ALPINEER CLUB RELEASE OF LIABILITY AND INDEMNITY AGREEMENT (Rev. June 2017)

By signing this Release of Liability and Indemnity Agreement, I acknowledge that I or my child, or the minor in my legal custody (collectively herein, “I”, “my”, or “me”), have chosen to be physically present in the Alpineer Lodge or its surrounding property and / or participate in activities of the Alpineer Club ("Club"), and/or use any Club equipment or property for any purpose, including, but not limited to, use of the Lodge or participation in any Lodge activities or affiliated activities of the Club.

I UNDERSTAND THAT MY PRESENCE IN THE ALPINEER CLUB LODGE OR SURROUNDING PROPERTY AND / OR USE OF ALPINEER CLUB EQUIPMENT POSES RISKS AND HAZARDS OF INJURY AND DEATH. THE RISKS AND HAZARDS THAT COULD BE OBVIOUS OR NOT OBVIOUS COULD INCLUDE, BUT ARE NOT LIMITED TO:

Travel over wild lands between available parking and the Alpineer Lodge, and presence in the property surrounding the Alpineer Lodge, that could include hazards such as

  •  accumulated snow and ice in the parking area
  • travel through unpatrolled, ungroomed, snow and ice transected by uncontrolled streams and creeks that could be superficially covered in snow
  • travel through areas with overhanging ice and snow accumulated in trees overhead and the potential for falling tree limbs and trees
  • travel through areas potentially populated with wild animals such as bear, coyote, bobcat, poisonous snakes and other animals that may carry diseases or disease carrying pests.
  • risk of injury and death from falling accumulated snow and ice from the Alpineer Club Lodge structure itself.
  • Risk of injury and death from collapsing snow structures, caves, forts, or other structures made of snow and ice on the Alpineer Club Lodge property.

Furthermore, I am aware of other obvious risks and assume all risk for any non-obvious risks of injury and death posed by hazards to health and safety in the building and on the property. Those risks include, but are not limited to:

  • Possible obstruction of Lodge emergency exits by accumulated ice or snow or fallen trees or tree limbs
  • Risks and hazards that, during times of deep snowpack, deep crevices may form between the Lodge structure walls and surrounding snow and may be covered by a superficial layer of snow such that they are hard to detect.
  • Fire safety risks and hazards posed by the common practice of use of the Alpineer Club Lodge fireplace by, and potential negligence of, people staying at the Lodge
  • Potential for obstruction of the roof top utility vent by accumulated snow or ice, or damage to it by falling trees, which serves to vent toxic gases from the Lodge furnace, hot water heater, clothes dryer and other utilities that, if obstructed or damaged, could result in the accumulation of deadly gases in the Lodge.
  • Potential for obstruction of the roof top fireplace chimney by accumulated snow or ice, or damage to it by falling trees, which serves to vent toxic gases from the Lodge fireplace, that, if obstructed or damaged, could result in the accumulation of deadly gases in the Lodge.

I understand and agree that if I bring a minor child to the Alpineer Club Lodge, either my child, a child I am the legal guardian of or a child guest, I am fully responsible for monitoring their presence, use of Club property or equipment, and any activities to ensure their safety. I agree to assume full responsibility for said child, or children’s, safety while in, or around, the Alpineer Club Lodge.

Despite these risks and all other risks, and TO THE FULLEST EXTENT ALLOWED BY LAW, I AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH that might be associated with or arise out of my participation in activities of the Alpineer Club or use of its facilities.

I AGREE TO RELEASE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE The Alpineer Club, its Board of Directors, Executive Committee, Officers, Committee Chairs and Co-chairs, members and guests, the United States of America, Department of Agriculture, United States Forest Service, and all of their successors, heirs, assigns, agents, employees, and equipment manufacturers and suppliers (collectively herein, “The Alpineer Club”) for injury or death resulting from my participation in the activities of the Alpineer Club or use of its facilities, regardless of the cause, including the alleged NEGLIGENCE of The Alpineer Club. I further AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the Alpineer Club for any claims, lawsuits, damages, attorney fees, costs or judgments arising out of my participation or my child’s participation in the activities of the Alpineer Club or use of its facilities.

THIS IS A MULTI-PAGE AGREEMENT, DO NOT SIGN IT UNLESS YOU UNDERSTAND IT AND AGREE WITH ITS TERMS.

I UNDERSTAND THIS IS A RELEASE OF LIABILITY that will apply whenever I participate in the activities or use the facilities at The Alpineer Club. I understand that this RELEASE OF LIABILITY will prevent me, my child, or our heirs from filing suit or making any claim for damages in the event of injury or death from my participation in the activities of or use of the The Alpineer Club Lodge. Additionally, in the event I file, or my child or any legal representative files, a claim or a lawsuit arising out of my participation in the activities of The Alpineer Club or the use of its facilities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS the Alpineer Club for any damages, attorney’s fees, or costs arising out of such a claim or a lawsuit. With a full understanding of this agreement, I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my child, our heirs, assigns and legal representatives.

By executing this agreement, I declare under penalty of perjury that I am doing so only for myself and/or for persons who have authorized me to do so on their behalf. If I execute this document on behalf of another person, I am acting as the agent for that person, and my execution of the document expressly confirms that I have permission to agree to its terms on the other person’s behalf, and that this Release of Liability and Indemnity Agreement is binding on that person. If I execute this document on behalf of another person without the express permission of that other person, I understand and agree that I am committing fraud against The Alpineer Club. If the person on whose behalf I have executed this release brings a claim or lawsuit against The Alpineer Club I agree to defend, indemnify and hold harmless The Alpineer Club as fully set forth herein.

I understand that by signing this agreement, I agree to be bound by the terms of the Indemnification and Release of Liability. I understand and agree that this agreement is severable and if any clause is found to be invalid, the offending clause will be stricken and the balance of the agreement will remain in effect, valid, and enforceable. I agree that any action will be brought in the courts of Placer County, California. Any disputes will be subject to and determined under the laws of the State of California.
