This Privacy Policy (the “Policy") applies to the websites located at www.ultimateninjawarriorli.com, and any other websites/applications (including the Ultimate Ninja Warrior mobile application) owned and operated by Ultimate Ninja Warrior, LLC., it parents or its affiliates (the “Company”) that direct the viewer or user to this Policy and any documents that direct the viewer or user to this Policy. This Policy explains how the Company collects and uses information of individuals who visit and/or use its websites, its mobile application or who supply covered information to the Company directly or via its franchisees. The Company’s websites and mobile application may contain links to websites/applications that are owned and operated by other companies. You may also have the option to login to the Company’s website through sites that are operated by third parties. This Policy does not apply to websites/applications that are owned and operated by third parties and you should consult those separately. By using the Company’s websites and mobile application you agree to the terms and conditions of this Policy. If you do not agree to the terms of this Policy, do not visit the Company’s websites, use its mobile application or submit any personal information.

Changes to This Policy

The Company reserves the right to modify or amend this Policy at any time by posting the updated version on its website and changing the date listed at the top of this Policy. Any material changes in how it uses or shares the information it collects will only affect information collected after the posting of the updated Policy, unless otherwise expressly stated. Collection of Personal Information

“Personal Information” is information that identifies or could be used to identify you which is collected by the website or mobile application or is otherwise submitted to the Company. Personal Information can be either information submitted by you or information which is passively collected.

The Company collects information you voluntarily give to it or its franchisees, such as your first and last name, e-mail address, physical address, telephone number, username, password, payment information, age, birthday, demographic data or any other information you choose to provide when you participate in a survey or promotion, submit content or feedback, fill out forms or questionnaires, set up a registration, sign up to receive information about the Company, sign up to participate in personal training services, or otherwise input information via the Company’s website or mobile application. When you contact the Company online, it may keep a record of that correspondence. When you use the Company’s services, or services offered by its franchisees, it may also collect information about the services you use and how you use them.

The Company is also provided with information automatically when you use a computer, tablet, smart phone or other device to access its website or mobile application or to interact with it online. It may collect information about the device and how you use it. This may include information about the type of device you’re using, your operating system, your browser, your internet service provider, your domain name, your internet protocol (IP) address, the date and time that you accessed the website or mobile application, the web pages you accessed, the subject of any ads you click or scroll over and the number of clicks. To collect this information, the Company uses cookies, web beacons and other similar technology. The Company may allow third parties to collect information about you by setting their own cookies, web beacons and other similar technologies on its website or via our mobile application.

When you use a computer, smart phone or other mobile device to access the Company’s website or mobile application, it may collect information about your physical location. It may combine this information with other location-based information, to give you information about Company offerings near you and to provide you with other services. The Company can only collect
information regarding your location if the permissions in your mobile device allow communication of this information. Collectively, this information is used to provide a more customized and enjoyable online experience for visitors and to allow the Company to fulfill visitor requests. The Company also uses this information internally to compile data regarding website traffic and mobile application use.

To ensure your privacy is protected, it is recommended that you consult the privacy policies on any linked websites or applications. The Company is not responsible for the manner in which others use your personal information or from any damages suffered as a result of viewing or visiting any third party website or application. The Company also makes no endorsement or representation regarding anything found on a third party website or application.

California residents may request a notice disclosing the categories of personal information the Company has shared with third parties for the third parties’ direct marketing purposes. To request a notice, please contact the Company as described in the “Contact Us” section, below. The Company will make every effort to promptly respond to your request.

Collection of Information From Children

The Company’s websites and mobile application are not intended for use by anyone under the age of 13. The Company does not knowingly collect, use or disclose the personal information of children under the age of 13. If you are under the age of 13 you should not provide any information to the Company. The Company complies with the Children’s Online Privacy Protection Act. If you are a parent or guardian and believe the Company may have collected information about a child under the age of 13, please contact the Company as described in the “Contact Us” section below so reasonable steps can be taken to remove that information from the Company’s servers.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK


Review No Limit Ninja LLC. Privacy Policy

In consideration of the services of No Limit Ninja LLC., their agents, owners, officers, volunteers, participants, personnel, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as ("NLN"), I hereby agree to release, indemnify, and discharge NLN, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that my participation in ninja warrior birthday parties, ninja warrior training and instruction, parkour, open gym activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips, trips, and falls; falling from equipment; collision with other participants, spectators, or objects; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life threatening hazards; muscular soreness, tears, strains, sprains, dislocations, fractures and broken bones; cuts, bruises, and muscle soreness; foot, ankle, leg, wrist, arm and shoulder injuries; musculoskeletal injuries including head, neck, and back; eye injury or loss; being struck by other objects dislodged or thrown from above; the use and potential or actual failure of climbing ropes and equipment; the risk of falling off the wall; loose and/or damaged artificial holds; abrasions from the walls, ropes, pads, or the floor; equipment failure; belay and or belayer failure; climbing out of control or beyond one’s personal limits; injuries to internal organs; being struck by an axe; the negligence of other climbers, visitors, participants, or other persons who may be present; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity. In any event, if you or your child is injured, any medical assistance will be at your own expense

Furthermore, NLN personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless UNW/NLN from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of NLN's equipment or facilities, including any such claims which allege negligent acts or omissions of NLN.

4. Should NLN or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6. In the event that I file a lawsuit against NLN, I agree to do so solely in the state of New York, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

7.Image Release. Participant consents to be recorded, photographed, and videotaped related to the Event, and hereby irrevocably and perpetually authorizes any of the Released Parties to copyright, publish, reproduce, exhibit, transmit, broadcast, televise, digitize, display, otherwise use, and permit others to use (i) the Participant’s name, image, likeness, and voice, and (ii) all photographs, recordings, videotapes, audiovisual materials, writings, statements, and quotations of or by the Participant obtained related to the recording of the Event (collectively, the “Materials”), in any manner, form, or format whatsoever now or hereinafter created, including on the Internet, and for any lawful purpose, including, the advertising or promotion of the Released Parties and/or the Event without further consent from or payment to the Participant. The Participant understands that the Released Parties are under no obligation to use the Materials. Participant agrees that all of the Materials, and all films, audiotapes, videotapes, reproductions, media, plates, negatives, photocopies, and electronic and digital copies of the Materials are the sole property of the Released Parties and Participant further agrees not to contest the rights or authority granted to the Released Parties hereunder. The Participant hereby waives any right to inspect or approve the recordings, and modes of the use thereof as described above. Participant acknowledges and agrees that: (i) Participant shall not be entitled to any compensation for its appearance at the Event or subsequent use of its appearance in the Materials, (ii) Participant has and will refrain from any offensive or distasteful remarks or conduct and will conduct itself in a courteous and professional manner at all times during its participation at the Event and appearance in the Materials, and (iii) this Agreement is intended to be as broad and inclusive as permitted by applicable law.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against NLN on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at NLN.

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
