In consideration of being permitted to enter the facilities at TOP GUN INDOOR RANGE & FIREARM CENTER, and/or being permitted to shoot and/or observe any activity thereon, I, on behalf of myself, my heirs, successors and assigns and such parties for whom I sign (collectively “Releasors”) their heirs, successors and assigns agree that I: 1. Fully understand and appreciate the dangers, hazards, and risks inherent in a firing range, including the inherent risks associated with the use and misuse of firearms. 2. Acknowledge and understand that I will be voluntarily engaging in activities that involve the discharging of firearms which may result in the risk of serious injury, scarring, loss of an important bodily function, hearing loss or ear damage, permanent disability, or death, and may cause severe social or economic losses due to not only my own actions, inaction or negligence, but also to the action, inaction or negligence of others or conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time. 3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability, or death. 4. Release from, waive and discharge all actions, claims, or demands that Top Gun Indoor Range & Firearm Center, LLC. and David V. Couch, and/or their assignees, heirs, guardians, and legal representatives now have or hereafter have for damage or losses on account of injury, including permanent disability and death or damage to property, caused or alleged to be caused in whole or in part by the negligence or other acts of Top Gun Indoor Range & Firearm Center, LLC. and David V. Couch, and its shareholders, directors, officers, employees or agents, as a result of my participation in any gun-related activities. I hereby agree and covenant to save and hold harmless, indemnify, and defend any claim against Top Gun Indoor Range & Fire Center, LLC. and David V. Couch, and its shareholders, directors, officers, employees or agents, as a result of my participation in any gun-related activities. I hereby agree and covenant to save and hold harmless, indemnify, and defend any claim against Top Gun Indoor Range & Fire Center, LLC. and David V. Couch, and its shareholders, directors, officers, employees or agents, arising out of my use of the firing range. 5. I authorize Top Gun Indoor Range & Firearm Center, LLC the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures or video taken of me and my likeness to be used in and/or for any lawful promotional materials including, but not limited to, newsletters, flyers, posters, brochures, advertisements, websites, any and all social media sites, and any other print and digital communications. 6. Agree to comply with all laws of the United States of America and the State of Tennessee. 7. I am not under the influence of drugs or alcohol.
8. I have not been denied the purchase of a firearm through lawful means.
9. I am lawfully permitted to possess and handle a firearm.
10. I have not been convicted of a felony or domestic violence.
11. I am not depressed or having suicidal or homicidal thoughts, nor have I made plans to carry out an act of suicide or homicide.
12. I understand that if I have rented a firearm it is not permitted to leave the property or be used in a manner other than what was specified at the time of rental.
13. I will follow the instructions of the Range Safety Officer and will seek his/her guidance for any questions I have regarding a firearm or related activities.
14. I will abide by all rules set forth by Top Gun Indoor Range & Firearm Center.
15. [Parents of minors only] Agree (if a Parent(s) or legal guardian(s) of minor participants (age 17 and below)) to instruct the minor participant to the above warnings and conditions and their ramifications, and consent to the minor’s participation. Parent(s) also acknowledge that I have full legal authority to sign as a guardian and waive their rights. 16. Fully understand if I am pregnant, may be pregnant, or am trying to become pregnant, I should not be in the firing range area as this poses a risk for lead exposure that may pass to my unborn child. 17. No person under the age of twenty-one (21) is allowed to use any fully automatic weapon. I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT AND I DO SIGN IT VOLUNTARILY. I AGREE TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL. I ACKNOWLEDGE RECEIVING A COPY OF THE RULES AND REGULATIONS OF THE FIRING RANGE AND AGREE TO ABIDE BY THEM. Four Fundamental Safety Rules - All guns are always loaded
- Never point a gun at anything you are not willing to destroy
- Keep your finger off the trigger until your sights are on the target
- Be certain of your target and what’s beyond
Top Gun Range Rules - Guns not in the booth must remain holstered, in a bag, or in a carrier
- Handle the firearm only inside the firing booth, forward of the yellow line
- Only graduates in good standing of Beyond the Permit or Mastering the Pistol I may draw from the holster
- If anything (gun, magazine, ammunition, etc…) falls forward of the white firing line, do not retrieve it. Ask the Range Safety Officer for assistance.
- Only one shooter in the booth at a time
- No cross-lane shooting
- Do not shoot the floor, ceiling, walls, or other range equipment. Ensure every round impacts the backstop
- Keep the gun pointed in safe direction at all times
- Eye and ear protection are mandatory
- No steel-cased, steel core, tracer, bolo, flechette, or armor piercing ammunition
- No blackpowder arms allowed
- Pistol calibers only unless using Top Gun’s frangible ammunition
- Full-auto firearms are allowed only under director supervision of Top Gun staff with Top Gun firearms and ammunition.
- There is to be no horseplay
- No food, drink, smoking, or electronic cigarettes on the range
- Range appropriate attire should be worn. Open toed shoes, low cut tops, etc…should be avoided. A covering garment will be provided as a courtesy.
- No one under the influence of any substance is allowed on the range. Those smelling of drugs or alcohol will not be all
- Pregnant women are not allowed to use the range
- If you have any issues with your firearm or range equipment, ask the Range Safety Officer for help
- The Range Safety Officer has authority over every aspect of the range, and has the final say over all range activities.
- Those unwilling to follow Top Gun’s range rules or safety rules will be expelled.
- No person under the age of 21 is allowed to use any fully automatic weapon.
