This agreement is between Flora-Bama Old S.A.L.T.S. Inc. (Hereinafter “The Marina”) and ______________________ (Hereinafter “Renter”). In consideration for the watercraft rental contemplated in this agreement, the Renter agrees as follows: 1. Eligibility & Legal Responsibility - I confirm that I am at least 19 years of age and hold a valid driver’s license.
- If I am renting on behalf of a minor for whom I am legally responsible, I confirm that the minor is at least 16 years old and holds a valid driver’s license if operating the watercraft.
- I understand that by signing on their behalf, I accept full responsibility for the rental and for the safe and lawful operation of the watercraft during the entire rental period.
2. Watercraft Use & Operation
- I agree to operate the watercraft only within the designated inland waterways of Alabama and Florida as defined below and as shown on the map provided.
- UNDER NO CIRCUMSTANCES WILL I ALLOW THE WATERCRAFT TO ENTER THE GULF OF MEXICO (America).
- Approved Operational Boundaries:
- North of Perdido Pass Bridge
- South of Lillian Bridge
- East of the Foley Beach Express Bridge
- West of Perdido Key Bridge (Theo Barrs)
- East of Perdido Key Bridge up to Fort McCree in Big Lagoon (8-hour regular pontoon rentals only)
I acknowledge that the Marina monitors vessel location via GPS. If the watercraft travels beyond the approved boundaries — including into the Gulf of Mexico (America) past Fort Morgan or Fort Pickens, or south of the Alabama Point or Highway 30 (East Pass) bridges — I agree to pay a surcharge of up to $500, which will be immediately charged to my payment method on file. 3. Safety & Conduct
- I will not operate or permit anyone to operate the watercraft in a careless, reckless, or unsafe manner.
- I am currently free from the influence of alcohol and drugs and will remain so while operating or in possession of the watercraft.
- I understand that I am solely responsible for any citations, fines, or legal consequences arising from negligent or impaired operation or violation of local boating laws.
- I have been informed of, understand, and agree to follow the boating rules and regulations applicable to the inland waterways of Alabama and Florida.
4. Passenger Limit - I understand that the Pontoons and Pontoon Boats with Slides (Watercraft) have a maximum passenger capacity of twelve (12) individuals, including children and infants.
- I understand that the Jet Skis (Watercraft) have a maximum passenger count of 3 persons or 350 lbs, including children.
- I will not exceed this limit or allow additional guests to board while on the water. I accept full responsibility for any fines or penalties resulting from exceeding this limit.
5. Return Policy & Condition
- I am responsible for returning the Watercraft and all onboard equipment in the same condition as received.
- The Watercraft must be returned to the location specified by the Marina and on time.
- I understand that a late return will incur a $2.00 per minute late fee, deducted from the damage deposit.
- I understand that early returns due to inclement weather do not qualify for a full refund.
6. Incident Reporting & Responsibility
- I agree to notify the Marina immediately by cellphone in the event of any accident, malfunction, or breakdown.
- Failure to report may result in damage and forfeiture of my damage deposit.
- I understand that if the watercraft runs out of fuel due to my negligence, I will be charged a $100.00 service fee for retrieval.
7. Slide Pontoon Rentals (If Applicable) If I am renting a slide pontoon, I agree to the following additional safety rules:
- No riding on the upper deck while the vessel is moving.
- No diving or jumping from the upper deck.
- A spotter must be present at the bottom of the slide to monitor the landing area and assist in case of emergency.
- The slide (and any off-boat activity) may not be used while the engine is running.
- Only one person may use the slide at a time.
DAMAGE DEPOSIT
A $500.00 damage deposit or valid credit card hold is required for each Watercraft rental. The Marina will inspect the Watercraft upon delivery and return for any damage. The deposit will be applied toward the cost of any repairs or damages to the watercraft. If the total cost of damages exceeds the deposit, the renter agrees to pay the full remaining balance necessary to repair or replace the watercraft to its original condition at the start of the rental. The renter acknowledges and agrees to the following: - Only the renter is permitted to operate the watercraft during the rental period.
- The renter is responsible for the retrieval and/or replacement of the watercraft, life jackets, or any safety equipment that is lost, stolen, or misplaced during the rental.
- In cases where damages exceed the $500.00 deposit, Flora-Bama Old S.A.L.T.S. will provide an itemized repair invoice, which may include charges for lost rental time as follows:
- $250.00 per day for jet skis
- $500.00 per day for pontoon boats
- Lost rental time is a separate charge in addition to all repair or replacement costs.
If a damage deposit or credit card hold is not collected prior to rental and the watercraft is returned with damage, a $500.00 deposit will be collected upon return and held until the damage estimate is completed. If the repair cost is less than $500.00, the difference will be refunded. If the cost exceeds $500.00, the renter is responsible for the remaining balance. RELEASE OF LIABILITY AND INDEMNITY AGREEMENT In consideration of the rental of the above –described vessel, I understand that operating a water vessel can be a potentially hazardous activity. I do hereby fully release, discharge, and hold harmless, Flora-Bama Old S.A.L.T.S., its agents, employees, officers, and directors from any and all claims liability for damages of every type and kind, including personal injury and loss of life for myself, my passengers and the operators or passengers of other watercraft while the vessel is under the contract rental agreement, whether being operated by me or anyone else or merely in my possession or for the time I am responsible for same. Further, the undersigned does agree to indemnify Flora-Bama Old S.A.L.T.S. and its employees, agents, servants and officers, against any and all civil judgments or any other monetary award along with the costs of defending against any such claim or action which may occur as a result of the injury to person or property, equipment, and accessories while the Vessel is under the Rental Agreement. 1. AGREEMENT SCOPE AND ACKNOWLEDGEMENT
This Waiver and Release applies to all renters, operators, passengers, and users of equipment provided by Flora-Bama Old S.A.L.T.S. Inc. (including its officers, employees, agents, representatives, insurers, successors, and assigns). If another rental agreement is used, this Waiver takes precedence in case of conflict. I affirm that I am signing on behalf of myself and any minors in my care. I have listened to the Rules and Regulations regarding equipment operation, had sufficient time to review this Waiver, and asked any necessary questions. I understand this is a required condition for rental and that I could choose another provider. I agree to disclose all potential users of the equipment. If I fail to do so, I accept full liability for any injuries or damages affecting undisclosed individuals. I acknowledge that by signing, I am waiving the right to bring legal action against Flora-Bama Old S.A.L.T.S. Inc. for any claims arising from this rental. 2. RISKS AND ASSUMPTION OF RESPONSIBILITY
I understand that water sports and vessel operation carry inherent risks, including but not limited to: - Changing water conditions, tides, and wakes
- Collisions with other vessels, people, or objects
- Capsizing, sinking, or falling overboard
- Equipment failure or operator error
- Weather hazards (wind, lightning, sun exposure, dehydration)
- Marine life or insect encounters
- My own physical limitations or inexperience
This list is not exhaustive; unforeseen risks may also occur. I voluntarily assume full responsibility for all such risks — including serious injury, illness, or death — and any resulting expenses, regardless of cause. 3. WAIVER/RELEASE OF LIABILITY – By the execution of this Release, the undersigned voluntarily releases, forever discharges and agrees to indemnify and hold harmless Flora-Bama Old S.A.L.T.S. Inc from any and all liability of any nature for any and all injury or damage arising from personal injuries sustained by the undersigned or any minor children under the undersigned’s custody care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Flora-Bama Old S.A.L.T.S. Inc regardless of the cause. The undersigned assumes full responsibility for any such injuries or damages which may occur and further agrees that Flora-Bama Old S.A.L.T.S. Inc shall not be liable for any loss or theft of personal property. The undersigned specifically agrees that Flora-Bama Old S.A.L.T.S. Inc shall not be responsible for such injuries, damages, loss or theft, whether such negligence is present at the signing of this Release or takes place in the future. 4. LIABILITY TO THIRD PARTIES – The undersigned hereby agrees that he/she will indemnify and hold harmless Flora-Bama Old S.A.L.T.S. Inc. for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to, operators and passengers of other watercraft and any passengers riding in the renter’s watercraft or under the renter’s custody, care, and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by Flora-Bama Old S.A.L.T.S. Inc. · I have read and fully understand the contents above and agree to abide with the statements. *

This behavior is considered grossly negligent operation of a boat. I Agree I understand that there is an awareness zone that includes the front (bow), side (gunwales), rear (stern) and swim platform, and extends 30 feet behind and around this boat. I Agree I will educate all of my passengers on the awareness zone, and I will not allow anyone to enter the awareness zone unless the boat motor is turned off, the keys are removed, and I have counted to ten to allow the propeller time to stop spinning. I Agree I will take a head count to make sure all passengers are present and accounted for before starting the motor. I understand that it is particularly dangerous to sit on the front of the platform of this boat, because a slip between the pontoons will “funnel” a passenger into the boat propeller. I Agree I understand that the motor of this boat produces Carbon Monoxide, a colorless, odorless, and lethal gas that can quickly affect people in the awareness zone. I Agree I will not use any generator that is not supplied as part of the rental package on this boat. I Agree I understand that this boat has no brakes so that stopping quickly may be difficult or impossible if I am going too fast. I Agree I will not operate this boat at speeds that are unsafe for the conditions. I Agree I will obey No Wake zones/signs. I Agree I have been instructed on how to use the navigation lights and anchor lights on this boat and I will display them properly if operating at night or when visibility is poor. I Agree I will make sure that there is a lookout other than the boat operator whenever passengers or parts of this boat obstruct the operator’s view. I Agree I have been informed of the total capacity of 12 people and a maximum of 2220lbs for this boat. I will not exceed that limit. I Agree I understand that overloading this boat is unsafe and against the law. I Agree I will anchor where it is easy for other boats to see this boat (so long as the area is anchor able. I Agree I will anchor this boat only form the front (bow). I Agree I will check to make sure that the water is deep enough before allowing head-first diving from the boat. I Agree I will instruct my passengers never to dive or jump off a moving boat. I Agree I will make sure that I, or someone who knows how to operate the boat, remain on board whenever the boat is unanchored. I Agree I have been instructed on what to do in the case of a person overboard, collision, or other dangerous situation. If this boat is equipped with an engine cut off device, I will use it. I Agree I have received an operational orientation for this boat and understand hat a written manual is on board. I Agree I hereby agree with all of the terms above and agree to abide by the rules and terms of this agreement: Today's Date: June 15, 2025
