Agreement: By placing this reservation with The Lodges at Cordillera Ranch, LLC (“The Lodges”) the undersigned, on behalf of the entire booking party (“the Guests”), agrees to the following terms and conditions. In this agreement, the Lodges, the Clubs of Cordillera Ranch, Ltd. (“the Clubs”), Cordillera Ranch, Ltd., CR/KWW Partnership, Ltd. and their affiliates may collectively be referred to as “Cordillera Ranch.” The term Property herein shall include both property of the Lodges and Cordillera Ranch and is made subject to the terms and conditions of this agreement. Authorized Use: The Clubs hereby grants to the Guests a temporary revocable license to use the Property for the agreed upon dates. The Guests will use the Property for lawful purposes only and will comply with any and all applicable Cordillera Ranch bylaws, rules and regulations, including but not limited to the Clubs Membership Plan and Rules and Regulations and applicable Cordillera Ranch covenants. The Guests will not permit the use of outside catering events at the Property. The Guests will not damage or destroy the Property (or permit another to damage or destroy the Property) or create a nuisance on or about the Property. The Guests will not permit the Property to be occupied or used by any persons other than you or your Lodge Guests unless they are a minor child of yours or have completed the agreement on their own behalf. Check-In & Check-Out: Check-In time is 4:00 pm & Check-Out time is 11:00 am. Subject to approval by the Lodging Concierge, early check-in or check-out may be arranged. Check-out is by no later than 11:00am the day of departure. The Clubs will send a statement of charges by email to the members account or if a non-member it will be charged to credit card. Cancellation Policy: If you need to cancel or reschedule your stay at least 48 hours in advance of planned arrival, please contact your Lodging Concierge. Any room cancellations made within 48 hours of the day of check-in will be responsible for the entire stay. The Lodges will not provide a refund because of shortened stays due to work or family emergencies or other commitments. When booking all 10 rooms in the Elmax & Georg, any room cancellations made within 30 days of the day of check-in will be responsible for the entire stay (except during peak season and holiday dates, for which the reservation would become non-refundable 60-days prior to your stay). When booking the entire Georg House or entire Elmax, any room cancellations made within 14 days prior to your stay of the day of check-in will be responsible for the entire stay (except during peak season and holiday dates, for which the reservation would become non-refundable 60-days prior to your stay). For reservations during peak season and holiday dates (as defined by The Lodges), at the initial booking, 50% deposit (“Deposit”) of the total estimated billing for the reserved room nights will be non-refundable. Lodge Pass: Lodge Pass offers preferred rates based on a prepayment of 12 weekday stays. Must be used in 12 months from purchase. All purchases are non-refundable.
Lodge Pass Plus:Lodge Pass PLUS offers preferred rates based on a prepayment of 20 weekday stays. Must be used in 12 months from purchase. Remaining balance will be charged to account. Member and Non-Member Charges: You and your Guests’ charges will be applied to the members club account or to a credit card in the case of a non-member. Non-member charges require a VISA, MasterCard, Discover or American Express credit card as security that you will fulfill your obligations. If you fail to perform any of your obligation under this Agreement or otherwise breaches the terms of this Agreement, you authorize the Lodges to charge your credit card for any necessary charges or damages. If the charges or damages exceed your credit limit, you will pay the difference immediately upon the Lodges demand. Inspection: You will, on arrival, examine the Room(s) and will immediately report any damage discovered and any equipment not in operating condition. Reporting damages does not give you the right to cancel his or her reservation or receive a refund of any payments made. If you fail to report any Property damage, you will be responsible for any Property damaged discovered after your occupancy. The Lodges reserves the right to enter the Room(s) for inspection to ensure the safety and enjoyment of all guests of the Lodges and the Clubs. Your General Duties: You will maintain the Room(s) and Property in a good and clean condition and will use the Property in a careful and lawful manner. You will pay for any damage to the Property, including, without limitation, any necessary or appropriate maintenance and/or repairs. You are responsible for utilizing door locks and other tools provided for securing the Property. You will be responsible for any losses incurred due to your failure to properly secure the Property. Upon termination of your license, you will have the following obligations in addition to any other applicable obligations under this Agreement: (a) You will leave the Property in a good and clean condition and in the same condition as received by you upon your arrival; (b) you will place waste and trash (and any waste and trash of your guests) in the appropriate trash container(s); (c) you will return all keys and opening devices to the Property; and (d) you will vacate the Property and surrender it to the Lodges empty of all persons and you and your guests’ personal property. Internet Access: Complimentary Internet access is available to all guests in their Room(s). Parking Restrictions: The Lodges and Cordillera Ranch prohibit parking recreational vehicles, trailers, and/or boats at the Property. Operation of Equipment: You will use and/or operate all furniture, furnishings, appliances, equipment and all mechanical, electrical, gas, and plumbing fixtures and equipment located on or at the Property (collectively, Equipment) safely and for their intended use. If you do not know how to properly use and/or operate any Equipment, you will contact your Lodging Concierge for instructions concerning such Equipment’s use and/or operation. Any damage caused to Equipment through you or your guests’ misuse will be your responsibility. If you find any Equipment that is not working properly, you will contact the Lodges immediately at 830.336.9000. Noise and Disturbances: We understand some of our guests enjoy socializing and having fun during the evening hours, but we must provide a safe, quiet environment for other guests who are trying to rest. We enforce our quiet time policies in all guest rooms and grounds after 10:00 PM. You will not disturb, annoy, endanger, and/or interfere with surrounding guests and property owners. If excessive noise or disturbances occur resulting in notification by other guests, lodging concierge, sheriff or neighbors, Cordillera Ranch shall have the right to require you to vacate the Property and, in such event, you will forfeit the reservation and any monies paid. Pets: Pets are not permitted in, at, or around the Lodges. If a pet is brought in, at, or around the Room (s), you will be in breach of this Agreement and the Lodges may require you to immediately leave the Property without a refund. You are responsible for any and all injuries and/or damages to person or property caused by any pet brought in, at, or around the Property. If an unauthorized pet is found to have been on the premises or in your room, an additional $350 pet cleaning fee will be charged. I Agree
No Smoking: Smoking is not allowed in the Rooms(s) but is permitted outside the Lodges (as long as the smoke isn’t allowed to come into the Room(s)). If you are found smoking in the Room(s) or allowing smoke in the Room(s) at any time, the Lodges shall have the right to require you and your guests to vacate the Property and, in such event, you will forfeit the reservation and any monies paid. The Room(s) will be subject to a $350 additional cleaning fee per room in addition to any other actual damages and charges incurred. Weather & Property Conditions: The Lodges will not provide any refunds due to the occurrence of any of the following events: (a) inclement weather; (b) malfunction of Equipment and/or any Property amenities (e.g., TVs, DVDs, kitchen appliances, electrical equipment, and/or plumbing; and/or (c) failure of public utilities. Notwithstanding the foregoing, the Lodges will make a reasonable effort to ensure repairs are made and that all equipment is kept in good working order and condition. The Lodges does not warranty amenities. Property Alterations: You will not make any alterations in or to the Property, including, without limitation, moving furniture or electronics (TVs, stereos etc.). Golf Carts: In conjunction with your stay at the Lodges you may receive complimentary use of a golf cart from the Clubs. This golf cart is only for your use on the Clubs and Lodges premises during your stay at the Lodges. It is not authorized to be driven on any streets at any time. Additionally, during nighttime hours, the golf cart is not allowed anywhere other than the Clubhouse parking and drive areas as well as the Lodges. Only you or your Guests, at least 16 years old with a driver’s license, may use the golf cart. At night during your stay, please park your cart in the covered area near your Room, plug it into the charger and take your key with you into your room. Damages: You are responsible for all Property damages, whether caused by you or any of your guests. Costs and expenses incurred to repair or replace damaged Property will be billed to your membership account or credit card on file with the Clubs or Lodges. After completion of any necessary repairs or replacements, the Lodges will send you a letter describing the charges in reasonable detail. Release of Liability & Indemnification: By electing to take advantage of the amenities provided by this Agreement, including but not limited to utilizing the facilities of the Lodges and Cordillera Ranch, collectively, and entering into and utilizing any living accommodations in connection with this booking, and as consideration for being permitted to utilize such amenities, you hereby agree, on behalf of yourself and any other person entitled to file any claim or bring suit on their behalf, to release The Lodges at Cordillera Ranch, LLC, The Clubs of Cordillera Ranch, Ltd., Cordillera Ranch, Ltd., CR/KWW Partnership, Ltd. and their respective owners, affiliates or subsidiary entities, and all their respective officers, directors, agents, contractors, employees, heirs, and successors (collectively, the “Released Parties”) from any and all liability to you and your estate, heirs, next of kin, successors and assigns, for any and all claims and causes of action for loss of or damage to my property or for personal injury to myself, up to and including death. This Release of Liability and Indemnification shall not apply in cases where the Released Parties acted with intentional negligence or gross misconduct. I acknowledge that some of the activities at facilities in Cordillera Ranch involve dangers and risks of injury or, potentially, death and I understand and accept those risks for myself and my Guests. I further agree to indemnify and hold harmless the Released Parties from liability for any loss or damage to any other person that may result from my acts or omissions while participating in the amenities provided by this booking. Entire Contract: All prior agreements between The Clubs at Cordillera Ranch, Ltd. or The Lodges and you are incorporated into this Agreement, which constitutes the entire contract between all parties. Each provision contained in this agreement will be treated as a separate and independent provision. The enforceability of any one provision will in no way impair the enforceability of any other provision. This Agreement shall be governed in accordance with the laws of the State of Texas. I have read and understand the provisions of this Terms of Use and Conditions and hereby agree to it. |
