North Tahoe Paddle LLC Participation and Release Agreement

Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement


1. Assumption of Risk

I acknowledge that participating in stand-up paddleboarding (“SUP”), kayaking, or using any equipment rented from North Tahoe Paddle LLC involves inherent risks, including but not limited to:

  • Collisions with other paddlers, boats, swimmers, rocks, or obstacles
  • Sun and heat exposure, dehydration, hypothermia, and water-related illnesses
  • Changing weather and water conditions
  • The risk of falling, injury, or drowning
  • The risk of death or serious injury

I voluntarily accept all risks associated with participation — including any resulting injury, loss, or death — for myself and for any minors or individuals for whom I am legally responsible and who use the rented equipment.

2. Physical Fitness and Medical Conditions

I certify that I am physically fit to participate in these activities and that I will not participate (or allow others to participate) if I am unfit or have a condition that may be worsened by this activity, including but not limited to:

pregnancy, heart conditions, back problems, epilepsy, or a history of loss of consciousness.

3. Insurance Responsibility

I confirm that I have adequate insurance to cover any injuries or damages that I or those in my care may sustain or cause during this activity. If I do not have such insurance, I agree to bear the full cost of any such injuries or damages.

4. Waiver of Liability

In consideration for the use of any equipment rented from North Tahoe Paddle LLC, I agree to:

  • Waive all claims against North Tahoe Paddle LLC for any injury, loss, damage, or death, even if caused by negligence or breach of duty
  • Release North Tahoe Paddle LLC from any liability arising from my participation or equipment use
  • Indemnify and hold harmless North Tahoe Paddle LLC for any claims arising from my actions or the actions of those using equipment under my reservation

This waiver applies to myself, my heirs, executors, administrators, and legal representatives.

5. Equipment Responsibility & Damage Fees

I agree to maintain the condition and whereabouts of all rented equipment throughout the rental period. This includes stand-up paddleboards, kayaks, paddles, PFDs, leashes, or any additional gear provided.

I agree to the following fees, if applicable:

  • Up to $500 for damage to equipment
  • Up to $1,000 for lost or irreparably damaged equipment
  • If I am not present for equipment delivery or return without prior consent from North Tahoe Paddle LLC, I accept full responsibility for any resulting loss or damage.

6. PFD and Leash Use (Safety Requirements)

I understand that California law requires a U.S. Coast Guard-approved Personal Flotation Device (PFD) to be worn or carried at all times while on a paddlecraft.

By signing this waiver, I agree to:

  • Wear the PFD provided at all times while using rented equipment
  • Ensure all minors and individuals under my care wear a PFD at all times
  • Ensure children under 13 years of age wear a PFD at all times, as required by law
  • Wear the provided ankle leash at all times while using a stand-up paddleboard
  • Follow North Tahoe Paddle LLC’s additional seasonal safety requirements, including mandatory PFD use before July 1 and after September 1


7. Legal Acknowledgment

This agreement shall be governed by the laws of the State of California. Any disputes shall be handled exclusively in California courts.

I acknowledge that I have read and understood this agreement and that it is binding upon me, my family, heirs, and legal representatives. I understand I am responsible for ensuring that all individuals using the rented equipment under this reservation are aware of and agree to the terms of this waiver.


8. Declaration

I declare under penalty of perjury that:

  • I am at least 18 years old
  • I am signing on behalf of myself and, if applicable, any minors or others in my care
  • I have explained the terms of this agreement to any such individuals
  • I fully understand and voluntarily agree to the terms of this waiver
