Participant Waiver, Release/Indemnity and Range Rules
In consideration for the agreement of Triple J Armory, Inc. (Triple J) to allow the undersigned, and/or any participant for whom sign below, any of the following consideration: access to or use of the indoor shooting facilities, classroom instruction, training, and rental of firearms provided by Triple J Armory at its indoor shooting facility located at 8152 SouthPark Lane, Littleton, CO 80120, I acknowledge and agree to the following (this Release):
ACKNOWLEDGEMENT AND ACCEPTANCE OF RISK ASSOCIATED WITH FIREARMS ACTIVITY
I understand and acknowledge that the shooting of firearms (“Firearms Activity” or “Activity”) at any indoor range or facility is a HAZARDOUS AND POTENTIALLY DANGEROUS ACTIVITY and that, as an observer or participant, I may suffer serious bodily, psychological and neurological injury or death, or cause injury to another person or property. Among the possible causes of serious injury or death include, but are not limited to (i) exploding or malfunctioning weapons and ammunition, even if rented/purchased from Triple J Armory; (ii) direct fire or ricochet of a bullet, either from my weapon, or the weapon of an instructor or another customer; and (iii) hearing loss, eye injuries and/or loss of eyesight; (iv) inhalation or contact with airborne hazards, including lead; and (v) injury or death resulting from a slip, fall, collision, noise, or environmental condition (including air quality), even if not directly caused by firearms but while I am on or off the premises. I understand that injury or death could result from other causes not listed above, and that any event, weather obvious and latent, natural or man-made which causes injury or death is covered by this release.
I am voluntarily participating in Firearms Activity with knowledge of the danger involved and agree to accept any and all risks of serious injury or death, economic loss, property damage or loss that may result not only from my own actions, inactions or negligence, but also from the actions, inactions or negligence of Triple J Armory, it’s instructors, Range Safety Officers, customers, employees and others and/or the condition of the Triple J facility, and I voluntarily agree to assume this risk.
I understand that under C.R.S. § 13-21-111.8: Any person who engages in sport shooting activities at a qualifying sport shooting range, as defined under section 25-12-109 (2)(d), C.R.S., assumes the risk of injury or damage associated with sport shooting activities.
RELEASE AND INDEMNIFICATION
I, my personal and/or legal representatives, heirs, successors and next of kin do hereby unconditionally and irrevocably release, waive and discharge Triple J Armory, Inc, including its owners, shareholders, members, managers, employees, club officers, range masters, match directors, range safety officers, agents, representatives, attorneys, independent contractors, subsidiaries, property owner (SouthPark LLC), all SouthPark LLC principles and affiliates and each, every and all persons acting by, through, under or in concert with any of them (Released Parties) from any and all actions, causes of action, claims, charges, demands, losses, damages, costs, attorneys fees, judgments, liens, indebtedness, and liabilities of every kind and character, whether known or unknown, including foreseen or unforeseen bodily injury and personal injuries and property damage that may be sustained by me or any other person in any way connected to, related to or arising out of my participation in the Firearms Activity, except as may be solely and directly the result of gross negligence or willful misconduct on the part of Triple J Armory or any Released Party. I further agree to indemnify and forever hold harmless Triple J Armory and all other Released Parties from any and all injuries and damages, liabilities, causes of action, judgements and any and all claims arising under, arising out of, or related to my use of the Triple J Armory facilities and equipment, event such damages are caused by any Released Party through negligence or breach of any legal duty or standard of care.
COVENANT NOT TO SUE
I, my successors, next of kin, heirs, guardians, and personal and legal representatives will not make any claim or otherwise seek losses, costs or expenses of any nature whatsoever, known or unknown, suspected or unsuspected, against any of the Released Parties for any injury, damage, death or any other loss arising from or related to participating in the Activity on or about Triple J’s premises and/or facilities, including without limitation, wrongful death, personal injuries, death and/or personal injuries to third parties, and injuries to property, real or personal.
FACILITIES & EQUIPMENT
I accept full responsibility for the repair and/or replacement of the facilities and equipment that I rent, borrow or use that is owned by Triple J Armory in the event that damages are directly caused by myself or my guests. This includes, but is not limited to: range surfaces, range equipment, range furniture, range signage, shooting stalls, rental firearms and borrowed eye/ear protection.
I have read, fully understand, and agree to follow the Triple J Armory posted Shooting Range Rules.
PERSONAL FIREARMS AND EQUIPMENT
I have, prior to engaging in any Firearms Activity at the Triple J Armory Facility, determined that, by professional standards, my shooting equipment, ammunition and all corresponding items are in good condition and suitable for the shooting contemplated by this Release.
CHOICE OF LAW; INTERPRETATION
This Release shall be interpreted according to the laws of the State of Colorado. In the event that any court of competent jurisdiction determines that any provision herein is to broad, the Release shall be interpreted so that the provision is interpreted in a manner so as to maximize the protection intended for Triple J Armory and the Released Parties, and this Release, to the extent so modified, shall remain in full force and effect.
This Release is binding upon me, my successors, next of kin, heirs, guardians, and personal and legal
I hereby certify that there exists no condition, whether physical, mental, legal (including without limitation any adjudication, conviction, etc.) or otherwise that would prohibit me from engaging in Firearms Activity at any time at the Triple J Facility, or any health or medical condition that might be impacted or worsened by my use of the Triple J Facility (including without limitation, pregnancy, heart problems and/or breathing problems).
KNOWING AND VOLUNTARY EXECUTION
I hereby certify that I, the Participant or Parent or Legal Guardian of a Minor Participant, am least 18 years of age and that I have carefully read this Release and fully understand its content. I am aware this is a full release of liability by me of Triple J Armory and all Released Parties, and that by signing it, I have given up substantial rights (including the right to sue) and I sign it of my own free will. This Release and the terms and conditions herein shall be deemed in effect for one calendar year from date of signature and will be restated and re-certified upon expiration, unless otherwise indicated in writing.
Triple J Armory Shooting Range Rules
- Eye and Ear protection are required at all times!
- Obey the commands of Range Safety Officer staff at all times
- All firearms must be transported unloaded and in a case
- Always treat firearms as if they are loaded
- Never point the muzzle at anything you are not willing to destroy
- Finger off the trigger until your sights are aligned and on target
- Always keep the firearm action open and unloaded when not firing
- It is your responsibility to know how to properly use and operate your firearm(s)
- No firing from a kneeling or prone position, Standing Only
- Shotguns are NOT permitted on the range
- Maximum of two people per lane, unless authorized by staff
- Only one person per lane may fire at any time
- No incendiary, tracer rounds or black powder firearms are permitted. A fine will result
- No drawing or firing from a holster unless previously qualified by Triple J Armory RSO staff
- All casing and uncasing of firearms must be done in the stall
- All loading and unloading of firearms must be done in the stall
- Magazines may be loaded at the rear tables
- Do not shoot the range equipment, walls, floors, ceiling or baffles. A fine will result
- Firearms may not be exchanged between lanes
- Shooting under the influence of alcohol or drugs is strictly prohibited
- No food, drink, gum or tobacco products are permitted
- Report any injury to staff immediately
- Any and all unsafe behavior will result in dismissal from the range
- Alert the Range Safety Officer if you desire to collect your brass
