(“CUSTOMER”) HEREBY ACKNOWLEDGES THAT CUSTOMER HAS VOLUNTARILY DECIDED TO ENTER INTO AND USE THE FIREARM RANGE FACILITIES AN THE BULLET RANCH (“TBR”), 12425 BROAD STREET SW, PATASKALA, OHIO 43062. CUSTOMER ACKNOWLEDGES AND UNDERSTANDS THAT SHOOTING AND RELATED ACTIVITIES INCLUDING, BUT NOT LIMITED TO ALL USES OF THE TBR RANGE FACILITIES AND MAY INCLUDE THE USE OF LIVE AMMUNITION. CUSTMER ACKNOWLEDGES AND UNDERSTANDS THAT “RANGE” MEANS THE FACILITIES WHERE LIVE FIRE EXERCISES ARE COMMENCED. CUSTOMER ACKNOWLEDGES AND UNDERSTANDS THAT SHOOTING, ARCHERY AND RELATED ACTIVITIES ARE INHERENTLY HAZARDOUS. Both involve known and unanticipated risks which could result in damage or destruction of property and physical and emotional injury, including paralysis or death, of customers or of other persons. Customer understands that such risks cannot be completely eliminated. The risks include but are not limited to: Gun/Bow Shot injuries to Customer or others; Partial or total loss of eyesight or hearing; Inhalation and other harmful contact with lead or other contaminants; Injuries from falling debris; Injury to self from mistakes in gun or bow handling such as injuries to fingers or hands. Customer acknowledges and agrees that Customer is competent to handle firearms and or archery equipment and has been adequately trained in the safe use of firearms and or archery equipment. Customer further acknowledges and understands that the range has both known and unanticipated hazards which create risks on the range. Customer understands and acknowledges that such risks and hazards cannot be completely eliminated. Customer further acknowledges and understands that The Bullet Ranch has no duty to undertake first-aid or first responder treatment in the event Customer suffers injury from any risk or hazard associated with the Customer’s use of the range. ABILITY TO POSESS FIREARMS: Customer acknowledges that live firearms are used on The Bullet Ranch’s Range. Customer acknowledges that he/she is not disqualified or disabled by law from possession or use of firearms in any manner whatsoever. Such disqualifiers include, but are not limited to the following: Being a fugitive from justice; being under indictment for or having been convicted of a felony offense of violence or a felony offense involving a drug of abuse whether violent or not or having a similar juvenile record; Being a drug dependent, in danger of being a drug dependent, an unlawful user of a controlled substance or addicted to such controlled substance, or being a chronic alcoholic; Having been adjudicated a mental incompetent or defective or committed to a mental institute involuntarily; Having been convicted of a crime that had the potential of more than one year in prison; Being an illegal alien of the United States of America; Having been discharged from the United States Armed Forces under dishonorable conditions; Having renounced one’s United States Citizenship; Being under a civil protection order; Domestic Violence: Having been convicted of a crime that involves an element of use, threatened use or attempted use of physical force (i.e. violence) and that involves a victim who is a spouse, a former spouse, parent, ward whereby Customer was the ward’s guardian), with whom there is a child in common, with whom there was cohabitation, or any similarly situated person. RULES AND REGULATIONS: Customer agrees to strictly follow all Rules and Regulations of The Bullet Ranch which are posted on the range and on The Bullet Ranch website. Customer acknowledges that it is Customers responsibility to read TBR Rules and Regulations. Customer agrees to abide by all rules concerning ammunition. Customer acknowledges that if The Bullet Ranch determines that Customer is not or has not followed rules concerning ammunition that Customer will be liable for any and all damages caused by violating the rules concerning ammunition as well as being permanently barred from The Bullet Ranch facilities until TBR determines otherwise. Customer acknowledges that The Bullet Ranch maintains the sole authority to determine if a Customer is being unsafe or violating the rules and regulations at any time which could result in permanent removal from The Bullet Ranch facilities. ALLOWABLE RIFLE CALIBERS: .All rifle calibers except .50cal; .50cal allowed only with prior approval from The Bullet Ranch. ALLOWABLE PISTOL CALIBERS: All common pistol calibers (.22lr – 44mag) as determined by The Bullet Ranch in its sole discretion. NON-ALLOWABLE AMMUNITION: Armor piercing; Tracer; Incendiary; Steel Core/Steel Case; USED BRASS POLICY: Customers may collect their brass only if that brass is located BEHIND the firing line and can be collected in a safe manner. Brass that is located downrange may only be collected with the approval and supervision of TBR staff. FIREARMS NOT OWNED BY CUSTOMER: Customer acknowledges that if customer is borrowing or renting a firearm from TBR that Customer is responsible for the safe functionality and handling of the firearm. Customer understands and acknowledges that the firearm may have been used by several people before him/her and that its usage history is unknown. CUSTOMER RESPONSIBLE FOR RANGE DAMAGE: If at any time Customer damages the firing range, to include but not limited to shooting down the lines, or use of broad heads on the archery range, Customer agrees to pay for the replacement and repairs caused by Customer’s damage. ALLOWABLE ARROWS FOR ARCHERY, only field points are allowed, NO BROADHEADS ALLOWED AT ANY TIME.
[intial] CUSTOMER AGREES that Customer, Customers next of kin, heirs, guardians, representatives and assigns RELEASE, FOREVER DISCHARGE, INDEMNIFY, HOLD HARMLESS AND AGREE NOT TO SUE The Bullet Ranch and The Bullet Ranch subsidiaries, affiliates, officers, directors, agents, employees, and representatives from and against any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, (including reasonable attorney’s fees and disbursements), that may result from Customer’s use of range and instructional facilities, products, or equipment, or engaging in or observing shooting or archery and other activities, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act or omission to act, including negligent or omitted first-aid or rescue operations or procedures, by The Bullet Ranch. CUSTOMER ACCEPTS THE BULLET RANCH’S FACILITIES AS IS, MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND REGARDING ITS DESIGN, MANUFACTURE, MAINTENANCE, CONDITION OR FITNESS FOR A PARTICULAR PURPOSE OF ANY RANGE, INSTRUCTIONAL FACILITY OR EQUIPMENT INCLUDING BUT NOT LIMITED TO: FIREARMS, AMMUNITION, EYE/HEARING PROTECTION AND FIRST-AID SUPPLIES. THE BULLET RANCH SPECIFICALLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CUSTOMER HEREBY ASSUMES ALL RISKS AND LIABILITY ASSOCIATED WITH THE CUSTOMER’S USE OF THE RANGE UNDERSTANDING THE INHERENT RISKS OF ACCIDENT OR INJURY AND RELEASE AND FOREVER DISCHARGE THE BULLET RANCH, ITS EMPLOYEES, OFFICERS AND AGENTS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY AND OR PROPERTY DAMAGE OF ANY KIND WHETHER SUCH PERSONAL INJURY OR PROPERTY DAMAGE IS CAUSED BY NEGLIGENCE OF THE BULLET RANCH, OR ITS EMPLOYEES, OFFICERS OR AGENTS OR OTHERWISE. CUSTOMER HEREBY AFFIRMS THAT CUSTOMER IS IN GOOD PHYSICAL HEALTH AND DOES NOT SUFFER FROM ANY DISABILITY THAT WOULD PREVENT CUSTOMER FROM PARTICIPATING IN SHOOTING OR RELATED ACTIVITIES ON THE BULLET RANCHES RANGE OR FACILITY.
