JUNIOR CHEER PROGRAM

Buccaneers Team LLC d/b/a the Tampa Bay Buccaneers (“Team”) is pleased to offer the Tampa Bay Buccaneers Junior Cheer Program (each an “Event” and collectively, the “Events”). The Event(s) will include, but may not be limited to, the opportunity to participate in one or more clinics, workshops, rehearsals, and performances (via a virtual online format or in-person).

BY PARTICIPATING IN THE EVENT(S), THE UNDERSIGNED (ON BEHALF OF HIM/HERSELF, HEREAFTER REFERRED TO AS “PARTICIPANT”):

Hereby expressly acknowledges and agrees that participating in the Event(s) is voluntary and may involve risk of bodily harm or injury or death to the Participant. Such risks may be caused by or result from, among other things, slips, falls, collision with other persons, strained or pulled muscles, torn ligaments, Participant’s own actions or inactions, the actions or inactions of others, the conditions in which the auditions take place, or the negligence of the Released Parties named below.

Releases, waives, discharges, and agrees not-to-sue the National Football League, its member professional football teams, Tampa Bay Buccaneers, Buccaneers Team LLC, Buccaneers Holdings LLC, Buccaneers Stadium LLC, Tampa Bay Broadcasting, Inc., Buccaneers Football Stadium Limited Partnership, Buccaneers Stadium Corporation, First Allied Development Partners, First Allied Development Partners Limited Partnership, the Tampa Sports Authority, the City of Tampa, the County of Hillsborough, and all of their respective partners, stockholders, officers, directors, employees, agents, affiliates, and sponsors (collectively, the “Released Parties”), from all present and future claims for property damage, personal injury, or wrongful death arising from or relating to Participant’s participation in the Event(s), wherever, whenever of however the same may occur.

Understands that this document is intended to be as broad and inclusive as permitted by the laws in the state of Florida and agrees that if any portion of this agreement is invalid, the remainder will continue in full legal force and effect;

Agrees that any legal proceeding related to this Waiver and Publicity Release would be resolved individually without resort to class action and through binding arbitration in Tampa, Florida;

Grants permission to Team, the National Football League (“NFL”), and each of their respective designees the irrevocable permission to photograph, film and videotape Participant in connection with the Event(s) and to use in any manner Participant’s voice, image, and/or likeness and/or photos or video footage of Participant captured or collected in connection with the Event(s), or any video or photograph submission provided by Participant, in any media now or hereafter existing in connection with the Tampa Bay Buccaneers or related events, for any purpose whatsoever, including the commercial purposes of Team, the NFL and/or any of their respective sponsors, partners, licensees, advertisers and/or broadcasters (collectively, the “Team Entities”). Any and all films and photographs of Participant that are taken by Team or provided by Participant as a submission in connection with any Event(s) shall be the exclusive property of Team and may be copyrighted, reproduced, published, broadcast, distributed, sold or otherwise used by Team in its sole discretion.

IF ANY PARTICIPANT IS UNDER 18 YEARS OF AGE:

I represent and warrant that I am the parent or legal guardian of the participant or attendee (the “Minor”) at the Event and that I have read and understood the foregoing Waiver. I fully consent to and voluntarily authorize the Minor to participate in the Event. I acknowledge and agree individually and on behalf of the Minor to the representations, consents, agreements, grants, waivers, authorizations, indemnifications and releases set forth above, which shall be binding on me and the Minor.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN

READ THIS FORM COMPLETELY AND CAREFULLY.  YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY.  YOU ARE AGREEING THAT, EVEN IF THE RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED.  BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY.  YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE RELEASED PARTIES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
