Fatbike Adventures - Agreement Releasing Waiver of Liability

This form is an important legal document.  It explains the risks you are assuming by beginning an exercise program.  It is critical that you read and understand it completely.  After you have done so, please print your name & contact details legibly and sign in the spaces provided below.

Waiver, Informed consent, and Covenant Not to Sue

I hereby understand and acknowledge that engaging in activities using Bicycles and Fat Bikes and participating in Bike tours may expose me to many inherent risks including accidents, injury, illness or even death. I do here and forever release and discharge and hereby hold harmless Fat Bike Adventures and their representatives and employees from any and all claims, demands, right of action, causes of action present and future arising out of or connected with my participation in any Bike tour or from the hiring and usage of a Bike.  This Waiver and Release of liability includes without limitation, injuries which may occur as a result of:

  1. My use of all bikes and equipment provided by Fat Bike Adventures.
  2. My participation in any activity, class, programme, tour, personal training or instruction.
  3. Equipment that may malfunction or break.
  4. Negligent instruction or supervision.
  5. Slipping and/or falling and or dropping equipment while renting a bicycle or Fat Bike or participating in a Fat Bike Tour.

ASSUMPTION OF RISK

To the best of my knowledge I am in good physical condition and have no disease, physical limitation, health concern or injury that would be aggravated or would be the cause of any injury sustained, before, during or as a result of my participating in activities related either directly and/or indirectly to Fat Bike Adventures.

I recognise that Fat bike tours and the hiring of bicycles of Fat bikes involves exercise that might be difficult and strenuous and that there could be dangers inherent in exercise for some individuals. I acknowledge that advanced identification of the possibility of certain unusual physical changes during exercise does not exist. These changes include abnormal blood pressure; fainting; disorders in heartbeat; heart attack; and in rare instances, death.

I understand that as a result of my participation in a Fat Bike Tour or during the hiring or riding of a bicycle of Fat Bike, I could suffer an injury or physical disorder that could result in my becoming partially or totally disabled and incapable of performing any gainful employment or having a normal social life.

I recognise that an examination by a medical expert such as a general practitioner should be obtained by all participants prior to involvement in any Fat Bike tour or the hiring and riding of a Fat Bike or bicycle.  If I have chosen not to obtain a medical expert’s permission prior to beginning engaging any of the above referred to activates with Fat Bike Adventure, I hereby agree that I am doing so at my own risk.

I hereby acknowledge that engaging in activates and tours using bicycles or Fat Bikes are inherently dangerous and I am fully aware of the risk of personal injury or death and I will hold Fat Bike adventures harmless for any injuries up to and including death that may arise during the use of a bicycle or Fat Bike or during the participation of a Fat Bike Tour.

In any event, I acknowledge and agree that I assume the risks associated with any and all activities and/or exercise in which I participate.

I give full permission to Fatbike Adventures to utilize any photographs and video footage that include me for marketing purposes with their online and printed materials.

I agree to reimburse Fatbike Adventures for the cost of any damages to the rental fatbikes and/or equipment that may occur during the tour/rental period.

I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY.  BY SIGNING THIS DOCUMENT,I AM WAIVING ANY RIGHT I OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST FAT BIKE ADVENTURES FOR YOUR NEGLIGENCE OR THAT OF YOUR EMPLOYEES, AGENTS OR CONTRACTORS & LANDOWNERS

Please Note: Signature of Parent/Legal Guardian, individually and in the capacity as Parent/Legal Guardian is required if the Participant is under 18 years of age.
