Equine Activity Release and Hold Harmless Agreement

 

I / We, the undersigned have read and understand, and freely and voluntarily enter into this “Release and Hold Harmless Agreement” with Sweet Dixie South LLC, Mike Campbell, Kelly Campbell, the Long Pond Community, RCR Equestrian Inc, Ronny Riemer, Chanel Riemer, Hardford Farm LLC, Mark Stopford, Michelle Harding Stopford, Diasti Stables, Derek Diasti, Jennifer Diasti, employees, and agents thereof, understanding that this Release and Hold Harmless Agreement is a waiver of any and all liability.

I understand the potential dangers that I could incur mounting, riding, walking, feeding, boarding, grooming any equine; including but not limited to interactions with others and their horses. Understanding those risks I hereby release Sweet Dixie South LLC, RCR Equestrian Inc, Hardford Farm LLC, Diasti Stables, and all their officers, directors, shareholders, employees, and anyone else directly or indirectly connected with the companies from any liability whatsoever from any activity on the premise in the event of injury or damage of any nature (even death) to me or anyone else. Whether I am electing to mount and ride a horse, boarding for a horse, feeding, training, and any other activity I may participate in during my stay at the facility.

I further voluntarily agree and warrant “Release and Hold Harmless” any and all equine professionals from liability and whatsoever, including but not limited to incident caused by negligence, relating to injuries known, unknown, or otherwise not herein disclosed; including, but not limited to injuries, death, or property damage from: mounting, riding, dismounting, walking, grooming, feeding, use of horses, barns, paddocks, trails, and arenas in any capacity; falling off horse whether horse is bucking, misbehaving, spooked, or my failure to understand any equine. Professionals’ directions relating to my riding or otherwise use and control. Or lack thereof, of my horse or the horse I have been assigned to.

I understand that wildlife can pose a threat to the safety of any animal I bring onto the property, and acknowledge that Sweet Dixie South LLC and Diasti Stables, shall not be held responsible in any way for any form of injury or fatality brought on by wildlife. I will assume all risk that may be presented, including but not limited to variations in the terrain, including if in the event it is my own animal out of control.

I will determine whether or not I am, or my child is competent and physically able to participate in equine activities.

I will exercise my own judgement as to the use of certain safety precautions, including but not limited to wearing a riding helmet.

I agree to be held responsible for any damages caused, but not limited to broken fence boards, damage to any stall or stalls, gates, wash racks, arena rails, stadium jumps, cross country fences, power poles, electrical and or trailer hookups including water, electric, sewer.. I agree to pay for any and all damage caused to the property or persons on facility during my stay, caused by myself, my animals, or any guest with me here at Sweet Dixie South LLC and Diasti Stables.
