RENTAL AGREEMENT

 

This is a legal document between the client “The Renter” and “MY KIDZ SOFT PLAY PH”, which affects your legal rights, so please read carefully.

 

The Renter desires to rent from MY KIDZ SOFT PLAY PH equipment to be used by Renter, his/her guests, invites or other persons while in Renters possession. Renter understands that use of this soft play equipment may, by its nature, cause injury or harm to Renter, his/her guests, invites, or other persons.

 

The Renter does hereby freely, voluntarily, and without duress executes this Release under the following terms and conditions:

 

Booking: The Renter agrees to pay a 50% deposit upon booking. This will serve as the reservation fee and confirmation of booking. The remaining balance will be settled on the day of the event.

 

Rebooking: The Renter will notify MY KIDZ SOFT PLAY PH at least 7 days before the event if rebooking is needed. Accepted rebooking date is only within 2 months from the initial event date or upon availability of schedule of MY KIDZ SOFT PLAY PH. Otherwise, booking is considered cancelled.

 

Cancellation: The Renter will notify MY KIDZ SOFT PLAY PH at least 14 days before the event and only half of t he reservation fee will be refunded. Otherwise, deposit or reservation fee will be forfeited.

 

Attendant and Manpower: The Renter agrees that the Attendant provided by MY KIDZ SOFT PLAY is solely for the purpose of setting up and looking after the safety of the equipment. The attendant may give assistance to the kids in the play area but in the event of injuries, accidents and the likes, the Attendant is not liable. The Renter agrees to provide meal/s for the Attendant/s during the event. Additional fees may apply for venues that require additional manpower and logistics.

 

Set-up location: The Renter agrees to set-up indoor or in an adequately roofed area. Otherwise, a tarp is required which will be provided by MY KIDZ SOFT PLAY PH to be charged to the Renter.

 

 

 

 

Equipment condition:  Renter agrees to return the equipment in good condition. If the equipment is returned in an extremely dirty condition at the time of pick up, the Renter will be charged from 1000 php to 5000 php as cleaning fee. The fee must be paid within 2 days after the event.  If there is any damaged or stolen soft play equipment, the Renter will be charged an appropriate amount, i.e. cost or repair or replacement. The fee must be paid within 7 days after the event.

 

Force Majeure: The term “force majeure” in this agreement includes, but is not limited to, a.) natural disasters such as earthquakes, typhoons, etc. b.) social unrest, such as war; c.) physical condition under unforeseen circumstances such as sudden serious illness or accidental serious injury. If either party is unable to perform this agreement before the event due to force majeure, it shall notify the other party as soon as possible and at least provide evidence to testify what happens. Both parties will then agree to reschedule or cancel the booking. However, in the event of force majeure during the event, which means the equipment is already set up, MY KIDZ SOFT PLAY PH is considered free of its obligation, thus the Renter will likewise fulfill its obligation.

 

 

 

Rules and Safety Procedures

 

Renter agrees to the rules and safety procedures listed below.

•             Play at your own risk

•             Socks must be worn at all times

•             No shoes, sneakers, flip flops or sandals

•             No face paint, glitters, colored pens and other art materials allowed in the play area

•             No food, candy, gum, or beverages in the soft play area

•             No pushing, shoving, wrestling or horseplay

•             No uneven size difference of players

•             No more than the recommended amount of players on unit at any one time

•             All sharp objects must be removed before play (including pens, pencils, scissors, jewelry, knives, eyeglasses, bling on pockets, etc.)

•             Do not enter if you are pregnant or have physical problems

•             Keep the soft play equipment inside the play area

 

 

 

 

Waiver and Release of Liability Clause

Waiver and Release: The Renter understands and acknowledges that upon signing and agreement of this document, Renter discharges MY KIDZ SOFT PLAY PH from any liability or claim that the Renter may have against MY KIDZ SOFT PLAY PH with respect to any bodily injury, personal injury, illness, death or property damage that may result from Renters use and possession of MY KIDZ SOFT PLAY PH equipment. Renter does hereby release and forever discharge and hold harmless MY KIDZ SOFT PLAY and its successors and assigns from any and all liability claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Renters possession and use of MY KIDZ SOFT PLAY PH equipment.

 

Insurance: The Renter understands that insurance for liability, health, and medical or disability coverage in any way related to the rental of equipment under this agreement is the sole responsibility of Renter.

 

Indemnification: The Renter agrees that he/she will indemnify and hold MY KIDZ SOFT PLAY PH harmless from any liability resulting from the use of MY KIDZ SOFT PLAY PH equipment by Renter, his / hers assigns, heirs, guests, invites or other persons using the equipment while in Renter’s possession.

 

Other: The Renter expressly agrees that this Release is intended to be as broad and inclusive as permitted by laws of the Republic of the Philippines and that this Release shall be governed by and interpreted in accordance with the laws of Republic of the Philippines. The Renter agrees that in the event that any clause or provision shall not otherwise affect the remaining provisions of this Release, which shall continue to be enforceable.
