Participant Release of Liability and Assumption of Risk Agreement

− Read Before Signing –

In consideration of being allowed to participate in any way in the tour, bottling, and related events and activities (the “Activities”), I, the undersigned, acknowledge, appreciate, and agree that:

Disclaimer and Assumption of Risk. Jacob Rieger & Company, LLC and any affiliates, their officers, officials, agents, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of the premises (collectively referred to in this release as the “Releasees”) are hosting the Activities and the risk of injury from the Activities, including potential animals that may be on the premise, is significant, including the potential for permanent paralysis and death. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume responsibility for my participation in the Activities.

Consumption of Alcohol. The Activities may involve the consumption of alcohol. I represent and warrant to the Releasees that my date of birth on my government issued identification is accurate.  I further understand that if I am under the age of 21, then I will not be permitted, under any circumstance, to take part in any activities that involve the consumption of alcohol. I fully understand that there may be consumption of alcohol before, during and/or after the Activities either by me or other participants. I understand and acknowledge the potential risks and dangers associated with the consumption of alcohol. I understand that the Releasees do not require me to consume alcohol to participate in the Activities. I take full responsibility for any liability associated with my intoxication, during or after the Activities. I acknowledge that the Releasees assume no liability for injuries that may occur to me or others, and no liability for any civil or criminal violation or damages that may be assessed against me as a result of my being intoxicated before, during or after the Activities.

Terms and Conditions for Participation. I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

Consent to Publicity License. By participating in or attending any activity in connection with the Activities, whether on or off the premises, I consent to the use of photographs, pictures, film or videotape taken of me or provided by me for publicity, promotion, television, websites or any other use, and expressly waive any right of privacy, compensation, copyright or other ownership right connected to the same.

Waiver of Claims and Release of Liability. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby waive, release, indemnify, and hold harmless the Releasees, from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, or death I may suffer, or loss or damage to person or property, whether arising from the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

Acknowledgement. I understand that the permission to participate on the Activities is being given to me in exchange for the execution of this Release of Liability and Assumption of Risk Agreement. I understand this is a release of liability, which will legally prevent me or any other person from filing suit or making any other claims for damages in the event of personal injury, death, or property damages.

I have read this Release of Liability and Assumption of Risk Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and sign it freely and voluntarily without any inducement.
