This Privacy Policy (the “Policy") applies to the websites located at www.ultimateninjawarriorli.com, and any other websites/applications (including the Ultimate Ninja Warrior mobile application) owned and operated by Ultimate Ninja Warrior, LLC., it parents or its affiliates (the “Company”) that direct the viewer or user to this Policy and any documents that direct the viewer or user to this Policy. This Policy explains how the Company collects and uses information of individuals who visit and/or use its websites, its mobile application or who supply covered information to the Company directly or via its franchisees. The Company’s websites and mobile application may contain links to websites/applications that are owned and operated by other companies. You may also have the option to login to the Company’s website through sites that are operated by third parties. This Policy does not apply to websites/applications that are owned and operated by third parties and you should consult those separately. By using the Company’s websites and mobile application you agree to the terms and conditions of this Policy. If you do not agree to the terms of this Policy, do not visit the Company’s websites, use its mobile application or submit any personal information.

The Company reserves the right to modify or amend this Policy at any time by posting the updated version on its website and changing the date listed at the top of this Policy. When you use the Company’s services, or services offered by its franchisees, it may also collect information about the services you use and how you use them.

The Company is also provided with information automatically when you use a computer, tablet, smart phone or other device to access its website or mobile application or to interact with it online. To ensure your privacy is protected, it is recommended that you consult the privacy policies on any linked websites or applications. The Company is not responsible for the manner in which others use your personal information or from any damages suffered as a result of viewing or visiting any third party website or application. The Company also makes no endorsement or representation regarding anything found on a third party website or application.

California residents may request a notice disclosing the categories of personal information the Company has shared with third parties for the third parties’ direct marketing purposes. To request a notice, please contact the Company as described in the “Contact Us” section, below. The Company will make every effort to promptly respond to your request.

Collection of Information From Children

The Company’s websites and mobile application are not intended for use by anyone under the age of 13. The Company does not knowingly collect, use or disclose the personal information of children under the age of 13. If you are under the age of 13 you should not provide any information to the Company. The Company complies with the Children’s Online Privacy Protection Act. If you are a parent or guardian and believe the Company may have collected information about a child under the age of 13, please contact the Company as described in the “Contact Us” section below so reasonable steps can be taken to remove that information from the Company’s servers.

Review Ultimate Ninja Warrior Privacy Policy

In consideration of the services of Ultimate Ninja Warrior LLC, their agents, owners, officers, volunteers, participants, personnel, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "UNW"), I hereby agree to release, indemnify, and discharge UNW, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

1. I acknowledge that my participation in ninja warrior birthday parties, ninja warrior training and instruction, parkour, open gym activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slips, trips, and falls; falling from equipment; collision with other participants, spectators, or objects; rope burns; pinches, scrapes, twists and jolts that could result in scratches, bruises, sprains, lacerations, fractures, concussions, or even more severe life threatening hazards; muscular soreness, tears, strains, sprains, dislocations, fractures and broken bones; cuts, bruises, and muscle soreness; foot, ankle, leg, wrist, arm and shoulder injuries; musculoskeletal injuries including head, neck, and back; eye injury or loss; being struck by other objects dislodged or thrown from above; the use and potential or actual failure of climbing ropes and equipment; the risk of falling off the wall; loose and/or damaged artificial holds; abrasions from the walls, ropes, pads, or the floor; equipment failure; belay and or belayer failure; climbing out of control or beyond one’s personal limits; injuries to internal organs; being struck by an axe; the negligence of other climbers, visitors, participants, or other persons who may be present; my own physical condition; and the risk of emotional and psychological injuries or physical damage associated with this activity. In any event, if you or your child is injured, any medical assistance will be at your own expense

Furthermore, UNW personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or instructions, and the equipment being used might malfunction.

2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless UNW from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of UNW's equipment or facilities, including any such claims which allege negligent acts or omissions of UNW.

4. Should UNW or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.

6. In the event that I file a lawsuit against UNW, I agree to do so solely in the state of Ohio, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against UNW on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at UNW.

I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
