3N’s Vacation Services Waiver and Release of Liability Agreement

Participant(s) listed below, hereby execute this General Release (hereinafter referred to as “Release”) voluntarily in order to participate and engage in activities provided by 3N’s Vacation Services Enterpriseand our partners (hereinafter referred to as the “Provider) and property owned and operated by 3N’s Vacation Services and our partners.

Participant(s) understands that during participation in outings offered by the Provider, exposed to a variety of hazards and risks, foreseen or unforeseen, are inherent and cannot be eliminated without destroying the unique character of the outing. These inherent risks include, but are not limited to, the dangers of minor or serious personal injury, property damage, and death (“Injuries and Damages”) from exposure to the hazards of the natural elements of the outdoors including the animals, and the Provider has not tried to contradict or minimize my understanding of these risks. Participant(s) knows that Injuries and Damages can occur by natural causes or activities of other persons, animals, or third parties, either as a result of negligence or because of other unforeseen events. Participants acknowledge that risks such as Injuries and Damages are involved in eco-tours, underwater tours, boating tours, interactions with animals, andsimilar related outdoor activities. Participants understand the need to exercise extra care and caution for their own person and property, in addition to the property provided by the Provider.

In consideration of participation in activities offered by the Provider, the Releasor(s) agrees to as follows:

  • Releasor(s) is qualified, in good health, in proper physical condition to participate in such activities and willingly agrees to comply with the customary terms and conditions of participation.
  • Releasor(s) agrees to discontinue participation in activity if at any time conditions appear unsafe or not in the best interest of the Releasor or the Provider.
  • Releasor(s) agrees that if I suffer injury or illness the Provider can, at my cost, arrange any medical treatment and emergency evacuation service as it or they deem necessary for my health and safety. Further, I agree at all times during the tour, to abide by and comply with any additional instructions given by the Provider and I accept that non-compliance may result in injury, death or permanent disability. I understand that non-compliance may result in my removal from the tour.
  • Releasor(s) waives, discharges and covenants not to sue Provider, its officers, director, employees, representatives, contractors, subcontractors, captains and agents from all liability to the Releasor(s), his/her personal representatives, assigns, heirs, next of kin for all loss or damage, and any claim or damage therefore, on account of injury to the person or property or resulting in death or serious injury to the Releasor(s), whether caused by negligence of Provider or otherwise, while participating in activities offered by the Provider.
  • Releasor(s) acknowledge and accepts all risks including, but not limited to falls, slips, collisions, shark and pig bites, or other such accidents that occur while participating in the activities of Company or using or operating Company’s equipment (including watercraft operated by Company) , the misuse or failure of equipment or tools (including watercraft operated by Company), the negligence or lack of adequate training of Company owners, employees, representatives, volunteers, or agents who seek to assist with medical or other help either before or after injuries have occurred.
  • Releasor(s) hereby assumes all responsibility for any risk of bodily injury, death or property damage arising out of or relating to activities whether caused by the negligence of the Provider or otherwise.
  • Releasor(s) agrees to indemnify the Provider from any loss, liability damage or cost Provider may incur due to the presence of the Releasor(s) in or on the Provider’s property, whether cause by negligence or otherwise.
  • Releasor(s) acknowledge that the Provider is not responsible for any food allergies or food-borne illness resulting from food or beverages provided or food or beverages consumed while participating on the tour. Guests are responsible for their own health and determining whether a particular food is safe to consume.
  • This release contains the entire agreement and Releasor(s) is not relying on any oral or written representation or statements made by the Provider or its employees or agents. Releasor(s) further agrees that this release shall be governed by the laws of the Commonwealth of the Bahamas and venue shall lie in Commonwealth of the Bahamas,
  • Releasor(s) hereby declares that he/she is of legal age and competent to sign this release.
  • By participating in or attending any activity in connection with this program, whether on or off the premises, I consent to the use of photographs, pictures, film or videotape taken of me or provided by me for publicity, promotion, television, websites or any other use, and expressly waive any right of privacy, compensation, copyright or other ownership right connected to the same.
  • By signing this release, Releasor(s) acknowledges that he/she has carefully read the agreement, understands it, agrees to be bound by it, and signs it on his/her own free will.
  • For parents/guardians of participants of minor age (under 18 at time of registration): This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/ her release as provided above of all the Releasees, and, for myself, my heirs, assign, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child’s involvement or participation in these programs as provided above, even if arising from the negligence of the releasees, to the fullest extent permitted by law.
  • Releasor(s) understand the risks, hazards, and dangers as described above. I understand my own responsibilities and I participate in the tour of my own free will, and with full knowledge of the inherent risks, hazards, and dangers involved and hereby assume and accept any and all risks involved.
  • Releasor(s) will not hold 3N's Vacation Services or our employees or agents accountable for the contraction of COVID19 or any other communicable diseases. 
  • Releasor(s) understand the risk associated in participating in this tour and fully accept all inherent risks related to the COVID19 pandemic. 
  • Releasor(s) freely and voluntarily assume complete personal responsibility for all risks and for death, injury or damage that may occur to me, or my child or ward, or my, or my child’s or ward’s property as a result of these risks even if such death, injury or damage occurs in a manner that is not foreseeable at this time. I realize that by voluntarily assuming the risks involved, I will be solely responsible for my, injury or damage, or injury or damage sustained by my child or ward.
  • I acknowledge, understand and appreciate that my participation, and/or the participation of my child(ren) and/or ward(s), in the ACTIVITIES such as boat experience and flights entails known as well as unanticipated risks that could result in death, serious physical or emotional injury, paralysis, or damage to me, my child(ren), my ward(s) and to any minors on whose behalf I sign this Agreement, to property, or to third parties. I further acknowledge, understand and appreciate that such risks simply cannot be eliminated without jeopardizing the essential qualities of the ACTIVITIES such as boat tours, interactions with animals and flights. I acknowledge that flights are a dangerous activity and I agree to join in this tour with this knowledge . These risks include, among other things: slipping and falling; collision with fixed objects or people; flight crash or other mishaps,  injuries caused by stepping on or falling on equipment or items that have fallen from or were dropped by myself or another participant; injuries including, sprains, fractures, scrapes, bruises and cuts, dislocations, pinched fingers and serious injuries to the head, back, or neck; injuries arising out of the negligence of or otherwise caused by other participants, myself, my child(ren), my ward(s) and any minor upon whose behalf I sign this Agreement; injuries due to the physical or mental condition or any medical condition that I, my child(ren), my ward(s), or any minor on whose behalf I sign this Agreement may have whether known or unknown; injuries due to physical contact with others, including the risk of contracting illness or coming into contact with germs, bacteria or fungi whether by contact with equipment or with another participant, and any and all risks associated with exercise, physical exertion and physical activities (hereinafter referred to collectively as the "RISKS").

Lastly, I consent to the use of electronic signatures, and agree that my use of an electronic signature shall be valid as an original signature. I understand and agree that this Waiver and Release Agreement and any other documents requiring a signature hereunder may be signed electronically. I agree not to deny the legal effect or enforceability of this Waiver and Release Agreement solely because it is in electronic form or because an electronic record was used in its formation.
