OVERVIEW Because employees, volunteers and contractors of Bethel World Outreach Center work with the private personal and financial information of donors and the ministry as a whole, a crucial aspect of each person’s responsibilities is the protection of this confidential information. To achieve this goal, you are asked to sign this Confidentiality Agreement. If you are faced with a request and are in doubt about disclosing information, please consult with the Executive Pastor before proceeding. AGREEMENT 1. The parties acknowledge and agree that during the term of employment, voluntary labor or contract labor and in the course of the discharge of Employee’s, Volunteer’s or Contractor’s duties during the term of employment, voluntary labor or contract labor, he or she shall have access to and become acquainted with information concerning the operation and processes of Employer, including without limitation, financial, personnel, fundraising, current or any future and proposed work, services, or products, the facts that any such work, services, or products are planned, under consideration, or in production, as well as any descriptions thereof, and other information that is owned by Employer and regularly used in the operation of Employer’s ministry, and that such information constitutes Employer’s confidential information. 2. Employee, Volunteer or Contractor specifically agrees that he or she shall not misuse, misappropriate, or disclose any confidential information, directly or indirectly, to any other person or use them in any way, either during the term of employment, voluntary labor or contract labor or at any other time thereafter, except: (a) as is required in the course of his or her employment, voluntary labor or contract labor; or (b) as is required by applicable state or federal law. 3. Employee, Volunteer or Contractor acknowledges and agrees that the sale or unauthorized use or disclosure of any confidential information obtained by him or her during the course of employment or voluntary labor under this agreement constitutes unfair competition. Employee, Volunteer or Contractor promises and agrees not to engage in any unfair competition, either during the term of employment or voluntary labor or at any other time thereafter. 4. Employee, Volunteer or Contractor further agrees that all files, records, documents, drawings, specifications, equipment, software, and similar items relating to Employer’s ministry, whether prepared by Employee, Volunteer, Contractor or others, are and shall remain exclusively the property of Employer.
