North Tahoe Paddle LLC Participation and Release Agreement

Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement


By agreeing to this waiver you are waiving certain legal rights, including the right to sue. Accordingly, you must read this agreement carefully before signing.

Assumption of Risk: I am fully aware of the risks and hazards inherent in stand up paddle boarding (“SUP”), kayaking, and using any other additional equipment rented from North Tahoe Paddle LLC. Such risks and hazards include, but are not limited to, being hit by or colliding with other stand up paddle boarders, kayakers, boats, vessels, swimmers, rocks, and cliffs. I am also aware of the risk of exhaustion, dehydration, water pollution, sun/heat exposure, hypothermia, and accidental drowning. I further understand there is the possibility of death or serious physical or mental injury associated with SUP, kayaking, and using any other additional equipment rented from North Tahoe Paddle LLC. I hereby voluntarily assume all risks of loss, damage, injury, or death that may be sustained by me -- and the individuals of which I am a legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC. I also voluntarily assume responsibility for damage to any and all of my property and the individuals of which I am a legal guardian of, including my children’s property, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC.

Insurance: I certify that I have adequate insurance to cover any injury or damage I (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) may cause or suffer while participating in SUP or kayaking, or using any other additional equipment rented from North Tahoe Paddle LLC. If such individuals do not have adequate insurance, I agree to bear the costs of such injury or damage myself.

Fitness for Participation: I further certify that I am physically fit to stand the rigors associated with SUP, kayaking, or using any other additional equipment rented from North Tahoe Paddle LLC. I also certify that I am willing to assume the risk of any medical or physical condition I (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) may have, including, but not limited to: pregnancy, heart condition, back problems, loss of consciousness, and/or epilepsy.

In respect of renting any equipment from North Tahoe Paddle LLC including stand up paddle boards, kayaks, or any other additional equipment, I hereby agree to:

  1. To waive any and all claims that I have or may in the future have against North Tahoe Paddle LLC and to release North Tahoe Paddle LLC from any and all liability for any loss, damage, expense or injury, including death, that I (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) may suffer as a result of participation in a North Tahoe Paddle LLC activity due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care, on the part of North Tahoe Paddle LLC, and further including the failure on the part of North Tahoe Paddle LLC to safeguard or protect me from or warn me of the risks, dangers and hazards of participating in a North Tahoe Paddle LLC paddle board rental, kayak rental, or physical activity.
  2. To hold harmless and assure North Tahoe Paddle LLC from any and all liability for any property damage or personal injury to any third party resulting from my (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) participation in a North Tahoe Paddle LLC paddle board rental, kayak rental, or physical activity.
  3. This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives, in the event of my death or incapacity.
  4. This Release Agreement and any rights, duties and obligations as between the parties to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the State of California and no other jurisdiction.
  5. Any litigation involving the parties to this Release Agreement shall be brought solely within the State of California.
  6. When participating in the rental or use of North Tahoe Paddle LLC rental equipment or physical activity, I agree to accept all responsibility to maintain the condition and whereabouts of all the equipment rented for the entire rental period and to pay all repair and/or replacement costs for any damage or theft that may occur to equipment during the rental period. Should I (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) damage a stand up paddle board, kayak, or any other additional equipment rented from North Tahoe Paddle LLC, I agree to pay a damage fee not to exceed $300.00 per board kayak, or any other additional equipment. Should I (or the individuals I am legal guardian of, including my children, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) lose or damage a stand up paddle board, kayak, or any other additional equipment beyond repair, I agree to pay a replacement fee not to exceed $750.00.
  7. If I am not present during the delivery or return of my stand up paddle board, kayak, or any other additional equipment without consent from a representative of North Tahoe Paddle LLC, I will be fully responsible for any loss, theft or damage to the board, kayak, or any other additional equipment.
  8. I hereby declare under penalty of perjury that I understand that I recognize that I alone am responsible for any and all risks outlined above that may be suffered by other individuals (including minors) who use any of the equipment rented or leased from North Tahoe Paddle LLC.
  9. I hereby declare under penalty of perjury that I have explained to any individual (including minors) the terms of this Release Agreement, it’s significance and the assumption of risk they are undertaking by use of the equipment rented or leased from North Tahoe Paddle LLC.

I understand California law requires a Personal Flotation Device (PFD) while on a watercraft. I have received a PFD from North Tahoe Paddle LLC and agree to wear my Personal Flotation Device at all times while participating in SUP, kayaking, or using any other additional equipment rented from North Tahoe Paddle LLC. I also agree to ensure that any other individuals (including my children, individuals I am legal guardian of, or any other individuals who I allow to use any of the equipment rented or leased from North Tahoe Paddle LLC) will wear a PFD while on any of the water sports equipment rented or leased from North Tahoe Paddle LLC.  Furthermore, I understand that any child younger than thirteen years of age is REQUIRED BY LAW to wear their PFD while on any of the equipment rented or leased from North Tahoe Paddle LLC.


I have read the Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement and fully understand its contents. By signing this document I swear that I am 18 years of age or older and voluntarily agree to the terms and conditions stated above.
