Release Waiver

I/We (hereinafter THE UNDERSIGNED), in return for use of premises and/or instruction in firearms and for other good and

valuable consideration, the receipt and sufficiency of which is hereby acknowledged, agree to the following:

THE UNDERSIGNED acknowledges and understands that discharging firearms is a dangerous act and that he/she is giving up

potentially valuable legal rights by signing this waiver and has had the opportunity to consult legal counsel to seek advice if

he/she so desires, and in the absence of doing so, THE UNDERSIGNED is not under a legal disability and expressly agrees to

bind him/herself as he/sees fit and, thus, is bound by the terms of this waiver.

 

THE UNDERSIGNED agrees to indemnify and hold harmless PROSHOTS and any of its employees, managers, members,

directors, officers, or agents (hereinafter, collectively, ProShots), from any and all fault, liabilities, costs, expenses, claims,

demands, or lawsuits arising out of, related to or connected with: the discharge of firearms; the course of instruction; ProShots

range, buildings, land, and premises (hereinafter the PREMISES); and, THE UNDERSIGNEDs presence on or use of said

PREMISES even if ProShots was acting in a negligent manner. In addition, should any such claim, demand or lawsuit arise or be

asserted in any way whatsoever related thereto, whether arising under the laws of the United States, the state of North

Carolina, or any other state, or under any theory of law or equity, THE UNDERSIGNED will indemnify, hold harmless and defend

ProShots from any and all costs, expenses, or liability including, but not limited to, the cost of any settlement or judgment

made or rendered against ProShots, whether individually, jointly, or in together with THE UNDERSIGNED, together with all

costs of court and other costs or expenses incurred in connection with any such claim, demand or lawsuit, including attorneys

fees.

 

THE UNDERSIGNED furthermore waives for himself/herself and his/her executors, administrators, assignees, or heirs, any and

all rights and claims for damages, losses, demands, and any other actions whatsoever, which he/she may have or which may

arise against ProShots (including but not limited to any and all injuries, damages or illnesses suffered by THE UNDERSIGNED or

THE UNDERSIGNEDs property) which may, in any way whatsoever, arise out of, be related to, or be connected with: a course

of instruction; the PREMISES (including any latent defect in the PREMISES): THE UNDERSIGNEDs presence on or use of the

PREMISES; THE UNDERSIGNEDs property (whether or not entrusted to ProShots); and, the discharge of firearms, even if

ProShots was acting in a negligent manner.

 

THE UNDERSIGNED hereby expressly assumes the risk of entering the PREMISES and of taking part in activities on the

PREMISES that include, but are not limited to, the discharge of firearms and the firing of live ammunition. THE UNDERSIGNED

furthermore hereby acknowledges and agrees that he/she has read, understands and will at all times abide by this waiver and

ProShots rules and procedures. THE UNDERSIGNED further acknowledges and agrees that this waiver remains in effect unless

and until he/she is required to sign an updated version of this waiver in the future as a condition to future use of the

PREMISES. This waiver binds THE UNDERSIGNED and his/her executors, administrators, assignees, or heirs.

 

THE UNDERSIGNED also understands that he/she is responsible for conducting himself/herself in a safe, responsible, and

proper manner when on the range and when handling firearms.
