PARTICIPANT, MEMBER & VISITOR WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

1. ACKNOWLEDGMENT OF ACTIVITIES AND POTENTIAL RISKS

I understand that participation in activities at Sooki Studio LLC involves hands-on creative work using materials, tools, equipment, and processes that require attention, care, and personal responsibility.

Activities offered by Sooki Studio LLC may include, but are not limited to:

  • Ceramics and pottery making
  • Pottery wheel use
  • Clay preparation and handling
  • Raku firing 
  • Glazing and kiln-fired work
  • Woodworking and wood craft activities
  • Use of hand tools and workshop equipment
  • Weaving, fiber arts, and textile-based crafts
  • Natural dyeing and use of plant-based or other dye materials
  • Other art, craft, and creative workshops and events offered by Sooki Studio LLC

I acknowledge that these activities involve inherent risks, including but not limited to:

  • Cuts, scrapes, punctures, splinters, or other injuries from tools, materials, equipment, or handmade objects.
  • Burns or heat-related injuries from kilns, fired ceramics, hot surfaces, heated tools, or other equipment.
  • Exposure to clay, ceramic materials, glazes, wood dust, fibers, dyes, pigments, cleaning products, and other workshop materials.
  • Allergic reactions, skin irritation, respiratory irritation, or sensitivities related to materials used during workshops.
  • Injuries resulting from improper use of tools, equipment, or materials.
  • Slips, trips, falls, or accidents caused by water, clay, wood scraps, fibers, equipment, or studio conditions.
  • Physical strain, repetitive motion injuries, fatigue, or discomfort associated with creative activities.
  • Damage to personal belongings, clothing, artwork, or personal property.
  • Unexpected outcomes or damage to handmade projects due to material characteristics, drying, firing, curing, or other creative processes.

I understand that creative work involves variables that cannot always be predicted or controlled and that injuries or damages may occur even when reasonable safety practices are followed.


2. ASSUMPTION OF RISK

I voluntarily choose to participate in activities at Sooki Studio LLC and knowingly accept responsibility for the risks associated with my participation and presence on the property.

I agree to:

  • Use tools, equipment, and materials only as instructed.
  • Follow all safety guidelines provided by instructors and studio staff.
  • Ask for assistance whenever I am uncertain about safely performing an activity.
  • Inform staff of any concerns, injuries, unsafe conditions, allergies, or limitations that may affect my participation.

I understand that my participation is voluntary and that I am responsible for making decisions regarding my own safety.


3. RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate in workshops, memberships, events, studio access, and activities provided by Sooki Studio LLC, I voluntarily release, waive, discharge, and agree not to hold liable Sooki Studio LLC, its owners, employees, instructors, contractors, representatives, agents, and affiliates from claims, demands, damages, injuries, losses, expenses, or causes of action arising from my participation or presence at the studio, except where prohibited by law.

This release includes claims arising from ordinary negligence related to the use of studio spaces, tools, equipment, materials, facilities, and participation in creative workshops and activities.


4. STUDIO SAFETY RULES AND PARTICIPANT RESPONSIBILITIES

I agree to:

  • Follow all instructions given by Sooki Studio LLC instructors and staff.
  • Use tools, equipment, and materials responsibly.
  • Maintain a clean and organized workspace.
  • Wear appropriate clothing and footwear suitable for studio activities.
  • Secure loose clothing, hair, and personal belongings when working around tools or equipment.
  • Use protective equipment when required or recommended.
  • Notify staff immediately of spills, damaged equipment, injuries, or unsafe conditions.
  • Respect other participants, instructors, members, guests, studio property, and shared workspaces.

Sooki Studio LLC reserves the right to stop participation or ask any participant, member, or guest to leave the premises if their actions create a safety concern, damage property, violate studio policies, or negatively impact the experience of others.


5. EQUIPMENT, MATERIALS, AND ARTWORK ACKNOWLEDGMENT

I understand that handmade and creative processes involve natural variations and uncertainties.

I acknowledge that:

  • Ceramic pieces may crack, break, warp, or change during drying, glazing, firing, or handling.
  • Wood projects may vary due to natural characteristics of wood, including grain, texture, movement, or imperfections.
  • Natural dyes and textile processes may produce variations in color, texture, and final results.
  • Handmade projects may not always produce the expected outcome despite proper instruction and care.
  • Sooki Studio LLC does not guarantee the completion, appearance, durability, or final result of any project created during a workshop or studio session.


6. PERSONAL PROPERTY

I understand that I am responsible for personal belongings brought into the studio.

Sooki Studio LLC is not responsible for lost, stolen, damaged, or misplaced items, including but not limited to:

  • Phones
  • Computers
  • Bags
  • Clothing
  • Personal tools
  • Artwork
  • Materials
  • Other personal property


7. HEALTH AND MEDICAL ACKNOWLEDGMENT

I confirm that I am able to safely participate in creative workshops and activities offered by Sooki Studio LLC.

I understand that some activities may involve:

  • Standing for extended periods
  • Sitting at workstations
  • Repetitive hand or arm movements
  • Handling tools and materials
  • Exposure to dust, fibers, dyes, and other substances

I agree to inform Sooki Studio LLC staff of any allergies, sensitivities, or conditions that may affect my participation.

In the event of an emergency, I authorize Sooki Studio LLC representatives to seek reasonable medical assistance if necessary. I understand that I am responsible for any medical expenses incurred.


8. MEMBERSHIPS, EVENTS, AND STUDIO ACCESS

This waiver applies to all participation and presence at Sooki Studio LLC, including:

  • Single workshops
  • Private events
  • Group events
  • Studio memberships
  • Open studio access
  • Member studio time
  • Guest access
  • Future classes, events, and creative activities

By signing this agreement, I acknowledge that it applies to my participation and presence during current and future activities at Sooki Studio LLC unless otherwise required by law.


9. GUEST AND VISITOR ACKNOWLEDGMENT

I understand that Sooki Studio LLC may allow members, participants, and guests to spend time on the studio premises, including accompanying friends, family members, or visitors.

Any person present at the Sooki Studio LLC property, whether participating in a workshop, observing, socializing, assisting, or accompanying another participant, acknowledges that they are entering a working creative studio environment where tools, equipment, materials, artwork, and active projects may be present.

Guests and visitors agree to:

  • Conduct themselves in a safe and respectful manner while on the premises.
  • Follow all posted studio rules and instructions provided by Sooki Studio LLC staff.
  • Avoid using tools, equipment, materials, workspaces, or supplies unless authorized and properly instructed.
  • Respect other members, participants, instructors, staff, and shared studio spaces.
  • Take responsibility for their own safety and personal belongings.

I understand that Sooki Studio LLC is not responsible for injuries, damages, or losses resulting from a guest or visitor’s decision to enter the premises, participate in activities, use equipment, handle materials, or remain in areas where studio activities are taking place.

Members are responsible for ensuring that their guests understand and follow applicable studio policies and safety expectations while visiting Sooki Studio LLC.

Sooki Studio LLC reserves the right to limit, restrict, or remove any guest or visitor whose behavior creates a safety concern, damages property, interferes with studio operations, or negatively impacts other members or participants.


10. ANIMAL AND PET RESPONSIBILITY ACKNOWLEDGMENT

I understand that Sooki Studio LLC may allow members, participants, and guests to bring personal animals onto the studio premises.

Any person bringing an animal onto the property agrees that they are fully responsible for the animal’s behavior, supervision, safety, and care while on Sooki Studio LLC premises.

Animal owners agree to:

  • Keep animals under control and supervised at all times.
  • Ensure animals do not interfere with studio activities, equipment use, instructors, staff, members, guests, or other participants.
  • Prevent animals from entering unsafe areas, including areas containing tools, equipment, kilns, materials, chemicals, or active workshop processes unless permitted.
  • Clean up after their animals and maintain a safe and sanitary environment.
  • Take responsibility for any injury, damage, loss, or disruption caused by their animal.
  • Ensure that animals brought onto the property are suitable for a shared creative workspace environment.

I understand that a ceramics and craft studio may contain materials, equipment, noise, movement, and conditions that may present risks to animals. I assume responsibility for my animal’s safety while on the premises.

I agree to release and hold harmless Sooki Studio LLC, its owners, employees, instructors, contractors, representatives, agents, and affiliates from claims, damages, injuries, or losses related to my animal’s presence on the property, except where prohibited by law.

Sooki Studio LLC reserves the right to request that an animal be removed from the premises if it creates a safety concern, damages property, disrupts studio operations, or negatively impacts other participants or guests.


11. PHOTOGRAPHY AND MEDIA ACKNOWLEDGMENT

By entering the Sooki Studio LLC property, I acknowledge and agree that photographs, video recordings, or other media may be captured during workshops, events, studio activities, and general studio use.

I understand that Sooki Studio LLC may use photographs, videos, or recordings that include me for non-commercial purposes, including but not limited to community updates, educational materials, studio documentation, website content, social media, newsletters, and other communications related to Sooki Studio LLC.

I understand that my image or likeness may appear in photographs or recordings taken while I am present at the studio and that I will not receive compensation for such use.

I acknowledge that I may be photographed or recorded simply by being present on the Sooki Studio LLC premises and voluntarily accept this condition of entry and participation.

If I have questions or concerns regarding photography or media use, I understand that I may communicate with Sooki Studio LLC staff.


12. LEGAL ACKNOWLEDGMENT AND GOVERNING LAW

I acknowledge that I have carefully read this Waiver, Release of Liability, and Assumption of Risk Agreement and understand that it is intended to be a legally binding agreement.

I understand that by signing this agreement, I am voluntarily giving up certain legal rights, including the right to bring certain claims against Sooki Studio LLC, its owners, employees, instructors, contractors, representatives, agents, and affiliates for injuries, damages, or losses arising from my participation or presence at the studio, except where such limitations are prohibited by law.

I acknowledge that I have had the opportunity to ask questions, seek clarification, and fully understand the terms of this agreement before signing.

This agreement shall be governed by and interpreted under the laws of the State of California.

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect to the extent permitted by law.


13. PARTICIPANT AGREEMENT

By signing below, I confirm that:
