Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement (“Waiver”)

In consideration of my voluntary participation in the Tampa Bay Buccaneers Gameday Flag Krewe (the “Event”), I, for myself, and for my heirs, family, personal representatives, agents, and assigns (collectively the, “Releasors”), do hereby release, waive, discharge, and agree not-to-sue the National Football League, its member professional football teams, Buccaneers Team LLC, Buccaneers Stadium LLC, Buccaneers Holdings LLC, Buccaneers Limited Partnership, Inc., Tampa Bay Buccaneers Foundation, Inc., Tampa Bay Mall Limited Partnership, Tampa Bay Broadcasting Inc., First Allied Development Partners, First Allied Development Partners Limited Partnership, Tampa Sports Authority, City of Tampa, County of Hillsborough, and each of their respective parents, members, affiliates, subsidiaries, officers, directors, employees, volunteers, partners, owners, sponsors, vendors, providers, and agents (collectively, the “Released Parties”), from any and all present and future claims, liabilities, damages, and expenses (including but not limited to attorneys fees), of any nature whatsoever (collectively, the “Liabilities”) which I, my heirs, executors and assigns may have in connection with my participation in the Event.

I understand that my participation in the Event involves certain risks and I assume all risk and danger arising in connection with my participation in the Event including loss of personal property, personal injury (including but not limited to serious injury or death). I represent that I understand the nature of the Event and that I am qualified, in good health, and in proper physical condition to participate in such Event. I acknowledge that if I believe Event conditions are or become unsafe, I will immediately discontinue my participation in the Event. I further agree to indemnify the Released Parties from any and all Liabilities arising from any of my or my guest’s participation in the Event and covenant not to sue therefore. Such waiver and release shall apply to any Liability caused in whole or in part by the negligence of any Released Parties in connection with my participation in the Event. I ASSUME FULL RESPONSIBILITY OF PROPERTY DAMAGE, BODILY INJURY, OR DEATH ARISING OUT OF OR RELATED TO PARTICIPATING IN THE EVENT WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.  

I consent to administration of first aid and any other medical treatment deemed necessary in the event of any injury or illness that I might suffer while participating in the Event. I recognize that the Released Parties or its designees have the right, but not the obligation, to offer any medical treatment while at the Event.

I hereby expressly grant the Released Parties (and grant the Released Parties the right to grant to others), in perpetuity, the irrevocable right, with or without my knowledge, to film, tape, photograph, record, exhibit, edit, alter, copy, reproduce, license, sell, rent, disclose, display, publish, distribute, broadcast, webcast, stream, prepare derivative works from or otherwise preserve, use and/or exploit in any format and/or manner now known or hereafter developed, whether commercial or non-commercial in nature (collectively, the “Use and Materials”): (1) my participation in the Event; and (2) my name, likeness, signature, voice, conversation, sounds, biographical data and/or any other information or material secured in connection with my participation in the Event. I agree that the Released Parties and its designees shall have the right to the Use and Materials throughout the universe in connection with the Released Parties. I acknowledge and agree that I shall not be entitled to receive any compensation whatsoever in connection with the exercise of the Use and Materials.


This Waiver shall also apply to any other activity or event that I participate in that is conducted or sponsored by any of the Released Parties within one (1) year from the date on which I sign this Waiver below, whether or not such future activities are similar or identical to the Event listed above. I understand that the Released Parties may not require me to execute a new Waiver for any such future activities or events that I might participate in within one (1) year from the date on which I sign this Waiver, and that this Waiver will apply with full force and effect to my participation in any future activities and events conducted or sponsored by any of the Released Parties within one (1) year after this Waiver is signed by me.

I understand that this Waiver is intended to be as broad and as inclusive as permitted by Florida law, and agree that if any portion of this Waiver is deemed or determined to be invalid for any reason, the remainder of this Waiver will continue in full legal force and effect. I further agree that this Waiver is governed by and enforceable in accordance with the laws of Florida without giving effects to the principles of the conflicts of law for that state, and that the parties submit to the exclusive jurisdiction to the courts in Tampa, Florida for any legal proceedings related to this Waiver.

I HAVE READ THIS WAIVER, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
