170PrescottSt. Worcester,MA 01605 Hold Harmless Agreement, Limits of Liability, Assumption of Risk and Indemnity Agreement for Range and Reball Use This Document Concerns The Rules and Requirements for Use of the Gun Parlor Shooting Range. You are required to Read and Sign This Agreement and to Strictly Abide by all of its Terms. You are legally bound by this Agreement so read it carefully and to the extent that you have any questions ask a Gun Parlor, Inc. Manager for Assistance. In no event shall the management of The Gun Parlor Range Inc., Its shareholders, officers, directors, heirs, consigns, servants and/or employees be held responsible or liable for acts or omissions, for any indirect, direct, incidental, special or consequential damage or costs whatsoever resulting from, or related to, the use or misuse of firearms on any of the shooting range facilities by you. The Gun Parlor Inc. officials have taken precautions to ensure user safety during your visit to the facility and shall not be held liable for any act of omission outside its jurisdiction and control or directly related to negligence on the part of a customer. Steps taken by The Gun Parlor Inc. include the training of range officers, field operators, and management staff. The facility provides a safe and clean place for the shooting of approved firearms. It is the consumer's responsibility to follow approved rules and to always exercise an appropriate level of caution in the handling and use of firearms and firearm ammunition. All customers of this facility have been notified of all safety rules applicable to the use of the shooting range (hereinafter referred to as "the Facility" or "the Range". Each person using the Facility will be required to execute this Agreement and each such person expressly agrees to hold The Gun Parlor Inc. harmless for any acts or omissions on their part as it relates to: - Transportation of firearms to and from the facility (each person signing this agreement shall certify that the method used to transport said firearms conforms to the laws of the State of Massachusetts);
- Handling and/or use of firearms while at the facility, whether participating in live-fire events on the range or not;
- The use and/or handling of ammunition while at the facility, whether participating in live-fire events on the range or not.
The Undersigned hereby agrees and acknowledges that he or she is knowledgeable in the use and safe handling of the firearms and ammunition he or she will use while visiting the range. The Undersigned hereby agrees and acknowledges that he or she has received, read, understands, and will comply with posted and published rules and regulations as they relate to the use of said facilities. The Undersigned further agrees and acknowledges that the failure to comply with any of the rules of the range, or failure to follow the direction of any Gun Parlor Range Instructor or Employee may result in the expulsion from the range and suspension or termination of range privileges without any refund. The Undersigned further agrees and acknowledges that The Gun Parlor Inc. management, in the sole exercise of its discretion, reserves the right to refuse access to any person(s) or to expel any person for any reason that may constitute or result in a safety violation, damage to the facilities, or for conduct which, in the discretion of Gun Parlor, Inc. employees, may become a safety hazard, ( i.e., unsafe firearm or ammunition handling practices; a demonstrated lack of proper training; the use or attempted use of an unsafe firearm; loud, boisterous or disruptive behavior; failure to wear appropriate clothing and safety equipment, or any other act or omission that is deemed to potentially pose a risk of harm to the undersigned or any other customer. The Undersigned further agrees and acknowledges that he or she is to refrain from the use of any alcoholic beverages and or illegal drugs while upon the premises. The undersigned understands that the Gun Parlor, Inc. has a zero tolerance policy concerning the use of drugs and/or alcohol in connection with the transport, handling and firing of firearms. Any person found to be, or believed to be, under the influence of alcoholic beverages or drugs of any kind while on property owned and/or controlled by The Gun Parlor Inc. will be expelled from the facility and are subject to losing their range privileges without refund of any previously paid fees. The Undersigned further agrees and acknowledges that he or she will use ammunition in their firearm(s) which has been properly loaded, either by a licensed manufacturer, or, if the ammunition has been loaded by the undersigned, that it was done following established criteria as contained in leading reloading manuals; and further that said reloads meet or exceed factory specifications regarding safety. The Undersigned further agrees and acknowledges that he or she MAY NOT USE ARMOR PIERCING, STEEL CORE, INCENDIARY or TRACER AMMUNITION and that any damage caused to the range or any of its component parts shall be his or her sole responsibility. The Gun Parlor, Inc. reserves the right to report any and all violations of Massachusetts or Federal gun laws to the appropriate law enforcement officials without warning. The Undersigned further agrees and acknowledges that he or she assumes full responsibility for their own actions while visiting The Gun Parlor Inc. facility, and that he or she are legally responsible for any harm occasioned by his or her use of firearms at the Gun Parlor Range. It is expressly understood and agreed, that in consideration of the undersigned's use of the Gun Parlor, Inc. shooting range, that the undersigned agrees to indemnify and hold harmless the Gun Parlor, Inc. for any and all claims made for injury to person or property which are made in connection with the undersigns use of the facilities. By signing below, you agree that you fully understand and agree to the terms of this Agreement and that you have read and understand the attached Range Rules, Waiver & Indemnity Agreement, and that this signed document will be in effect for the entire calendar year from the start of your membership to the expiration of your membership. RANGE RULES The `Range Safety Officer' (RSO) is in charge at all times and has the right to order a cease fire at any time on the range. If this should occur, all shooters are to lower their firearms, clear the chamber and place the unloaded firearm on the table with the muzzle pointed down range with the safety In the "ON" position. Anyone can order a cease fire at any time for any situation. Range time will not be credited for the cease fire unless authorized by The Gun Parlor Inc. Violation of any of the following Rules can result in the immediate termination of all shooting privileges without refund to the customer. Violation of any state, local or federal law will be reported to the appropriate law enforcement authorities. - No drugs or alcohol are allowed on the premises.
- Any person who appears impaired in any way by the use of drugs and/or alcohol shall be removed
- from the facility.
- All members will have adequate safety equipment prior to entering the range which would include a hat
- with visor facing forward, eye & ear protection, appropriate clothing and shoes must be warn at all times.
- Safety equipment must be worn until the member has exited the range.
- When in the lounge, no person or member will be allowed to load or unload any firearm or magazine. All
- Firearms and ammunition must remain in a carry holster, locked case or a range bag.
- This is a "cold range" which means your gun is loaded at the firing line only.
- Keep the muzzle pointed down range at all times.
- Keep your finger off the trigger except when shooting.
- Keep the action open and the firearm unloaded, except when shooting.
- When leaving the firing line temporarily, lay the firearm unloaded on the firing line table with the action open and the muzzle pointing down range.
- Any equipment left is at the owner's risk.
- Loaded firearms are not to be handed from one person to another.
- Do not change lanes or leave shooting stall with a loaded firearm.
- No one is allowed forward of the firing line. Anyone stepping forward of the firing line will be asked to leave.
- Only fire at your target. No rapid firing, or drawing from a holster unless you have been vetted and approved
- to do so by the training division of The Gun Parlor Inc.
- In the event of a jammed or malfunctioning firearm, lay the firearm on the tray, muzzle pointing down range
- and raise your hand for assistance from the RSO.
- When you are finished shooting, keep the action open and place the unloaded firearm in your bin. Proceed
- to the range check-out area.
- You must be 21 yrs or older and have a valid firearms license to enter into the range and shoot.
- Pregnant woman and children are not allowed inside the range.
- No food or drink is allowed in the range.
- No targets are allowed closer than 10 feet unless otherwise approved by The Gun Parlor Inc.
- Only ammunition purchased on site at The Gun Parlor Inc. Is allowed in our range rental guns.
- Spectators can view from the lounge only. No exceptions.
- Only one member in the shooting stall at a time.
- NO COLLECTING OF BRASS WILL BE ALLOWED. NO EXCEPTIONS.
- GENERAL PUBLIC CUSTOMERS & MEMBERS ACKNOWLEDGE THEY WILL BE CHARGED FULL REPLACEMENT COST OF ANY ITEM(S) YOU LEAVE IN A STATE OF DISREPAIR UNLIKE THAT OF WHEN YOU ARRIVED (INCLUDING LABOR REQUIRED TO REPLACE SUCH ITEMS). EXAMPLES OF COSTS WOULD BE $500 (OR MORE) FOR SHOOTING WALLS, CEILING, BAFFLES, DOORS, TARGET CARRIES OR ANY ITEM OR FIXTURE OTHER THAN THE BACKSTOP.
- When renting fully automatic weapons you will be with an employee of The Gun Parlor Inc, or an RSO at all times and will not be allowed to handle this firearm without instruction.
- Depending on your skill level a Gun Parlor employee or RSO may require you to take an instructional class on certain rental firearms before using them on the range. Class price varies depending on the firearm.
By signing below, you agree that you fully understand and agree to the aforementioned rules and that this signed document will be in effect for the entire calendar year from the start of your membership to the expiration of your membership. Paper copies are available upon request to the sign. RENTAL AGREEMENT General public customers & members affirm, by their signature below, that if they rent a firearm for range use at The Gun Parlor Inc., they will be held completely responsible financially if the firearm is damaged, stolen, lost, or has been Intentionally misused by the person renting the weapon or if the facility is damaged by the customer's use or handling of the firearm. The customer agrees to allow his or her credit card used In renting the firearm to be charged for any damage to the facility or any weapon rented. No rented weapon shall be in any manner altered or modified for any reason whatsoever. If any rented weapon is modified the person renting the weapon shall be liable for the cost of any necessary repairs and/or replacement of the weapon. Every person renting a firearm agrees and understands that they must satisfy the Range Safety Officer ("RSO") that they are proficient in the safe use and handling of any such firearm. All rented firearms are to be used solely and exclusively on the shooting range and may not under any circumstances be removed from the property. All ammunition to be used in any rented firearm must be purchased from The Gun Parlor, Inc. I agree to be bound by the "Hold Harmless Agreement, Limits of Liability, Assumption of Risk and Indemnity Agreement for Range and Reball Use" and the "Range Rules" which are attached hereto. The Gun Parlor Inc., suggests that all persons using the shooting range take a firearms handling class to better prepare yourself for the experience of shooting at The Gun Parlor Inc. Class price varies depending on the firearm We want all persons using our facility to operate in a safe and courteous manner. Shooting sports are safe when established safety practices are followed, but unsafe firearm practices can result in bodily Injury or death to shooters or others, you will be held personally liable if you fail to follow safe firearm practices or if you fail to follow the direction of the RSO or any employee of the facility. - NO ONE IS ALLOWED IN THE LOUNGE THAT IS UNDER THE AGE OF 13
- NO CLEANING OR REMOVING OF FIREARMS FROM YOUR BAG, CASE OR HOLSTER AT ANY TIME. PLEASE LEAVE THEM LOCKED OR HOLSTERED.
- PLEASE DO NOT LEAVE FIREARMS OR PERSONAL BELOINGINGS UNATTENDED, THE GUN PARLOR IS NOT RESPONSIBLE FOR LOST OR STOLEN ITEMS.
- PLEASE CLEANUP & THROW AWAY ANY TRASH THAT YOU HAVE BEFORE LEAVING
- MAKE SURE TO WIPE AND OR WASH YOUR HANDS TO REMOVE LEAD AFTER SHOOTING
- IN THE EVENT OF AN EMERGENCY PLEASE LOCATE A RANGE SAFETY OFFICER OR A GUN PARLOR EMPLOYEE
