Revolutionary Earth (RE) values its users' privacy. This Privacy Policy ("Policy") will help you understand how we collect and use personal information from those who visit our website or make use of our online services, and what we will and will not do with the information we collect. Our Policy has been designed to ensure those affiliated with Revolutionary Earth of our commitment and the realization of our obligation not only to meet, but to exceed, most existing privacy

We reserve the right to make changes to this Policy at any given time. If at any point in time Revolutionary Earth decides to make use of any personally identifiable information on file in a manner vastly different from that which was stated when this information was initially collected,
the user or users shall be promptly notified by email. Users at that time shall have the option to permit the use of their information in this separate manner.

Please note that this Policy does not govern the collection and use of information by companies that Revolutionary Earth does not control nor by individuals not employed or managed by us. Information We Collect
It is always up to you whether to disclose personal information to us, although if you elect not to do so, we may be unable to contact you for opportunities you volunteer for or provide you with any products or services available through our site. This website collects various types of information, which may include your name, address, email address, phone number, billing and/or credit card information, the latter of which may be used when you make donations, purchase products and/or services and to deliver the services you have requested.

This site will only collect personal information that you knowingly and willingly provide to us by way of surveys, completed forms, and emails. It is the intent of this site to use personal information only for the purpose for which it was requested, and any additional uses specifically provided for on this Policy.

Why We Collect Information and For How Long
We are collecting your data for the following reasons:
• To better understand your needs and provide you with the services you have requested;
• To fulfill our legitimate interest in improving our ability to provide volunteer opportunities;
• To send you an email newsletter containing information we think you may like when we have your
consent to do so.

The data we collect from you will be stored for no longer than necessary. The length of time we retain said
information will be determined based upon the following criteria:
• the length of time your personal information remains relevant;
• the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations;

• any retention periods prescribed by law or recommended by regulators, professional bodies or associations;
• the type of contract we have with you, the existence of your consent, and our legitimate interest in keeping such information as stated in this Policy.

Use of Information Collected
Revolutionary Earth does not now, nor will it in the future, sell, rent or lease any of its customer lists and/or names to any third parties. Revolutionary Earth may collect and may make use of personal information to assist in the operation of our website and to ensure delivery of the services you request, including being connected to volunteer opportunities and subscriber services. Revolutionary Earth may also be in contact with you with regard to completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered. Revolutionary Earth uses various third-party social media features including but not limited to Facebook and other interactive programs. These may collect your IP address and require cookies to work properly. These services are governed by the privacy policies of the providers and are not within Revolutionary Earth's control.

Disclosure of Information
Revolutionary Earth may not use or disclose the information provided by you except under the following circumstances:
• as necessary to provide services or products you have ordered;
• in other ways described in this Policy or to which you have otherwise consented;
• in the aggregate with other information in such a way so that your identity cannot reasonably be determined;
• as required by law, or in response to a subpoena or search warrant;
• to outside auditors who have agreed to keep the information confidential;
• as necessary to maintain, safeguard and preserve all the rights and property of Revolutionary Earth.

Non-Marketing Purposes
Revolutionary Earth reserves the right to contact you if needed for non-marketing purposes (such as bug alerts, security breaches, account issues, and/or changes in Revolutionary Earth products and services). In certain circumstances, we may use our website, newspapers, or other public means to post a notice.

Children under the age of 13 (COPPA Compliance Disclosure)
Revolutionary Earth's website is not directed to and does not knowingly collect personal information directly from children under the age of thirteen (13). If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13) without verifiable parental consent, we shall immediately take the necessary steps to ensure that such information is deleted from our system's database, or in the alternative, that verifiable parental consent is subsequently obtained for the use and storage of such information. Revolutionary Earth uses a third-party website to collect the names and email addresses of children under the age of thirteen (13) with verifiable parental consent as part of a waiver and release of liability for volunteer work with our organization. Our privacy policy is prominently displayed on all waivers we collect through that third-party site. Any parent who
provides verifiable consent through a waiver to disclose personal information of children under thirteen (13) is entitled to direct Revolutionary Earth to delete such information and to refuse to allow any further collection or use of the child's information.

Unsubscribe or Opt-Out
All users and visitors to our website have the option to discontinue receiving communications from us by way of email or newsletters. To discontinue or unsubscribe from our website please send an email that you wish to unsubscribe to or opt-out from the third-party website through which we send our newsletter. Revolutionary Earth will continue to adhere to this Policy with respect to any personal information previously collected.

Our website does contain links to affiliate and other websites. Revolutionary Earth does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our website and to read the privacy statements of every website that collects personal information. This Privacy Policy Agreement applies only and solely to the information collected by our website.

Revolutionary Earth's operations are located primarily in the United States. If you provide information to us, the information will be transferred out of the European Union (EU) and sent to the United States. (The adequacy decision on the EU-US Privacy became operational on August 1, 2016. This framework protects the fundamental rights of anyone in the EU whose personal data is transferred to the United States for commercial purposes. It allows the free transfer of data to companies that are certified in the US under the

Revolutionary Earth takes precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (e.g. credit card information), that information is encrypted and transmitted to us in a secure way. You can verify this by looking for a lock icon in the address bar and looking for "https" at the
beginning of the address of the webpage. While we use encryption to protect sensitive information transmitted online, we also protect your
information offline. Only employees and/or volunteers who need the information to perform a specific job (for example, volunteer coordination or subscriber services) are granted access to personal information. The computers and servers in which we store personal information are kept in a secure environment. This is all done to
prevent any loss, misuse, unauthorized access, disclosure or modification of the user's personal information under our control.
The company also uses Secure Socket Layer (SSL) for authentication and private communications to build users' trust and confidence in the internet and website use by providing simple and secure access and
communication of credit card and personal information.

PLEASE NOTE: This waiver is a comprehensive waiver that encompasses all of the activities that a volunteer may engage in through Revolutionary Earth Farm. Your signature on this waiver is equivalent to signing the Seasonal Waiver and makes you eligible to participate in any and all activities related to work at any of our physical locations. Signature of the Seasonal Waiver is therefore unnecessary if you sign this waiver.

Thank you for agreeing to work as a driver volunteer for Revolutionary Earth Farm (“RE Farm”). This is an annual form in which you agree to release RE Farm from liability and is effective for the calendar year 2020. 

The Volunteer desires to work as a volunteer for RE Farm and engage in the activities related to being a volunteer (the “Activities”). The Volunteer understands that the Activities may include, but are not limited to: land preparation, tilling of soil, composting, seeding, weeding, harvesting, washing of produce, construction, educational events and workshops, fundraising, or administrative work, and delivery of produce boxes and other items on behalf of Revolutionary Earth.

This Release and Waiver of Liability (“The Release”) is executed on September 28, 2020, by (“The Volunteer”) in favor of Revolutionary Earth, a non-profit habitat restoration and urban farming organization, including all directors, officers, employees, homeowners, and agents (collectively, “RE Farm”). 

The Volunteer hereby freely, voluntarily, and without duress executes this Release under the following terms: 

1. RELEASE AND WAIVER: The Volunteer releases and holds harmless RE Farm from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise from volunteer work for the duration of the time that the volunteer commits to working actively with RE Farm. The Volunteer understands that the Release discharges RE Farm from any liability or claim that the Volunteer may have against RE Farm with respect to bodily injury, illness, death, or property damage that may result from his/her participation on any of the land used by RE Farm. The Volunteer also fully understands that RE Farm does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage. The Volunteer expressly waives any such claim for compensation or liability on the part of RE Farm. 

The Volunteer waives, releases and discharges RE Farm, its trustees, officers and employees from any claims, demands, costs, causes of action, or damage as a result of property loss or damage, or personal injuries sustained to himself/herself and to passengers of a vehicle that the Volunteer operates during participation in the distribution of produce and other RE Farm activities. Furthermore, the Volunteer intends this waiver and release to be legally binding on his/her heirs, executors, administrators, estate and assigns.

The Volunteer states that he or she is an adult over the age of eighteen (18) years, that he or she is mentally competent to make this release, and that he or she is driving a vehicle with the owner’s permission to deliver for RE Farm under his/her own volition. The Volunteer further states that he or she has at least a Class C driver license that is valid in the State of Minnesota, and that he or she is insured for liability in compliance with Minnesota State Law to drive the vehicle. The Volunteer agrees to notify RE Farm in writing if there is a change in the status of his/her driver's license or vehicle liability insurance.

2. MEDICAL TREATMENT: The Volunteer hereby releases RE Farm from any claim whatsoever which arises or may arise in the future on account of any first aid treatment or other medical services that are conducted in connection with an emergency during his/her time with RE Farm.

3. ASSUMPTION OF RISK: The Volunteer understands that his/her time with RE Farm may include various activities that may be hazardous to him/her, including but not limited to strenuous manual labor, working with hand tools and other gardening equipment, lifting heavy objects, exposure to the elements, and injury from insects and/or animals. The Volunteer also assumes all of the risks associated with driving a motor vehicle. The Volunteer expressly and specifically assumes the risk of injury or harm in these activities and releases RE Farm from all liability for injury, illness, death, or property damage resulting from the activities of his/her time with RE Farm. 

4. RIGHT TO DECLINE WORK: The Volunteer understands and acknowledges that he/she may decline any volunteer role or position at any time if he/she feels such role or position presents a risk to health or safety or for any other reason. The Volunteer agrees to advise RE Farm of any preexisting conditions that would preclude involvement in any activity, including the activity of delivering produce using a motor vehicle, motorized bicycle or scooter, or bicycle.

5. INSURANCE: The Volunteer understands that RE Farm carries general liability insurance and limited medical insurance up to $5,000 to cover injuries to volunteers in association with work performed for RE Farm. However, RE Farm does not carry disability or Workers Compensation insurance coverage for any volunteer. 

6. PRIVACY AND CONFIDENTIALITY: The activities associated with the physical locations at which Revolutionary Earth maintains licensing agreements with property owners to do work are private property. The personal information, including the name, address, phone number, and email address, of any homeowner or business owner who enters into a licensing agreement with Revolutionary Earth ("Steward") is provided to the Volunteer solely for the purpose of and in connection with the current relationship to provide work on behalf of Revolutionary Earth. The activities associated with delivery of material goods to a subscriber ("The Subscriber") of RE Farm's services include disclosure of the personal information of subscribers to delivery drivers. The personal information of the Subcriber may include name, home address, phone number, email address, or location of the Subscriber's place of employment. Any personal information shared to the Volunteer may only be shared with another Volunteer who has also signed a liability waiver with RE Farm or with any of RE Farm's directors, officers, employees, homeowners, and agents under the same conditions, to wit, solely for the purpose of enabling the Volunteer to perform any of the work outlined in this Agreement. The Volunteer agrees to keep the personal information of any and all Stewards and Subscribers of RE Farm confidential by way of exercising a reasonable degree of care and agrees not to disclose any of this personal information to any third parties unless otherwise provided for in this Agreement. The Volunteer also agrees not to keep a record of the personal information of the Stewards and Subscribers of RE Farm unless engaged in any of the activities described in this Agreement. The Volunteer agrees to dispose of the record of the Steward's and the Subscriber's personal information upon the expiration of the terms of this waiver, and notwithstanding the foregoing, the Volunteer's duties to keep any personal information dislosed during the term of this Agreement confidential shall remain in effect indefinitely.

7. VALIDITY OF RELEASE: The Volunteer expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Minnesota in the United States of America, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Minnesota. The Volunteer agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
