and/or while competing, officiating, observing, working or, for any other purpose, participating in the event.

If I am under the age of 18 years, I represent and certify that I have the permission of my parents and/or guardians to participate in the promotion or slated activities, and that they have full knowledge thereof and approve of my participation. I promise and warrant that I am not currently, nor will I be at any time during the event, under the influence of alcohol or any drugs which would in any way impair my ability to safely participate.

I certify that my attendance and participation in the promotion or stated activities is voluntary, and I am not, in any way, the employee or agent of the owners, operators, or sponsors of the premises, promotion and activities conducted therein.

I hereby agree, personally and/or on behalf of my child or any participating minor over whom I have guardianship that any and all disputes, controversies or claims of whatever nature arising out of or relating to this Agreement shall be resolved only by submitting the same to arbitration in accordance with the rules of the American Arbitration Association, and consents to exclusive jurisdiction and venue in St. Paul, Minnesota.

I HAVE READ AND UNDERSTOOD THE FOREGOING REQUEST AND RELEASE, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARYILY WITHOUT ANY INDUCEMENT.

**IF UNDER 18 YEARS OF AGE – PARENT/GUARDIAN SIGN BELOW** As parent/guardian with legal responsibility for this participant, I hereby consent and agree to his/her release as provided above, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the releasees from any and all liabilities incident to my minor child’s involvement or participation in the promotion or stated activities. I also certify that I have fully disclosed the names of all minor(s) for whom I have legal responsibility and who are involved with or are participating in promotion or stated activities.
