WAIVER OF RESPONSIBILITY

As a non-registered guest of the Wilderness Hotel & Golf Resort, Inc. I, the undersigned, individually and on behalf of any minor child(ren) listed below, acknowledge that in consideration for being permitted to utilize facilities and attractions at the Wilderness Territory , I hereby waive  any and all rights I, or the minor child(ren) listed below, may have in the event of an injury. I, individually and on behalf of the minor child(ren) listed below, further agree to hold harmless the Wilderness Territory and any related entities, and their respective officers, directors, employees and agents (collectively, The Wilderness), for any such injury or accident.  I further agree, individually and on behalf of the below-listed child(ren), to defend and indemnify The Wilderness, for all claims brought against The Wilderness arising out of any accident, or injury (regardless of severity) or death, which arose from my use, or the below listed child(ren)’s use of any facility, attraction, Waterpark, Waterpark attraction, or premises, owned or operated by The Wilderness.

The undersigned has read the foregoing, and understands that he/she is waiving important legal rights, and that injuries can occur and are sometimes serious, and that this document, in exchange for allowing the undersigned and any children listed above to enter and use The Wilderness facilities, is waiving all rights and claims that may arise out of the use or facility, regardless of the cause of such injury.

This Release, Hold Harmless, and Indemnity Agreement is executed on behalf of the undersigned, individually, and on behalf of the child(ren) listed below.
