Cherry Valley Investments, Inc. / encompasses Gigueres, Discovery School House, and Gigueres Dance. For this waiver, the use of the word Gigueres will represent all businesses under Cherry Valley Investments, Inc.
ANNUAL REGISTRATION FEE: All participants are required to pay an annual registration fee at the time of sign up. This fee is good for one year from first day of enrollment and is never refundable. The annual registration fee is $40 for the first participant in an immediate family, $30 for the 2nd participant in an immediate family, and any further immediate family members participating in programs at Gigueres are free.
ENROLLMENT/UNENROLLMENT: Enrollment in a Gigueres program is continuous. This means that each child is enrolled from their start date through the end of our school year session in June unless a written unenrollment form is completed by the 15th of the month to unenroll for the following month. Failure to unenroll by the 15th will result in being responsible for next month's tuition cost. Gymnastics and trampoline team programs are continuous throughout an entire calendar year. Written notice must be given to both the office and the team coaches by the end of the current month in order to not be responsible for payment for the following month's tuition.
MONTHLY TUITION: Gigueres classes and team programs run on a monthly tuition schedule. Your tuition for classes is not based on the number of classes per month, but over a period of time. The payments were figured out based on a 40 week program (September through mid June) for gymnastics classes, kung fu classes, dance classes, dance team, and trampoline classes. Gymnastics and trampoline team prices were figured out based on a 50 week program. In any given month there may be 3, 4, or 5 classes depending on where the days of the week land that month, holidays, and scheduled gym closings. All families are required to keep a working credit card on file. The credit card on file will be charged automatically for all current and past due charges on the 1st of every month. If you would like to use a different type of payment you may do so prior to the 1st of the month.
REFUNDS: If during the first two classes a 1st time participant in our programs chooses to unenroll, a full refund of the tuition will be issued. The registration fee will not be refunded.
CREDIT CARDS: If Gigueres is not able to successfully charge the credit card on file by the 5th of the month, a $40 late fee will be assessed to the account. Further failed attempts to charge a credit card on file that month will result in removal from the program for the following month.
MAKE UP POLICY:
-Make up classes must be scheduled through the office. Failure to show up for a make up class or notify the office of missing the make up without a 24 hour notice will result in losing the make up class with no rescheduling options.
-A maximum of 1 make up class may be done per month and must by made up within 2 weeks of the missed class.
-You must be currently enrolled to make up any missed class.
-Make up classes can not be tranferred to another child in the family currently enrolled in class.
-There are no refunds or credits for missed classes.
-There are NO make up times for any missed workouts for our team programs.
During the Covid-19 pandamic there will be no make ups.
WHAT TO WEAR
Boys or Girls may wear tucked in t-shirts and shorts, OR leotards for Girls. NO chewing gym or dangling jewelry. Hair should be pulled neatly and securely away from the face so that it stays up for the entire class/workout. Girls should not wear bows or other large hair ornaments that may cause discomfort during activity. All students should have activity-appropriate footwear during class. Personal items should be left in their backpack during class. Jewelry should not be worn during classes, and should be left at home. The staff are not responsible for ANY items that may be lost or stolen. Be sure your student's personal items are marked with their name. Due to COVID-19 a face mask is required for those who can not physically distance themselves from one another.
ARRIVAL AND PICKUP
Be sure your student arrives 5 minutes before (no earlier please) his/her scheduled class/workout time. Please pick up your student on time, right after class. We ask that you inform us by calling the office if you know you will be late picking up your child. Instruct your child to wait inside the building and a staff member will escort them from the building to your car. During peak times the parking lot is crowded. Please take into consideration that our students may include young children. We ask that you drive slowly and carefully through our parking lot and pulling up to our driveway. Do not take a chance on having your child run to and from your car.

COVID-19 RUFUND POLICY
Gigueres is very fortunate to have great relationships with all of our staff and vendors. During the time of the shutdown many vendors have worked with us to lower, delay or in some cases forgive some payments. We would not be able to re-open if it wasn’t for the generosity of these other businesses. Gigueres is still here, thank goodness, but we will not be able to absorb many more such hits. We cannot close our doors with zero revenue coming in and survive. As we re-open, many bills and staff paychecks will start again. During the first couple of steps of opening, we will incur extra expenses and only be allowed to open at partial capacity.
Therefore, the following Coronavirus Pandemic Team and Recreational Tuition Policy will be in effect as we move forward.
Should Giguere Gymnastics be forced to close either by a government entity or by a reasonable decision by the owner made to protect the safety and well being of our students, their families and staff, the following policies will be in effect:
Coronavirus Pandemic Team Tuition Policy:
No refunds or credits on tuition will be provided for the remainder of any month during which the gym is forced to close. Online workouts will be held in place of the closed weeks.
Should a continuous shutdown extend into another month the gym will process tuition with a 50% reduction. Online team workouts will continue. Should the shut-down end during the second or future months, practice will commence with no additional tuition for those months.
There will be no make-ups or credits offered for missed or cancelled practices.
COVID-19 Pandemic Recreation Tuition Policy:
Any payment not used for classes because of a Covid-19 shutdown will be labeled as a credit and can be used for any future program or purchase at Gigueres. Refunds will be processed upon request if absolutely necessary.
I want to do my part to help Giguere’s keep my child(ren), his/her teammates, the coaches, other families and everyone else at the gym as safe as possible under the Covid-19 pandemic. I have read, understood and agree to follow the following policies and procedures
A monthly health and safety fee will be placed on account for the time being of $20. One fee per family.
I understand and agree that:
I will drop off pick-up/drop-off only at the designated gym door.
Both me and my child(ren) will have a cell phone to communicate with each other when I arrive to pick him/her up. If cell phone texting is not available, a coach will accompany remaining gymnasts out to meet their parents with 6’ distancing.
Only one parent or non-participating individual will be allowed to enter the building at the main entrance if necessary.
I am required to wear a mask when entering Gigueres, per state order.
I am aware that my child may be required to wear a mask where physical distancing is not possible, but not while exercising.
I am aware that Gigueres is trying to minimize the amount of people within the building, therefore I will be able to watch my child’s practice/class through streaming it on video.
I will support the social distancing standard of 6’ to 10’ while at the gym .
Practice start and end times will be staggered to insure time for the children to get in and out of the gym safely, to provide time to wipe down the equipment between each practice and for teachers to thoroughly wash their hands.
My child (ren) will have regular opportunities to use the hand sanitizing stations available in all areas of the facility.
Upon entering the building, I agree that my child may be required to use hand sanitizer or wash their hands.
I am aware that I may be asked screening questions upon my child’s arrival and my child’s temperature may be taken.
I am aware that no outside shoes are allowed in the training areas of the building.
My child (ren) will bring his/her clearly marked bag to the gym each day with all recommended items included.
I will have my child (ren) wash hands and feet thoroughly upon arriving back home and her bag will be cleaned upon arriving home and again before she brings it back into the gym.
I agree to keep my child (ren) home if she/he or anyone in my family is coughing, has a temperature over 100, or other Covid-19 symptoms.
I understand and agree that these procedures will change and evolve over time and that I will follow any new standards required by the local Board of Health, the Commonwealth of Massachusetts and/or Gigueres. I understand that the coaches and everyone at the gym will make a strong effort to maintain social distancing but that there will be times when incidental contact and less than prescribed physical distancing will occur. I am aware and agree that spotting is an essential part of training my child (ren) in order to keep him/her safe and to prevent injury. Additionally, many of the athletes are at the level of training where spotting for instructional purposes is advantageous. I will allow my child to be spotted when spotting is necessary, knowing that coaches will be wearing masks at all times and sanitizing their hands before and after each child. I further understand that I am voluntarily allowing my child to participate in programs and activities offered by Gigueres, knowing that it is impossible to keep him/her, myself or anyone else who enters the gym completely safe from exposure to any infectious disease. My signature is my understanding of, and acceptance of the risks.
Cherry Valley Investments, Inc. dba Gigueres Acknowledgment and Assumption of Risk:
I request for any of my children to participate in gymnastics, day care or nursery school, dance, trampolining, kung fu or any other activity at Gigueres and to receive instruction in such subjects from Gigueres' staff and associates. I understand that such participation and instruction require the performance of physical exercises by my child which necessarily involves the risk of personal injury, including severe paralysis or even death to my child. Neither my child nor myself are under compulsion by Gigueres, its officers, teachers, employees and associates to participate in this program nor am I being paid to do so. My child's interest is solely in the activities at Gigueres and his/her self-improvement and I willingly accept the risk inherent in this pursuit. In consideration for allowing my child to use these facilities, I hereby forever release Gigueres, its officers, employees, teachers and associates from all liability for any and all damages and injuries suffered by my child in connection with said use of these facilities. This acknowledgment of risk and waiver, having been read thoroughly and understood completely is signed voluntarily as to its content and intent.
I represent and warrant that if I am purchasing something or paying for a service from this facility or from other merchants through this facility that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
I hereby authorize (if online payment is made or autopay information is provided) this facility to charge my ACH draft, or credit card account. I understand that a 15 day written notice is required to terminate billing and I am responsible for payment whether or not my student attends classes until I notify this facility in writing to drop my student from class(es).
Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
